Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.***,Thank you for forwarding me Bromwell's response to my complaintI'm happy to hear that the company is now aware of it! Obviously, Bromwell's has not addressed the issue of the dispute that I initially brought up, as they still have not provided the services and goods, or a refund of the money that I paid them for said services and goods. While much of the ***ground MrM*** has written in his response is untrue, his premise is irrelevantMy company (*** ***) and he did attempt to enter into a partnershipThis partnership never came to fruition, and there was a lawsuit that resulted from MrM***'s unauthorized use of a name *** came up with, registered, and promotedAll of this unfortunate business was between my company and MrM***I personally purchased two fireplaces from Bromwell's Inc., a retail establishment that had nothing to do with the lawsuit, or with the proposed partnership with *** ***It is unfortunate that MrM*** is choosing to punish me personally through his company for his personal involvement in an unrelated lawsuitThe fact remains however, that Bromwell's is obligated to honor the agreement it made with me, for which I tendered full payment. Thank you for your help in this matter, and if you have any questions--general or specific--regarding this sale please let me know. Best regards,***

Despite my efforts and my attorney's efforts to point out that the lawsuit he continues to reference does not involve me or Bromwell's, Mr*** still refuses to give me a refund, or provide the goods and services Bromwell's promised to provide in exchange for thousands of dollarsI hope this will prove to be the end of this prolonged complaint process, and that the Revdex.com has what it needs to rule in my favor.

I already sent you the opinion letter of the attorney for Mr***, regarding this issueThat seems to me to speak volumes.I'll look for the settlement doc and forward under separate cover.Jeffrey M***

Dear Revdex.com:I am the owner of The Bromwell Company dba: Bromwell's Hearth and Home GoodsI received an email from you regarding a complaint from a Mr*** ***, dated 6/8/and assigned the ID #***My attempt to respond via the link below resulted in an error message stating the link had
expired despite the fact I am responding within the timeframe requestedPerhaps the complaint was withdrawn? Regardless, the following is my formal response to Mr***'s complaint.First some ***ground information about my relationship with Mr***. Mr*** and I attempted a business partnership in in which he and three other of his existing partners were to open and operate an event venue / bar called "The *** ***", as 50/partners, in my building at *** *** *** Street, Cincinnati, Ohio This nascent partnership failed as a result of our inability to agree on a mutually acceptable partnership agreementFollowing our final event as "partners", Mr*** and HIS existing partners sued me over my use of the name I had developed with my long time branding agent, *** ***During our partnership I paid for 95% of the furnishings, provided all of the bar equipment, developed the branding and logo, paid for the logo design and actual vinyl signage on the windows, developed the facebook page, purchased the website domain name(s) and paid for all of the utility expenses, trash removal, real estate taxes, insurance, and window washing in addition to doing all of the build-out and decorating of the subject spaceThe lawsuit was subsequently settled in Judge ***'s court and it was agreed I could use the new operating name of "Bromwell's Harth Lounge and Event Center" and all other claims would be droppedIt should be noted that I received no share of the operating proceeds and the total expenses I incurred on the behalf of those operations, excluding capital expenditures, was in excess of $20,000, in addition to legal fees, opportunity loss and the cost to re-develop the logo and branding materialsMy total loss in this venture was a year and a half of my life and over $40,000, as Mr*** and his partners subsequently refused to reimburse me for the documented and legitimate expenses mentioned above.Written articles about this episode may be reviewed by clicking on the following links:http://www.***http://www***/***http://www.***http://www.***The next bit of relevant ***ground concerns my repeated, yet thwarted attempts, to regain possession of an antique hairbrush store display that I lent to Mr*** and his other partners (*** ***, *** *** and *** ***) in as a prop for their front window display in their new venture, ***'S on *** StreetYou can learn more about this by visiting my facebook page, "Free the Bromwell Brush" : https://***.*** After months of requests for the return of my property ( I am 100% owner of Bromwell's ), Mr***'s very own attorney wrote the following letter to me that I have cut and pasted below:***Date: May 13, at 1:51:PM EDTOur office received the attached, unsolicited email from your client, Jeff M***. It does not appear that MrM*** copied you on this correspondence, so I wanted to call this to your attention. Our response to MrM***’s correspondence is as follows.First, please let your client know that we will not and, indeed, cannot correspond directly to him while you represent him. Rather, he should lodge any concerns to us through you.Secondly, regarding MrM***’s demand for the “return” of the subject “antique hair brush,” this matter has already been decided by the parties’ Settlement Agreement whereby each side agreed to release their respective claims against each other, including claims on personal property in the possession of the other party. For example, as you will recall, while the Settlement Agreement required MrM*** to allow our client ***’s *** to retrieve its forty-eight barstools, your client maintained the possession of ***’s ***’ other property, including pairs of mounted Austrian antlers, brass wall sconces, cast iron table bases, and thirty inch walnut table tops. Similarly, ***’s *** retained possession of any of your client’s property, including the subject hair brush.Third, ***’s *** is willing to trade the subject hair brush to MrM*** for the antlers, sconces, table bases, and table tops mentioned above. If this is acceptable to him, please let us know.As always, I look forward to hearing from you. Thanks

Again, I defer to the opinion letter of Mr***'s own council regarding any past or future obligations to one another. Ironically, Mr*** has also filed a legal action against me regarding this very case but chose to file in ***, seemingly to avoid having Judge *** re-consider the settlement of our global disputesIt should be noted that my business and Mr***'s residence are located in Ohio and ***ucky has nothing to do with this situation. If MrBeck wishes to reconsider our settlement, I'd gladly meet with him to discuss as he and his partners were able to avoid paying me over $20,of operating expenses, as a result of our global settlementObviously, he got the best of me in that settlement, as I also incurred approximately $12,in legal fees, defending my good name and position.Perhaps you should solicit the opinion of Mr***'s attorney, *** *** (letter previously submitted), regarding our obligations to one anotherI have cut and pasted the email from his attorney below, for your convenience. Furthermore, I take exception to Mr***'s contention that my position is due to a "capital crisis" at my business, and if this slanderous statement is published, I shall take legal action against any party involved in the broadcast of such a reckless, untrue and harmful statement.JM***C: *** ***, ***.Letter from Mr***'s attorney, regarding past and future obligations to one another......From: *** *** Subject: Jeff M***Our office received the attached, unsolicited email from your client, Jeff M***. As previously stated, this matter has already been settled in a court of lawI have submitted, under separate cover, the subject settlement agreement that both parties have signed and an opinion letter, from Mr, ***'s very own attorney, in which he very clearly states that all previous disputes have been settledIf Mr*** wishes, I am sure that Judge *** will gladly review his claim as it relates to our obligations to each other Mr*** is clearly attempting to further disparage my reputation, as his only viable recourse, since the court has already accepted our settlementI have nothing further to add and suggest Mr*** and his legal team revisit this claim with the appropriate court in Hamilton County Ohio.....j***

Again, MrM*** sites an unrelated lawsuit that did not involve Bromwell's as justification for that company's failure to fulfill its obligations to me as a customerWhether out of personal spite, or because of some capital crisis in Bromwell's, it is unacceptable for a company to make an agreement, receive payment and then decide not to perform its obligations and keep said payment.
