I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[Your Answer Here - The definition of "juried" provided is [redacted]. The gallery said that the show is juried, AND THAT THE JURY WOULD BE SELECTING WINNERS. Emphasis on the word "winners". They never said that the jury would be selecting who could even display their work. They said that the jury would pick winners. I didn't pay $65 expecting to win a prize. I paid $65 to have my work displayed. The [redacted] recently had a "juried" show. They even called it a "juried" show & had a juror. Anyone could display artwork. The juror picked the winner. They deliberately misled many artists into paying an exceptionally high fee for absolutely nothing. It's a disgusting scam. They never clarified this. Why did their website say "The juror will pick the winners" and neglect to say anything about the juror picking work in general.
Also, who in their right mind would pay $60 for nothing? What a [redacted] scam. Artists do not have a lot of money, and this makes me sick!!!

Review: I submitted artwork to [redacted]) and paid a $65 fee. My artwork was not accepted - fine, but on their website, they never wrote that this was a possibility. Their rules stated that artwork would not be accepted if it was film, if it did not match the photographs, or if it was over the size limit. My artwork fit all of the requirements, so I paid $65 with the impression that I was paying for my artwork to be part of the show. Instead, they rejected my artwork and pointed to "nonrefundable" to deny me a refund. I feel completely deceived, and I absolutely sent them this money under false pretenses. They acknowledged that they never explicitly stated that artwork would be denied, but then they said that I should have realized this possibility because of the use of the word "juror"... Their website clearly says that the juror will choose WINNERS. Nothing about the juror choosing which artwork actually goes in the show. I would have never paid $65 if they hadn't deceived me.

They scammed over a thousand people with this. "Only 100 pieces were selected out of 1346."Desired Settlement: I simply want a refund of my $65. I paid $65 to have my artwork in the show - not for what they gave me, which was nothing.

Response:

It is unfortunate that [redacted] clearly did not understand the definition of a juried show before she applied to one. [redacted]’s first definition of “juried” is an, “adjective 1. having the contents selected for exhibition by a jury : a juried art show.” For six years, we have been holding juried competitions – hiring curators from NYC’s finest museums to select the work to be exhibited. An independent juror, Assistant Curator of Contemporary Art at the [redacted], selected the works to be presented in [redacted]. The Brooklyn Waterfront Artists Coalition is a 501.c3 non-profit organization. Organized in 1978, BWAC has grown to become Brooklyn’s largest artist-run organization with about 400 artists exhibiting with us each year. The artists are the management, leadership, board and staff, volunteering their talents and time in a shared effort to support and showcase the work of emerging artists. There has been neither ‘deception’ nor ‘scamming’. These accusations made by [redacted] are not supported by the facts. The prospectus clearly states in bold that, “All entry fees are non-refundable.” [redacted] should have read before she applied. For the 2016 shows, BWAC plans to add some clarification of ‘juried’ for those whose comprehension of English may be weak.
