Review: I have requested to end my contract with this fitness organization because of a change in my work hours that make me no longer able to attend their classes. They have rejected my request to end the contract on the grounds that only a medical disability or relocation of 25 miles or more give me grounds to end our service agreement regarding classes at their school.To date, they have charged me for 3 months of classes, at $220 a month, for a total of $660, while I have been unable to attend. I told them if I found myself charged for a third month, I would be lodging a complaint. I was under the impression that the contract and my payment relationship with the school was 'at will' for as long as I trained with the organization. Now that I am not training with their school, they are charging me for services that I am not receiving, even after I have requested in writing to end payments and severe my tuition contract. I originally signed up for the program in May 2012, and due to misleading language and sales practices on the part of BBJJ III, was unaware of any stipulations that required me to pay for a full 2 year's worth of classes whether or not I was able to take them.I have our correspondence available if you should need it.Desired Settlement: I would like them to end my payment contract immediately and discontinue all future charges for classes at their school.

I am writing in response to your inquiry dated November **, 2013. As detailed further below, [redacted]’s allegations are without merit, as he has a contractual obligation with our organization to make payment. Accordingly, I am requesting that his complaint be summarily dismissed and that any negative allegations regarding my business be removed from the Revdex.com’s (Revdex.com) database immediately.

In 1994, I opened my first martial arts school, [redacted]. In the past 19 years, I have expanded my business to six schools which currently employee approximately 35 people in Brooklyn and serve more than 1,500 students. Our schools serve as models for leadership and fitness training in the communities in which they are located. The feedback from the students and their families is overwhelmingly positive.

On May **, 2012, [redacted] signed a 2-year contract for martial arts training at the Brooklyn Brazilian Jiu-Jitsu III School located at [redacted]. As clearly stated within the contract, within 3 days from the date of receipt of the signed agreement, [redacted] had the right to cancel without penalty or further obligation. After the 3 day period’s expiration, the contract clearly states that cancellations are only available in limited circumstances---if a family relocates or has medical issues that make continued participation untenable. In both circumstances, independent verification (i.e., proof of relocation or a doctor’s note) is necessary.

Despite the clear terms of the contract, [redacted] gave notice that he would not be able to make further classes based on his new work schedule. [redacted] refused to provide any further independent corroboration as stipulated by the agreement. Further, staff made several attempts to reach out to [redacted] in an effort to accommodate him, given his stated enthusiasm for our services. We even offered to store his class uniform at one of our schools and wash it for him free of charge- an offered never extended to any student before or since. Also, we offered to credit any time that he misses- and pays for- to him at a later date when his schedule more easily permits. [redacted] refused these repeated requests. Instead, [redacted] acted in breach of the contract by his refusal to make payments to which he agreed.

I request that his complaint be dismissed based upon the foregoing facts. Please feel free to contact me should you have any other questions and/or concerns.

At this time, I have not been contacted by BBJJ III regarding complaint ID [redacted]. While no one has been in touch with me regarding my complaint, I have received an single email from their billing agency ([redacted]) claiming out now owe $717 dollars. I forward the aforementioned email to my attorney without responding.
