Answer to Revdex.com Complaint #[redacted].Clarification to the contract: 10 days to furnish Letter of Commitment, took 3 ½ months to get this. Contract states: “If Owner does not provide such confirmation, to Builder's satisfaction, Builder may terminate this Contract,retain the Down...

Payment…”There is no clause stating anything about 6 months.All text messages and calls have been answered. Brookshire Homes, LLC has no intension of retaining all of their down payment, however there has been costs incurred, due to the [redacted]’s not getting the necessary documents in a timely manner. Brookshire Homes, LLC entered into a contract to build a custom home for[redacted] & [redacted] on their land in [redacted], OK on November 16,2015. Contract states that Buyers ([redacted]) had 10 days to furnish a Letter of Commitment for the purchase of the home after construction. We also requested the 10 acre survey of the property for Brookshire Homes, LLC construction loan and appraisal. We never received this letter or the survey from the Buyer.They gave Brookshire Homes, LLC an extensive list of the items they wanted included in the construction of their home. The plans were revised.First Bid: The cost of construction was submitted to the [redacted]’s and they didn’t want to spend that much. They revised their list of the items.I asked for the Letter of Commitment and the survey again. [redacted]told me she would get me both.Second Bid: We agreed on a final price January 17, 2016. I requested aLetter of Commitment and the survey again. I explained that we had to have the survey for the appraisal and the Letter of Commitment for Brookshire Homes to obtain the construction loan. I was told I would have both items ina couple of days. I submitted information to the bank for our construction loan January 19,2016. I was asked for the Letter of Commitment and the Survey. I responded that as soon as I had them I would send them.February 22, 2016 I finally received a Letter of Commitment for the[redacted]’s from Gateway Mortgage. (3½ months later). I sent it to the bank.February 25, 2016 Gateway Mortgage had me raise the price to include theland. We signed this February 29, 2016. I sent it to the bank.March 4, 2016 [redacted] texted me a picture of the survey and asked if this would work. (4 months later A TEXT) I sent it to the bank.March 17, 2016 we received the Letter of Commitment for the full price of$280,000.00. I sent this to the bank for our construction loan.The bank ordered the appraisal March 23, 2016.April 13, 2016 Title Company received the deed from the [redacted]’s deeding the 10 acres to Brookshire Homes, LLC for construction of their home.May 2, 2016 Appraisal came in low due to the house only being on 10 acres on rural property. Appraiser suggested the [redacted]’s use the full 70 acres.[redacted] didn’t want to do that. Brookshire Homes, LLC was unaware that they owed money on the property.May 5, 2016 [redacted] called and said he had been laid off. I called the Title Company and the bank to stop all work.Sincerely,[redacted]
