I would very much like to respond to this complaintThere are two things that need to be understood about this projectFirst I have received no payments of any kind although the project was completed more than two months agoSecondly, the spouse of the complainant, [redacted] , was present for and observed the execution of this project virtually from beginning to endThe only commentary I received until literally the last few minutes was praise for both the workmanship and the appearance of the projectThen and only then did I hear of any dissatisfactionThis project involved labor and materials to design and build a gas fireplace surround utilizing cultured stone with a natural stone hearthBefore any work began I asked the homeowners to choose a cultured stone for the main body of the work and a natural stone for the hearthI explained at the time that the use of a cultured trim stone as a border was a typical way to provide a finished termination point for stone that had to be cut to fit into the fixed space to be addressedIt was my understanding that this was the agreed upon approach to the project designI explained the thickness and type of hearth stone that could be accommodated by the existing fireplace so that access to the controls could be maintainedI identified several [redacted] yards where products could be viewedThe cultured stone to be used was chosen and specified at the supply yard by the complainantThis was the stone that was usedThe design beyond that was not specifiedThe natural stone to be used for the hearth was not specified by the complainantThe initial phase of this project involved preparation of the surfaces to be addressed and installation of the stone hearthThe complainants spouse observed this entire processThe complainant had the opportunity to see the finished hearth before any additional work began the next dayI received no negative feedbackThe following day involved installation of the cultured stone fitted to cultured trim stones surrounding the fireplace openingThe complainants spouse was there to observe the entire process of the installation of the trim stone and the cultured stoneThe only commentary I received was praise for both the workmanship and the appearanceIt was not until the project was 95% complete that I heard any negative feedback, and then only from the complainantIt is my understanding that the chief complaint is the use of the trim stonesThe design of this fireplace front was not specifiedTrim stones are typically used to provide a decorative border while also providing a termination point for stone that has to be cut to be fitted into spaces not designed to accept the fixed length of the cultured stoneThe original price quoted for labor and materials was $I offered the complainant, in writing, a $courtesy discount upon hearing of her disappointment with the designI offered to remove at no charge and at a discount the part of the project that she did not likeIt is also true that I expected to be paid for the work that I had already done, at the discounted price, as it was done while the complainants spouse was observing the entire process, and was accomplished in a timely and professional manner without negative commentary until after the factThe bill I submitted was for $for labor and materialsI have paid wages to my employee and all materials billsThe complainant has paid nothingMy offer still standsI will remove that portion of the project that the complainant does not like at no chargeI will re-prep the surfaces to be addressed at no chargeI will the hearth and upper stonework at a discount to be mutually agreed uponBut I expect to be paid for the work I have doneI have been doing [redacted] work for yearsThis is the only complaint I have ever received [redacted] Sent on: 8/30/11:54:AM

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]As I stated in my complaint, that is exactly what happened, Mr*** said he remembered it differentlyWhy is it a professional mason is relying soley on his "memory" vs writing down what the customer wantsAs I said, he did suggest the accent stone when he was at our home, I said we did not have enough room for it with the cultured stone & it would look badHe continues to blame my spouse who had a traumatic brain injury which he was informed about. I have the business card that says: $Hearth & cultured stone, that was what we hadHe then verbally told us to go pick out the cultured stone which we did.I dont feel I should have to pay for mistakes made due to poor business habits of not writing things downPlus we got the wrong color hearth stone because the yard he uses ran out by the time he went there to pick it upI don't feel this is my responsibility either. I am willing to pay for some of the stone even though I had to pay to have it removed & redone

The original price quoted for labor and materials was $750.00. I offered the complainant, in writing, a $150.00 courtesy discount upon hearing of her disappointment with the design. I offered to remove at no charge and re-do at a discount the part of the project that she did not like. It is also true that I expected to be paid for the work that I had already done, at the discounted price, as it was done while the complainants spouse was observing the entire process, and was accomplished in a timely and professional manner without negative commentary until after the fact. The bill I submitted was for $600.00 for labor and materials. I have paid wages to my employee and all materials bills. The complainant has paid nothing. My offer still stands. I will remove that portion of the project that the complainant does not like at no charge. I will re-prep the surfaces to be addressed at no charge. I will re-do the hearth and upper stonework at a discount to be mutually agreed upon. But I expect to be paid for the work I have done. I have been doing [redacted] work for 25 years.
