I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
[The time line is off with the responseI did nothing prior to calling Brummett Pools to come out and look at my pump that would not spin upThe pump was turned on for only to minutes before shutting it off and calling Brummett PoolsWhen the tech came out to look at the pump, the pool cover was still on the poolI had not even attempted to clean the pool due to the equipment failing to start upAlso, there has never been a service technician come out to repair any equipment till and then it was to replace the original pump, nothing to do with the filterI replaced the sand in the filter back in and I vacuumed out the sand with a shop vacI was able to see the laterals along with the tube that is attached permanently at the factoryThe pieces weren't glued together at that time and the filter has never been opened since thenBrummett Pools was supposed to clean the pool for *** *** due to the working relationship they haveThe pool still had rocks, screws and concrete mud on the bottom when I pulled the cover offThe filter was broke before I attempted to turn the pump onBrummett Pools did break the filter, along with the pum[p, the auto chlorinator and the completely destroyed the heater unitIf Brummett Pools refuses to pay for their mistake and attempted cover up, then I will be forced to sue for the amount which is legally due me.]

Response:When our technician went to service Mr [redacted]s pump the cover was not on the pool and when the valve on the filter was turned to backwash sand came out at that time. If the cover had been on the pool then the return lines and skimmer would have been plugged therefore no water could get through the line to the pump. Neither Brummett Pools or any of our service techs ever took his filter apart and glued it nor did we vacuum anything through his filtration system. When we closed his pool after [redacted] poured the concrete, we vacuumed the pool through a separate pump that discharged the water & debris into the yard, not through the system. It is possible that from 2012 and 2016 that the lateral simply broke, they are only plastic and don't last forever. By no means is Brummett Pools responsible for Mr [redacted]s pump, filter, chlorinator and heater. As in the first response, it is possible that the company or person that opened and closed the pool or serviced the equipment prior to Brummett Pools doing service could have glued the lateral assembly and damaged the lateral causing the damage to his entire system.

It is apparent Brummett Pools is going to continue to cover their mistakes with lies. I will be talking to a lawyer to further this process.

Response:Mr. [redacted] contacted us about removing and replacing his concrete in 2015, we referred him to [redacted] but Mr. [redacted] does not work for us and cannot say what we will do to a swimming pool after he pours concrete. When we winterized Mr. [redacted]s pool in the fall of 2016 we did not...

take his sand filter apart and glue the manifold inside nor had we ever taken his sand filter apart. I am not sure how long Mr. [redacted] has had his pool but he apparently has had other pool companies service it prior to him calling us, we did not take his filter apart and glue anything. We winterized the lines, the pool equipment and put his cover on just like we do every pool we close. When Mr [redacted] opened his pool in the Spring he vacuumed all the debris through his pump into his filter causing a lateral in the bottom of the filter to break which lead to the sand caked in the heater and piping. When we open a pool we vacuum all the debris to waste so it doesn't go into the customers pump & filter. Mr. [redacted]s issues were either caused by the age of the filter (laterals do break over time) or what he vacuumed up in the Spring, not from our company closing the pool.

Mrs
[redacted] sent us a letter stating that she had an issue with her retaining wall
that we installed in 2007. We had done a repair to that wall without charging
her for it in 2012. The wall was not under warranty at that time but Mr
Brummett performed the repair at no charge to satisfy the customer. The
contract that was signed by Mrs [redacted] clearly states that there is only a one
year warranty on workmanship. After receiving her letter stating that she was
going to hire someone to repair the wall and send us the bill, our attorney
responded with a letter stating again that the wall was not under warranty and
that we would not be paying someone else to do any work on the wall for them.
