We have received your letter dated December 5th, regarding Live Impact, LLC's complaintBelow is our understanding of the situation** ***, principal of Live Impact, first notified us on Oct 2nd, via our customer online
ticketing system that on three different occasions he claims our company plugged BroadAspect routers (Broad.Aspect equipment) into his APC UPS via an extension cord which caused his equipment to failIn this ticket he provided no specific dates for when these events occurred.We replied to ** *** via our ticketing portal on October 9th “indicating that the Broad.Aspect routers (equipment) are located on the other side of the *** network room and that the Broad.Aspect equipment uses a power outlet that is located directly next to the Broad.Aspect equipment and that at no time did BroadAspect run an extension cord to the *** equipment rack and connect the Broad.Aspect equipment to the Live Impact UPSIn the "Customer Statement of the Problem" that you have provided to us in your letter of 12/5/14, ** *** has significantly changed the specifics of his complaint now indicating that we plugged "additional equipment" (not BroadAspect equipment) into his UPS causing an overload and failure of the UPSHe also states that this event took place on 5/1/The facts are that ** ***'s first notification to Broad.Aspect on this matter occurred on 10/2/which is more two years later than the date that he has provided to Revdex.comWe responded to ** ***'s ticket on 10/9/that we did not connect any Broad.Aspect equipment to his UPSWe find it odd that given the negative impact that ** *** attributes to these "events" that he waited so long to notify us and only after he received the Suspension Notice due to non-payment of past due invoicesLive Impact had several past due invoices and received "suspension" notices indicating that the service would be turned off if payment was not receivedThese notices were sent on 9/5, 10/6, 10/7, 10/11, 11/5, 11/6, 11/10, 11/and 11/The invoices that remain outstanding are Aug, Sept and Octplus two $late fee invoices; total due $In order to provide further context to this, it is important to note that based on our limited knowledge, Live Impact had a business arrangement with *** to lease space in the *** network equipment room and specifically to install some of their server and UPS equipment in the *** equipment rackThe *** equipment rack has *** owned network, voice and UPS systemsBroadAspect provides network, voice and IT services to *** and does connect CAT5e cables (not power cables) from the Broad.Aspect equipment rack to the *** equipment in the *** equipment rack.It is also important to note that Live Impact equipment was not labeled or segregated from *** equipment in any material mannerWith regard to *** ***'s new claim that “unauthorized electrical connections were established to my equipment”, we are only aware of one situation where confusion over which equipment was ***'s or Live Impact's may have resulted in *** equipment being connected to Live Impact's UPSOn July 2014, ***'s UPS systems failed and *** contacted Broad.Aspect to have a technician come onsite to review the situation with *** personnelWe met MrJJS*** our technical contact at ***'s office and reviewed the failed *** UPS systemsUnder Mr JJ S***'s request and supervision, our technician worked together with MrJJ S*** to disconnect power cables from ***'s failed UPS and connect this to a power strip that connected to the power outlet on the wall to the left of the *** equipment rackWhile we have yet to fully review the new complaint specified in your letter dated 12/5/15, it seems possible that during the 7/28/event, that some of ***'s power cables from their equipment may be have been connected to a power strip that connected to Live Impact's UPSIt should be noted that in the minutes and hours after this work was performed no new trouble tickets reporting outages or interruptions were communicated by either *** or Live Impactin summary, given the significant outage impact that ** *** has stated in his complaint, it seems very odd and disingenuous that he would have waited over two months to report this to BroadAspect and was only concerned enough to communicate this upon receiving a Suspension Notice for past due invoicesIf ** *** has any issues with the work performed by Broad.Aspect for ***, then ** *** should address this with ***.We hope this provides insight and clarity on this matter and look forward to Live Impact's full and final paymentSincerely
