On May 16, an incident involving atrocious customer service occurred at this centerI was banned from this center for being rude to a waitress who was treating me very poorlyI complained to her supervisor with no result, or responseI received a letter on June 6, notifying me that I was banned for life for harassment of this employee after a “thorough investigation”No harassment ever occurred towards any employee by meI have witnesses to the entire eventNone of my witnesses were ever questioned, and the company refuses to respond to my repeated request for their evidence supporting this banI had been a patron, league bowler, and league officerMy family had been customers for well over yearsI feel this ban was excessive and unjustified

response to the above-referenced guest complaint filed by *** ***M r*** is seeking to damage the reputation of the Company based on the fact that the Company banned him in light of events that transpired on May 16, at one of the bowling establishments operated by the Company ??" "Brunswick Moreno Valley Bowl," located at Sunnymead Blvd., Moreno Valley, CA ("Center")On May 16, 2017, one of the Center's lane servers ("Server") approached the lane where M r*** was bowling to take his orderAs the Server approached the lane, M r*** abruptly and without provocation forcefully stuck his hand out in the Server's faceThe Server felt threatened by this hostile actM r*** later said to the General Manager of the Center that he had intended it to be "funny."? That same day, the same Server attempted to take Mr***'s orderA nearby guest "Larry" knocked a credit card out of Mr***' handWhen the card fell to the floor, M r*** shouted obscenities at the Server telling her to "better fking pick that up." Later on, the same guest Larry again knocked the same card out of Mr***'s handM r*** belittled and demeaned the Server in front of the Center's other guests by shouting at her again that "it's your job to pick up the cardYou need to fking pick it up."? Later on that evening, M r*** told another employee at the Center that the Server "better bring her as over to talk to him." When the Server arrived to take Mr***'s order, M r*** told the Server "I want nothing to fking do with you."? From the foregoing facts, Mr***'s assertion that "[n]o harassment ever occurred towards any employee by me" is baselessMr*** purposefully degraded the Server with hostile, offensive, mean and obscene commentsAs part of an investigation of the incident? performed by the Company, Mr*** admitted to the General Manager of the Center that he was "a jerk" to the ServerMoreover, in subsequent written correspondence to the Company, Mr*** admitted that he was "rude."? The Company strives to provide a safe, friendly, and courteous environment for its guests and employeesWhen the Company believes a guest's behavior is inconsistent with this goal, the Company will take the appropriate actions it believes are necessary to prevent such behavior, including a permanent banMr***'s actions towards the Server had no other purpose other than to hurt and injure her emotional stateThe words spoken by Mr*** were hostile, degrading, demeaning and offensiveMr*** had no authority to force the Server to cater to his very whimMr*** clearly confuses servitude for service.? The Company has a legal obligation to maintain a workplace free from hostility and harassmentMr***'s acts and words were hostile and harassingThus, the Company was justified in banning Mr*** from entering any of its properties; if the Company did not act as it did, it would subject itself to untenable liabilityMoreover, as a private enterprise, the Company has lawful rights to restrict the access of any person from entering its establishments under state trespass lawsFor these reasons, Mr*** has no lawful right to force the Company to rescind the ban.? I am rejecting this response because: The centers statements of events is not entirely accurateAs for an incident the week before the main incident, that was a case of mutual joking aroundWhich the employee in question had always participated inAs for the incident in question, my card was taken by another patron (*** ***) upon the employees return of my card and orde, all I said was “thank you”, as witnessed by *** *** and *** ***It was not until later in the evening and our waitress had never returned that the incident happenedWhen she returned, her attitude was very rudeI did not know that the card incident was still upsetting to herRemember, I didn’t take my card from her and throw it on the groundI was actually bowling at the timeWhen she came with an attitude, I responded in kindI was not yelling obscenities, I was detailing the litany of inappropriate incidents that have occurred over time with this employeeMy point was that this employee can joke and play when it suits her, but draws the line when customers joke backI then attempted to complain to the bartender, who did absolutely nothing except walk awayThe next week, the employee and I apologized to one another and made amends with no hard feelings held, with the understanding we would both try to curb our joking around with each other to avoid any further misunderstandingsThis incident was witnessed by no less than other customers that were never questioned at allI apologize now, as I did then, for becoming irate with the employee and the treatment I receivedBut, the fact remains, my actions did not rise to harassment, and witnesses to the event were never questioned about the incidentThe center banned me based on one side of the story, and that is unfairI am not trying to give the business a bad name, only dissatisfied with the handling of this issue.?
