On 3/17/18 we went into business to purchase a reclining couch & loveseat. This would have been the 3rd reclining couch we had bought from this business (the other 2 were floor models). We spoke with the salesperson about needing a couch with a long reclining length because we are taller people. He told us that he could order a couch with a reclining length of 96 inches when it was fully reclined. They did not have a demo model of this couch. We agreed to order it based upon his assurances and payed the full balance of $1228.00 for both pieces. When the couch was delivered to their warehouse on 3/31/18 we went to pick up the couch and loveseat. We asked that they be unwrapped so that we could measure this length. Measured length was 73 inches. We declined to take delivery and proceeded to the store to speak with the salesman, Chewy. Chewy was not available so we spoke with another manager and told them the issue and requested a refund. He told us that they could not process the refund until Monday & would take a restocking fee of 25% from the total charge. We felt this was unfair as we were very explicit regarding the furniture that we needed and it wasn't what we were promised. I told them we wanted a full refund. We filed a credit card dispute and were awarded a credit of $921. The amount the business kept the 25% restocking. In a normal instance I would understand a restocking fee. In this case it allowed us to be lured in by a salesman that misrepresented a product and then keep $307. for doing that.

To whom it may concern,

We completely understand Mrs. concerns and we apologize for any inconvenience. However, at the time the customer cancelled the order, the store manager offered to order a custom made set or store credit. Unfortunately, Mr. & Mrs. decided to cancel the items and per our terms and conditions a re-stocking fee applies to special order items. The items they chose were special order meaning it is a piece of furniture we not display or stored in the local warehouse.

I am rejecting this response because:

The salesman didn't offer an in store credit and it never occurred to me that you would not refund my money in full for furniture that was misrepresented to me by a store employee. The only thing I was told is that I would have to wait until Monday for a refund to be processed. We did speak about your stores ability to do a special order but if your salesman misrepresented one couch why would I order another? That doesn't make sense.
