November 10, 2017Response to complaint # [redacted] ( [redacted] )The lady came in wanting a two-bedroom apartmentt told her I had one upstairs that would be ready in a week and a downstairs unit that would be ready towards the end of the monthShe decided she would like to wait for the downstairs apartmentI informed her that after approval, if she decided she didn't want the apartment, she would forfeit her depositWhen the apartment was empty, I called her to let her look at it mainly for size as we would be doing upgradesShe did point out a few things that worried her but I told her those things would be taken care of during the make-ready.She came in a few days after she was approved and said her attorney told her she should not rent an apartment at this time if she wanted to collect spousal support so she decided not the take the apartmenti again told her the deposit was forfeit but I would be happy to hold it in abeyance until January She said that would be great and leftThe next day, she came in demanding a copy of her application and the name and telephone number of the ownerI informed her again that the deposit was forfeit and the application becomes the property of the BromleyI do not disclose any information regarding the owner(s) of the property to anyoneI informed her the only way she would obtain that information is with a subpoena.When an applicant is approved, I put their name on the apartment and it is taken off the marketI had numerous calls regarding a downstairs unit after she applied for it.I don't have waiting fistsI rent on a first come, first serve basis.Thank you [redacted] ***Property ManagerBromley Apartments

Complaint: [redacted] I am rejecting this response because: This is absolutely falseShe never once told me my deposit was non refundableNot one single timeI know the application fee was non refundable but not the depositThe lessee was still in the apartment on 10/at the time of applicationThe apartment would not be ready for occupancy until ThanksgivingI told her Tuesday the 24th I could not move in there due to my attorney's adviseI did not mention I also would not be able to live in such conditions eithershe said the reason I could not have a refund was because she was holding the apartment just for mewhen I questioned this response of how in the world could she be holding an apartment for me that was occupied and would be ready for at least one month this is when she became irate and she said I would have to have a subpoena for a copy of my application and the Apartment owner's contact information.Her response is a complete and absolute lie regarding my depositNever one single time did she say it was non refundableNot one single timeThis is the poorest business practice I have ever seen Regards, [redacted]

I am rejecting this response because: This is absolutely false. She never once told me my deposit was non refundable. Not one single time. I know the application fee was non refundable but not the deposit. The lessee was still in the apartment on 10/18 at the time of application. The apartment would not be ready for occupancy until Thanksgiving. I told her Tuesday the 24th I could not move in there due to my attorney's advise.
