Review: My daughter was in an accident on Sunday in my car on 95 north of Richmond. She had never been in an accident before, and was not sure of her rights and responsibilities. The police called a wrecker to tow the car without consulting her. Broyles responded and hooked up the car without asking if that’s what she wanted and without providing any information about costs, and then without asking her where she wanted the car towed, they took the car to their lot. She asked how much it would cost, but he said they would bill her, could scrap the car, that she should take all her stuff and that storage would cost $25 per day. I spoke with the owner on Monday, and she told me that a tow from that location would cost $78.50, but when I told her that the car was already there in the lot, she said the price was $225 plus $40 per day for storage because it was an "accident situation". I asked what the difference was and she said that "normal" towing would be where the person was with the car, had the keys and they could just hookup the car and go, which WAS the case. She then mentioned weekend costs, but that doesn't justify almost triple the cost. She said they could scrap the car, keep the profit, and waive just the storage fee, though I would still have to pay the towing charge. I said she was price gouging and that the scrap value of the car should cover the cost of the tow and storage, especially since there were two brand new tires on the car. I asked if we could come take the two tires off the car to recoup that expense; she said NO, that no one could take them off on her property. She refused to budge, and since she had possession of my vehicle I had no choice but to pay the charge and send the title to avoid additional storage charges, and had to pay $35 more to have them remove the tires. It's my assertion that Broyles is taking advantage of vulnerable people without providing any information about fees, rights or choices about where the car should be towed.Desired Settlement: I would like the $225 towing charges refunded since we did not choose to do business with Broyles, they never asked where we wanted the car towed to, never informed us of the fees ahead of time, and is price gouging accident victims. I had to surrender the title and pay the $225 or they would have continued to charge $40 per day while I tried to dispute this. They have also already gotten the $175 scrap value for my car and $35 for removing the two tires (which I would have done myself if she had not refused while the car was on their property). This should more than cover her towing costs. Had I been told the fees, I would have chosen a different tow company or would have brought a car trailer and moved the car myself. And I would have taken the car directly to a scrap yard or elsewhere than their lot, so extra towing to the scrap yard or storage would not be necessary.

Response:

The Virginia State Police have a rotation list that they use with approved, reputable towing companies that carry the correct limits of insurance and whose operators are background checked and licensed through the Department of Criminal Justice. The main objective is to mitigate any traffic obstructions and to remove incidents from the roadways in a timely and safe manner. Broyles was contracted in the referenced incident by the Virginia State Police and picked up the wrecked vehicle and transported it back to our location. The drivers do not discuss pricing. The price that was charged for the accident was $225.00 which is our standard base accident fee. There is a daily storage fee that is charged of $40.00/day until the vehicle is removed from our premises. We do offer to our customer who do not carry full coverage insurance on their vehicle to waive the $40.00/day storage in return for the title for disposal of the vehicle. There are no additional charges to the customer for disposing of the vehicle. The vehicles that we dispose of do have to be prepped (including but not limited to removing tires, batteries, fuel tanks, etc.) before they can be transported (at our cost) to the scrap yard. The accident fee is always collected. Broyles is not interested in any scrap value of the vehicles that are disposed of but merely use this to offset expenses incurred. We were also not interested in the tires that were on said vehicle because they are of no use to us. Due to insurance regulations with our current policies and liabilities involved we do not sell “used” tires. Customers are also not permitted to do any repairs or modifications to their vehicles while on our premises again due to liability risks for injuries. This is once again not permitted through our insurance carrier. In addition to being a towing facility we are also a repair facility so we offered to remove the tires for the customer at the charge of $17.50 each tire which the customer acknowledged. We regretfully decline the customers’ request to have the $225.00 refunded to her. The customer has merely paid for the services that have been rendered to her. Had said vehicle carried a full coverage insurance policy the insurance company would have stepped in and taken care of accident and storage fees associated with the vehicle. No one forced the customer to sign over her title for disposal of the wrecked vehicle.
