Please understand that the heating contractor has sent the letter of intent to lien they have not filed a lienThe situation around this is that the contractor did not send an invoice to my office, he and I work normally on a verbal basesSo to that end my office assistant did not enter the amount in to the computer for paymentAfter which I ended up in the hospital and the invoice did get over looked and the monies were then paid out for other billsI am trying to recover in the business from not being in the office for almost a monthI have regular communication with heating contractor as to the status of the situation and we are taking care of this paymentAll of this I have communicated with Mr [redacted] In regards to the basement floor, I talked with Mr [redacted] at his home and we discussed the situationAt that time I had asked him to install a sump pump in the pit as it was close to being full of waterThe reason for the request was to determine the cause of the cracking in the floorAs we discussed I did not want to remove the existing floor and pour a new concrete slab without determining, if possible, the reason for the cracking as I did not want to put any of us through the situation a second timeWe have put additions on to other homes in the past and have not had this happen and the finishers that I use on the concrete projects work solely in the concrete profession, therefore the implication that we are not professional is untrueI also discussed with Mr [redacted] at that same time that we would replace the slab if neededSince that meeting I have not heard from Mr [redacted] and if I had received a voice mail or email from him I certainly would have responded as I have always responded to his calls in the past In as much as I have let Mr [redacted] know that I am willing to take care of the situation, there is no need for another company to be involved with this project

Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below.We have had weekly conversations with the heating contractor and he says BRK is not in contact with him which is why he keeps contacting us and is very unhappy with the way this has been handled as are weSo we would like him to be paid in full and a lien waiver sent to us as proof of payment as soon as possibleBRK might not think that this is a big problem but having a business threaten to put a lien on your property is a huge dealWe did the right thing by paying BRK on time and expected him to do the right thing and pay the people that worked on our project.As requested by BRK we installed the sump pump to satisfy his requestIt has not changed the status of the floor at allWe did try to contact BRK and received no responseSo after having several professional contractors evaluate the basement floor they all agree it was not installed properly and is a very poor quality jobThis is our reason for wanting a different contractor that knows how to pour a flat slab with saw joints properly As it stands right now we are not able to finish the floor because it is to uneven to have any flooring installedWe do not believe BRK is capable of fixing this issue correctly and restore our yard back to it's original stateHe has had to come and repair the bathroom several times after it was painted and completedWhen instructed to paint of the bathroom walls to it's original state he was unable to do that without drips, runs, paint on door and molding and painting the ceiling when not asked to but also with the wrong colorThese are just a few of the reasons we do not trust them to fix the basement properly and the damage to our yard from the cement truck This is why we feel we need an outside contractor to correct the basement issue and restore our landscaping to our satisfaction and that way he can move on to other jobs and not continue to repair this jobWe have lost trust in BRK to do things properly so that is why we would like a different contractorThere are many more issues that had to be fixed after completion but we do not wish to discuss all of themThe main concern now is the basement getting fixed properly [To assist us in bringing this matter to a close, we would like to know your view on the matter.] Regards, [redacted]

based on the fact that we have had this discussion five times already and our responds has not changed towards the issue, I would hope that we can stop looking at the issue and focus our efforts on the solutionwe have already committed to correct any issueswe have had two of the members of
the manufacture for the ICF product on sight and they have committed to helping us to correct any of the issuesthe customer has been assured that all of the issues can be correctedhowever, we are still in the same situation, which is that the customer has not made any payment to us for the materials or labor already put into the jobwe are a small contracting company and our resources are limited, which we have explained to the customerthe resources are all to the limit and need to be paid down in order to proceedwe have not asked for anything beyond that pointdo the fact that the customer continues to focus on the issue and not on the solution, we are wasting time and causing other problemsplease understand that we would like to proceed as soon as possible

to date I have not had any emails, calls, voice mails or text messages indicating that the customer has tried to contact meI have not contacted them because I was waiting for the sump pump to be installedWith holidays upon us I thought that they would not want to have additional mess in their homeDo to the fact that Mr*** continues to think that he has tried to contact me without response and that somehow we cannot do the job that we have done in other projects without the issue in his I believe that we need to meet and resolve this matter

To date I have nothing that I can take back to my architect so he can advise me. I have prepared a agreement that is reasonable based on the fact you have not performed to any standard of concrete construction, and T F Systems best practices.   If you can correct any issue you would not hesitate to sign the agreement.    I have paid you 5000.00 and I also paid for the first amount of  concrete . I will gladly like to know what other problems I am causing from the delay due to your  poor workmanship ? I would like to proceed as well but I can not proceed based solely on your word without a written contract.

Review: BRK Enterprise built a master suite and laundry room addition onto our existing house. We paid BRK in full several months ago. Recently we received notice by certified mail that the heating contractor has not been paid and is threatening to put a lien on our house if he is not paid soon. We contacted BRK a month ago to let him know and he said he would take care of it right away. As of today 12-14-15 it has not been paid.

The basement floor that was poured for this addition is not acceptable. It's severely cracked down the middle with two cracks forming on each side. It is also heaving up where the crack is down the middle. The floor is extremely uneven in many parts and can not be corrected with a leveling agent because it is too uneven. We have had 2 contractors come in to look at it and they both said it was not framed or poured properly and the quality is really bad. We had BRK come to look at it and discuss what should be done. [redacted] agreed verbally that if it needed to be replaced he had insurance to cover the cost and he would be in touch. I tried calling him but he has yet to return my phone calls. Our signed contract says that everything is guaranteed for a year which it has not been a year. We have had nothing but problems in regards to this whole project. He has fixed some of them but is choosing to ignore the basement issue. We feel we have no where else to turn but to the Revdex.com for help resolving this huge issue.Desired Settlement: We would like the heating contractor to be paid in full immediately, as we have paid BRK in full months ago, so a lien is not put on our house.

We would also like the basement floor to be removed and replaced by a professional cement contractor other then BRK. All costs involved in the removal and,replacement of the basement floor will be paid for by BRK. Also, any damage to the newly excavated landscape that occurs during this process to be restored to it's original condition and paid for by BRK.
