Bromwell's Inc. Reviews (3)

Dear Revdex.com:I am the owner of The Bromwell Company dba: Bromwell's Hearth and Home Goods. I received an email from you regarding a complaint from a Mr. [redacted]. [redacted], dated 6/8/2015 and assigned the ID #[redacted]. My attempt to respond via the link below resulted in an error message stating the link had...

expired despite the fact I am responding within the timeframe requested. Perhaps the complaint was withdrawn? Regardless, the following is my formal response to Mr. [redacted]'s complaint.First some [redacted]ground information about my relationship with Mr. [redacted]. Mr. [redacted] and I attempted a business partnership in 2014 in which he and three other of his existing partners were to open and operate an event venue / bar called "The [redacted]", as 50/50 partners, in my building at [redacted] Street, Cincinnati, Ohio 45202. This nascent partnership failed as a result of our inability to agree on a mutually acceptable partnership agreement. Following our final event as "partners", Mr. [redacted] and HIS existing partners sued me over my use of the name I had developed with my long time branding agent, [redacted]. During our partnership I paid for 95% of the furnishings, provided all of the bar equipment, developed the branding and logo, paid for the logo design and actual vinyl signage on the windows, developed the facebook page, purchased the website domain name(s) and paid for all of the utility expenses, trash removal, real estate taxes, insurance, and window washing in addition to doing all of the build-out and decorating of the subject space. The lawsuit was subsequently settled in Judge [redacted]'s court and it was agreed I could use the new operating name of "Bromwell's Harth Lounge and Event Center" and all other claims would be dropped. It should be noted that I received no share of the operating proceeds and the total expenses I incurred on the behalf of those operations, excluding capital expenditures, was in excess of $20,000, in addition to legal fees, opportunity loss and the cost to re-develop the logo and branding materials. My total loss in this venture was a year and a half of my life and over $40,000, as Mr. [redacted] and his partners subsequently refused to reimburse me for the documented and legitimate expenses mentioned above.Written articles about this episode may be reviewed by clicking on the following links:http://www.[redacted]http://www[redacted]http://www.[redacted]http://www.[... next bit of relevant [redacted]ground concerns my repeated, yet thwarted attempts, to regain possession of an antique hairbrush store display that I lent to Mr. [redacted] and his other partners ([redacted], [redacted] and [redacted]) in 2011 as a prop for their front window display in their new venture, [redacted]'S on [redacted] Street. You can learn more about this by visiting my facebook page, "Free the Bromwell Brush" : https://[redacted].[redacted] After months of requests for the return of my property ( I am 100% owner of Bromwell's ), Mr. [redacted]'s very own attorney wrote the following letter to me that I have cut and pasted below:[redacted]Date: May 13, 2015 at 1:51:58 PM EDTOur office received the attached, unsolicited email from your client, Jeff M[redacted].  It does not appear that Mr. M[redacted] copied you on this correspondence, so I wanted to call this to your attention. Our response to Mr. M[redacted]’s correspondence is as follows.First, please let your client know that we will not and, indeed, cannot correspond directly to him while you represent him.  Rather, he should lodge any concerns to us through you.Secondly, regarding Mr. M[redacted]’s demand for the “return” of the subject “antique hair brush,” this matter has already been decided by the parties’ Settlement Agreement whereby each side agreed to release their respective claims against each other, including claims on personal property in the possession of the other party.  For example, as you will recall, while the Settlement Agreement required Mr. M[redacted] to allow our client [redacted]’s [redacted] to retrieve its forty-eight barstools, your client maintained the possession of [redacted]’s [redacted]’ other property, including 8 pairs of mounted Austrian antlers, 2 brass wall sconces, 4 cast iron table bases, and 4 thirty inch walnut table tops.  Similarly, [redacted]’s [redacted] retained possession of any of your client’s property, including the subject hair brush.Third, [redacted]’s [redacted] is willing to trade the subject hair brush to Mr. M[redacted] for the antlers, sconces, table bases, and table tops mentioned above.  If this is acceptable to him, please let us know.As always, I look forward to hearing from you.  Thanks.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Again, Mr. M[redacted] sites an unrelated lawsuit that did not involve Bromwell's as justification for that company's failure to fulfill its obligations to me as a customer. Whether out of personal spite, or because of some capital crisis in Bromwell's, it is unacceptable for a company to make an agreement, receive payment and then decide not to perform its obligations and keep said payment.
Regards,
[redacted]

As previously stated, this matter has already been settled in a court of law. I have submitted, under separate cover, the subject settlement agreement that both parties have signed and an opinion letter, from Mr, [redacted]'s very own attorney, in which he very clearly states that all previous disputes have been settled. If Mr. [redacted] wishes, I am sure that Judge [redacted] will gladly review his claim as it relates to our obligations to each other.  Mr. [redacted] is clearly attempting to further disparage my reputation, as his only viable recourse, since the court has already accepted our settlement. I have nothing further to add and suggest Mr. [redacted] and his legal team revisit this claim with the appropriate court in Hamilton County Ohio.....j. [redacted]
