Dear [redacted],
This is in response to id# [redacted].
Our company holds an auction called Pallet Wars. It is posted in our Ads that the merchandise being sold is returns, shelf pulls and box damaged goods. It is also stated in the Ad, on the receipt, posted...

at the cashier's station and stated several times by the auctioneer at the opening “terms and conditions” and during the auction “All Items Are Sold As Is Where is with no warranties expressed or implied. “We model this auction after [redacted] the TV show, whereby, the auction crew opens the garage door and buyers can look in and then bid. Sometimes they buy a deal and sometimes they pay too much, but as stated in that auction as with ours “all items sold as is where is".
We have pallet auctions where you can look in the pallet but you are not allowed to touch or dig through and we have security people to prevent this from happening. It is widely known by the hundreds of buyers that have participated and that have purchased thousands of pallets, that they are blind bidding, and that all items are sold 'as is where is” no returns allowed.
We have been auctioneers since 1992 and have run hundreds of auctions with absolutely no issues. [redacted] purchased 2 pallets on March 25th and wants to return one, she failed to reveal to the Revdex.com, the whole truth, about the “terms and conditions" of which she was well aware. I believe it would be best for all if [redacted] does not attend any of our future auctions. With this said We will not allow the return of the merchandise.
NOTE: The majority of auctioneers sales terms are (as is where is). *Please see accompanied documentation backing up our claim.”Sincerely,Howard H

 Complaint: [redacted]
I am rejecting this response because: I don't deny that the terms were "as is where is", however, Broco advertised that the items were returns and overstocks, not items that DIDN'T WORK AND COULDN'T BE resold.  I sold one of the items on [redacted] and the buyer said "I ripped him off".  How can I resell crap that doesn't work and falsely advertise that it does work?  That would make me as bad as Broco.  I still want to return the full skid and want my full refund for the second skid of $325.  I'll agree to take a loss on the buyers fee and tax, but not the $325.  [redacted] is not like this auction.  A person can see a little more into the storage unit.  And, as for the security?  NO ONE was watching that because there were quite a few people digging in the pallets.
Regards,
[redacted]
