Complaint: [redacted] I am rejecting this response because:brown used the info about case that was provided to him or he obtain as my lawyer not only he made it public also he is miss represzfacts to make me look like a monster this behavior is not professional & he can not hide his incompetency & fraudulent practice of over charging clients by using information that is falsei guess I'll take him to court for1- incompetent lawyer2- making private info public3- miss representing facts about my case like a child to make me look like a monsterHe loved me when he could charge my card $100/Day for answering single email 4- charging me for a motion that he never filed5- accused me of forgery 6- Sincerely, [redacted] *

I would like to start by saying [redacted] gave me permission to respond to his complaints by saying anything I would like, even providing to the general public what would normally be privileged information.[redacted] is correct in that we terminated representation because he lied (by omission) to us...

about very important material facts about his case. He did not tell us about child abuse investigations and substantiated child abuse cases, domestic violence arrests, protective orders, or his wife's spinal injuries and closed head trauma from his domestic violence. While [redacted] maintains he did not know about any of the things listed above, he was interviewed by the division of child and family services about abusing his infant daughter (the investigation was substantiated for [redacted] assaulting his daughter), so he knew about the investigation. He also said he didn't know anything about criminal domestic violence investigations, but, as it turns out, he was arrested for domestic violence against his wife. When faced with credible medical evidence of spinal injury and closed head trauma he caused his wife (by throwing a lamp at her head), [redacted] said she must have beat herself up. He attempted to explain away the spinal trauma by blaming it on his wife having given birth some time before. Regarding the protective order his wife took out against him, [redacted] said the court never notified him, even though it's standard practice for courts to notify those against whom protective orders are taken out. In fact, I believe [redacted] said he didn't receive notice because he was "out of the country."The evidence received indicates not only that [redacted] knew about these materially relevant facts and withheld them, but that he actually committed crimes against his wife and daughter. We do not represent those who commit domestic violence and lie about it.[redacted] also states an "intern" attorney handled his case. Nothing could be further from the truth. I told him when he hired us that I would not work the case directly and that he would be assigned a primary attorney. McKenzie A[redacted] was his attorney. She has been a divorce attorney with my firm for many years and works on more divorces per year than almost anyone in Utah. I would venture to guess [redacted] thinks McKenzie is an intern because she is female.[redacted] also says we overbilled him for work done. When I spoke with [redacted] today, I ask him to provide me with one example of overbilling. The only example he could provide, after being prompted five times, was that we didn't file a motion for alternate service. I informed [redacted] we filed that motion. He could provide not even one more allegation of overbilling. In fact, when I worked up the hours we spent on [redacted]'s case and compared them to our normal hourly billing, it was around $213 per hour, while our normal hourly rate is $245 for attorneys and $295 for me. (The decreased hourly rate is explained by the fact [redacted] paid flat fees for a portion of his case, and we spent quite a lot of time on that portion (much more than normal), which decreased the overall effective hourly rate.)In the end, we cannot represent people who deceive us and withhold material facts. [redacted]'s case did not turn out as he would have wished because, as the evidence indicates to us (and the court, by the way), he abused his wife and daughter and then lied about it. [redacted] was ordered by the court to undergo domestic violence therapy, and I hope that therapy is successful.Unfortunately, given all this, there is no way we will refund [redacted]'s money or pay for a new attorney. [redacted]'s behavior caused his present situation, and we will not take the blame or pay to fix the problems caused by his violent, criminal behavior.Thank you for your time and consideration.
