Review: On July **, 2013 I have ordered the granite counter top from the shop “Bronxdale Tiles and Marble” located at [redacted]. I have ordered the whole piece of granite with cutout for the sink and paid $180 as a deposit.

Technician came to my apartment on the same afternoon, and requested $250, as a deposit for installation. He took measurements, checked my sink size and approved. Then, he asked me to bring all accessories (facets, soap dispenser, water filter) to the granite shop next day to assure that the holes for them would be cut properly.

Next morning, in the shop I met the technician again. The shop owner told me that my sink is of low quality and they will not going to install the counter top until I buy the proper sink from their shop. Technician supported his statement. They choose the sink for me and assured me of its good quality.

I agreed to buy the new sink and asked for an “Installation Contract” since the technician did not give me any, after I paid him a deposit for installation. The shop owner assured me that the shop is responsible for both cutting and installation and there is no need for another contract. I told him that I will pay only after the installation is completed, but the owner wanted full payment before the delivery of the counter top.

I showed all the accessories to the shop worker who was cutting the piece of granite. He did not even look at them and said that the holes will be “standard”, so I just pointed where I want each of them around the sink and he put marks on the paper sketch.

The order was completed in 4 days and I saw the whole piece with sink cutout in the shop, but when it was delivered the piece was cut in 2 . Before installation I was asked to pay in full. I gave the technician two checks for $1,720.03 (balance for counter top and sink) and $300 (balance for installation).

Next, I realized that the holes placement was wrong, with one of them blocked by cabinet wall and could not be used to install the accessory piece properly. I have pointed it to the technician but he said he will have to “improvise”. After several attempts he, finally, installed the Water filter facet instead of the soap dispenser, which was still wobbly, because it was not sitting properly.

When it was time to install the sink, technician told me that it was "oversize and too big for my cabinets". He asked me to remove all the under sink pipes in order to fit the sink. However, he still could not install it properly and had to “improvise” again. Instead of using metal anchors (normal installation) he put 2”x 4” wooden blocks on the cabinet walls from the inside to support the sink. Since the facets had to be installed before the sink, when he finally mounted the sink, all facets hardware was jammed between the sink lip and the counter top. That made impossible to make any future adjustment or replacement of the facets without removal of the sink and plumbing.

There were no holes for the anchors (for sink mounting) that should be drilled in the granite. Therefore, the counter top was not done properly from the beginning.

All this was explained to me by another contractor who came later that day and tried and failed not reassemble the plumbing.

Next day I came to the shop to complain about all these problems. I told them that I believe the measurements were wrong. The owner told me that my cabinet is “too small” and my plumber is “no good”. I was advised “do not bring your problems here”, “be more creative and improvise” and “learn how to solve your own problems”. He refused to consider any corrections and did not admit that the sink and holes measurements were wrong.

I have asked another granite shop technician for the second opinion and was told that “sink is of a very poor quality, over-sized and was installed incorrectly", that "the sink would get rusty very fast", and because of poor installation, I would "soon have water and mold damage" to the cabinet. He confirmed that the holes were "drilled too close to the cabinet wall or blocked" by cabinet wall. Overall, I need to replace the counter top!

I have paid my money and trusted to get the professional service but now need to do it all over.

I paid: $180 (deposit)

$ 1,720.03 (counter top + sink)

$ 550 (250 + 300 installation job)

Total: $2,450.03Desired Settlement: Refund $2,450.03

We only cut the stone to specifications provided to us by the customer. We were never at the customer’s home.

The “Technician” the customer refers to is the independent Contractor hired by the customer. He is not our employee, as the customer makes it appear in his statement. The counter top was cut accurately per the customer’s measurements provided to us. The invoice clearly states that measurements are the responsibility of the customer. Our store policy is full payment of counter tops before delivery because we are not responsible for measurements.

The customer’s Contractor (“Technician”) requested the $250 installation deposit as part of his service. He installed the counter top—not us.

We pointed out to the customer that the sink he brought to the shop was “defective” as the sink’s hole was off center. He agreed that his sink was defective. He had the option to bring us a new one or purchase one from our shop. He chose to purchase one from us. We did not indicate that he had to purchase a sink from our shop. He chose a sink of the same dimension as the original sink provided. The sink is premium grade and spec sheets can be provided to prove it’s quality, rather than relying on the competitor’ s opinion.

We did not install the countertop. There was no need for an installation contract. We did not indicate to the customer that we are responsible for installation.

The fixture holes were placed where the customer wanted as he indicated to the fabricator. Fixture holes are standard – that would not affect placement of the fixtures—inaccurate measurements provided would affect placement. The plumber has to tighten the nut on the fixture to prevent wobbling. It has nothing to do with the hole size. There are holes for anchoring the sink.

Dear Sirs/Madams;

This office is counsel to Bronxdale Tile & Marble and I write with reference to the about case number, and I write in furtherance to my telephone conversation with "[redacted]" taking place this afternoon. Bronxdale Tile & Marble is a retail distributor of tile and marble with offices located at [redacted]. Bronxdale Tile & Marble is not an installation contractor nor do they perform any installation services.

Your complainant, [redacted], was a customer of Bronxdale Tile & Marble. Notwithstanding his complaint to Revdex.com to the contrary [redacted] was informed that Bronxd Tile & Marble would not be performing the installation of his granite countertop and sink but specifically advised that an installation contractor and Plumber would need to be independent and separately retained for that purpose. [redacted] was further advised that his retained installation contractor would need to perform all the necessary measurements for this installati and prnvide them to Bronxdale Tile & Marble so that his granite countertops could be cut to th specifications provided. At no point was the complainant informed that a specific installation contractor was required to be used and, at his request, he was provided with a list of installatio contractors who could perform these activities. The communication with, and ultimate selectio and retention of, the installation contractor was exclusively within the control of the complainant.

Further, after the measurements were performed by the installation contractor and provid to Bronxdale Tile & Marble, the complainant came to my client's business location to show the sink which he had independently purchased for his home renovation. He was shown, and there agreed, that the sink he purchased was ''defective";since the sink's drainage whole was off-cen The complainant was also advised that he could return his "defective" sink for a refund and, at option, could either purchase a sink directly from my client or obtain one from an independent retail distributor. The complainant voluntarily elected to purchase his sink from Bronxdale Tile Marble.

The granite countertop as purchased was provided to the complainant based upon the specifications given to Bronxdale Tile & Marble by the installation contractor, and this installation contractor along with the complainant's retained plumber performed all the necess activities to complete the job to which they were each individually retained.

If any inaccurate counter-top measurements were provided to Bronxdale Tile & Marble fault rested with the installation contractor (as my client was not involved in the measurement process).

Similarly, if the complainant's sink was incorrectly or improperly installed by the complainant's' plumber, this would have been outside of the involvement of Bronxdale Tile & Marble since they were not involved in the installation process.

The complainant has been repeatedly told this information yet continues to pursue his frivolous complaints and accusations against Bronxdale Tile & Marble; now having filed the instant complaint, a complaint with the Department of Consumer Affairs and a civil Small Claims complaint in the Bronx County Small Claims Court. Unfortunately what [redacted] appears to understand is that his proper recourse is to pursue his privately retained contractors for their negligence as opposed to pursuing these complaints against my client.

I trust with this information you will be able to bring this matter to a swift conclusions that my client is not forced to incur any additional legal expense. However should you require further information please feel free to contact this office directly.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

The installer business card was given to me at the shop. It was the only one, without alternatives. I believed he is the usual installer who is working for this shop. He measured my cabinets only. According to his measurements, the sink was too big, but the shop owner did not pay attention to the measurements, since the sink would fit, though not with proper anchors.

The shop owner realized that the sink will not fit properly, so when the granite was being cut there were no holes drilled for these anchors. He knew that the sink was too big and did not inform me. I could choose a smaller size sink at any time. I was in the shop on the morning of the cutting.
