Bryant Fence Company was installing a metal fence post on or about *** for a neighbor and cut our *** fiber optic cable line.
As the owners of ***, we are a proud member of the *** for 12 years with no complaints. We achieved this status because when we made a mistake we compensated our clients appropriately without "pointing fingers" to avoid a settlement.

Bryant Fence Company was installing a metal fence post on or about *** for a neighbor and cut our *** fiber optic cable line.

My wife and I lost our internet and TV service for 4 days in ***. We had to pay *** $*** (plus tax) for a new cable. This is a fair price considering ***'s cost. We have 6 hours of time off work talking with and meeting all the parties mentioned in this complaint. This time off also includes writing this complaint.

Bryant Fence told us they knew they cut it. After we complained to them, they talked to their installation crew. According to Bryant Fence Company, their crew said they thought our cable was an "old line and not active" so they did not report cutting it to their supervisor. This came directly from a lady at Bryant who spoke with *** on the phone several times. This part of the subdivision is two years old!

Additionally, the cable runs parallel with the main underground power line running to three condos. Bryant should have known utilities were there and to be careful. At another fence post, they pulled our cable out of the ground and put it around the post without damaging it. They had to know they could damage the rest of the cable when digging other post holes that were in line with this one.

Bryant Fence company responded to us that it was either ***'s fault for not reporting the line was there or *** fault for not marking the cable. *** did mark the cable, but not all the way across our neighbor's yard. *** came to my house and said they are not responsible for marking "drops" that run through another person's yard and *** is not responsible for reporting where the drop runs to. They said only the main cable, gas, and water lines are required to be marked.

Additionally, *** told us the *** State Regulations state that damage to utility lines are not to be charged to a consumer. The cost of repair is to be negotiated between the utility company (***) and the contractor doing the damage. Bryant Fence Company refuses to negotiate and we can't find anyone at *** who wants to make a decision on the cost.

We have researched the *** Laws ("Codes") and found that Bryant Fence Company has violated several sections of *** Code § *** regarding a contractor's responsibilities when excavating ground near an underground utility. If our *** complaint is settled to our satisfaction, we do not intend to pursue future legal action, which can include penalties up to $***.

As of ***, we had to pay *** $*** plus tax (about $) for a total of $*** for the repair. Otherwise, they would have shut off our service if we refused to pay.

Desired Outcome

five hours of time handling this during work hours is worth $*** per hour (conservatively) for a total of $***. ***'s time of one hour is worth $*** per hour. *** charged us $*** for installing the new fiber optic cable, which is very reasonable. We are seeking a total of $*** in reimbursement from Bryant Fence Company as of ***. We also ask for late charges of $*** per month if they delay payment past the 13th of ***. If our time spent on this complaint goes beyond 6 hours, we will seek an additional amount per hour as listed above. It is to Bryant's benefit to settle this matter quickly. They have installed about 10 fences in our subdivision and we hate to see their opportunity to install additional fences hindered. We ordered a $*** fence for our own home today from one of their competitors. Was the $*** we originally asked for (before spending all this time trying to be reimbursed) worth it?. Our time lost from work is worth money and Bryant's refusal to participate in the legally mandated negotiations is costing everyone involved. Thank you!

We installed a fence for Mr.s neighbor on ***. Prior to installation, we called *** to have the utility lines marked. During installation, the crew hit an unmarked line. Upon informing our customer, she indicated that everything was in working order, so the crew figured it was an old abandoned line.
On ***, our customer e-mailed to inform us that the line cut was her neighbor's (Mr.)*** fiber line. It was clear at that point that*** had mistakenly placed Mr.s fiber line on our customer's property. Our customer doesn't have*** fiber which is why the line was never marked.
On ***, Mr. contacted us via e-mail asking us to pay his*** repair bill, which he provided. We agree that Mr. should not be charged for this repair given that it was***'s mistake for placing his line on his neighbor's property. We offered to contact*** on his behalf to try to sort this out. We also pointed out to Mr. that the *** ticket clearly showed that the marked*** line was for our customer's phone line and not a fiber line for TV and internet.
Upon contacting***, we were given limited information because we are not the owner on the account. However, they did say that repairing mistakenly cut fiber lines is not something they typically charge for. They also said that what Mr. was billed for was in fact NOT to repair a fiber line. Upon further review of the invoice Mr. provided, we saw that he was actually charged for a "phone jack installation" on ***.
We then called Mr. to inform him of what we learned. He told us that*** did in fact repair the fiber line but that the technician said it would be cheaper if he wrote that it was for the phone. Mr. then said that he would take care of it from there. Also, at that time he asked that we send someone out to quote him on a fence for his property. We sent someone out on ***. That was the last communication we had with Mr. and we thought the issue was resolved. At no point have we "refused to participate in legally mandated negotiations" as Mr. states.
So here is a brief summary to date:
- While working on his neighbor's yard, we hit Mr.s unmarked*** fiber line
- The line was not marked because*** mistakenly placed the line on the wrong property
- The*** flags that Mr. references were for our customers phone line, not a fiber line
- We appropriately informed our customer about the line but there was no way either Bryant Fence nor our customer would have known that the line cut was Mr.s
- Neither Bryant Fence nor *** should be responsible for the cost to repair the line because it was an*** mistake
- Bryant Fence did nothing wrong and we have done everything in our power to help Mr. resolve this issue
-*** will not discuss account specifics with us because we are not Mr.
- We have documentation showing that the fiber line was not included on the *** ticket and therefore unmarked, as well as documentation stating that the repair job was for a phone jack installation
It is our belief that the decision to falsify the repair documentation has led to the unwillingness on***'s part to waive the charges. We truly regret this has happened to Mr.. We understand that Mr. is frustrated, and rightfully so. However, we feel that his frustration is misplaced. We can only assume that when Mr. didn't get anywhere with***, he turned his sights on Bryant Fence. Mr. states himself that, "we can't find anyone at*** who wants to make a decision on the cost." It is easier to drag a small business through the mud in order to get what you want than it is to take a large corporation to task and force them to do the right thing.
As a company, we always try to do the right thing. There have been and will be times when we mess up. When that happens, we pride ourselves on going above and beyond to correct the situation. Unfortunately for Mr., this is not one of those situations because we are not at fault. We are however, still willing to help Mr. try to resolve this issue. We can write a letter to*** on his behalf or have a 3-way call with*** in order to come to a resolution. Please let us know how we can help.

Sorry so late in responding. I have had an injury that sidetracked me. Here is my response.

In over 30 years of business, I have never known a company that admittedly damaged someone's property but said it was someone else's fault for their damage. I have been in business over 29 years and here is the policy myself and other ethical business take regarding property damage by an employee.

If an employee damages someone's property in the course of doing their work, the company causing the damage is responsible, period. Blaming someone else for the damage the employee obviously created shows poor character on the part of Bryant Fencing. It cost them a $*** job (mine). I was willing to buy their fence if they paid for my *** bill.

Secondly, their opinion of whether *** should have charged me or not is erroneous. Bryant fencing caused the damage and now they are saying*** should pay for their damage? They are looking for someone to blame, whoever they can find.

Thirdly,*** did mark their line on half of our neighbor's property (***). The flags were leading toward the area of fence repair. The owner even kept the*** flags to show me. Our neighbor saw *** install our fiber optic cable across her entire property in ***. I even met with Mrs. beforehand and told her they would be on her property. So she did know this our line was there contrary to what Bryant Fence stated in their Revdex.com response. Even the slice mark in the ground was visible in ***.

Bryant's version about what my neighbor said is not correct (see thirdly above). I will ask *** (our neighbor) to write an affidavit about her recollection of what transpired.

Revdex.com, I will not accept anything less than full payment of my expenses. Please do not close this case until this is satisfied. I will get you the affidavit as soon as possible.

If *** does not pay I will file a claim in small claims court. I will ask for punitive damaged and will justify this with legal precedent.

We were told the fence would take 3 days to install. The company only stayed 30 minutes the first day and installed a grand total of 6 poles. The next day they placed poles on one side of the fence and left early to get supplies. The company arrived today and stayed about 15 minutes and left again for supplies. No poles have been planted today. No demolition has been done. When I called the company with my complaint they said it was my fault because I wanted the fence tore down in sections. Well if they had told me that it was going to take 3 weeks with 30 minute days I would not have agreed. I could have tore the fence down by myself by now its so rotten. All they have to do is lean on it and it will be down. But the fact is they still don't have any panels up at all and NO demolition has occurred. I discussed this with Anthony the crew leader yesterday. My question is why did they leave yesterday and today for supplies. And why does the whole crew have to leave to go get supplies. As of now they have been gone over 4 hours to get supplies. So I guess they are having to cut and process the wood by themselves. We are not getting any resolution for our problem. We just keep getting told well if they don't come back let us know. Why do I have to look for their crew? Why are they not finding a crew to come out and take care of my problem? I am not a babysitter. If they don't care to find the crew and make them work then there is a much bigger problem here than than $ for this fence. I cant continually stay behind their workers. Why hasn't Mr. B already come to my property and see what his crew is doing and resolving my problem. I feel they think they can take advantage of us due to my husband being handicapped. My father was in construction. What type of fence company does not know how to prepare and bring all of the supplies that they will be needing for the job? T

The customer was given a time frame by our salesman that was inaccurate. The fence was 8' tall which meant additional posts set at 6' instead of the standard 8'. It was also a board on board fence which requires significantly more material. It was an honest mistake by the salesman and one we have apologized for. Still, the job did take longer than we anticipated. The job site was over an hour from our shop and we could have been more efficient when delivering material by loading it onto our flat bed truck and making 2 trips instead of the crew making multiple trips. The crew leader also had to take his wife to the doctor on a couple of occasions which contributed to the delay. Ultimately the crew did finish and the fence looks great. Although the customer was not happy with how long the job took, I believe they are happy with the final result. They paid upon completion, which we greatly appreciate.

Bryant Fence Company recently completed installation of a fence at my residence. Great job! The work was professional, and the employees were outstanding. Lalo,Omar, and Miguel represented themselves and your company very well. I own two businesses in Knoxville and understand how difficult it is to find and keep good employees. Those guys are winners.

We had to replace our 15 year old wooden privacy fence and decided to have it replaced with an aluminum "wrought iron look" fence. We contacted Bryant Fence and their salesman come out immediately to measure and consult on fence types. We received our quote very timely and scheduled the installation. They were actually able to work us into their schedule earlier than planned, the old fence was removed (and hauled off) and the new fence was installed in about a day and a half (over 350 feet of fence). The fence looks great and the three installers were very professional, hard workers, and very attentive to details, they put up the fence as though it was their own. The last part installed was the double gate and they spent extra time making sure that it looked and functioned to perfection. We couldn't have asked for better service or a better product.

After careful research snd recommendations, I chose Bryant Fence Company. I am glad I did. From the initial phone call for an estimate until completion of job it could not have gone more smoothly. The office and management personnel were always prompt and courteous. The men that came out and put up my fence were stellar. They were clean, courteous and considerate of me and my home.. They worked daylight to dark and after dark.. The fence looks great and I would recommend Bryant Fence Company to anyone looking for a quality, dependable and reputable company that will put up a fence that will enhance your home for years and years.

I give Bryant Fence and the installation crew 5 stars. They put in our fence almost 6 years ago and did a GREAT job! And this month did a reconfigure of the fence for us. The crew did an excellent job of making the changes we wanted AND getting it configured the way we wanted it. Cudo's to all at Bryant Fence.

The crew was polite, professional and extremely pleasant to work with. The crew creatively addressed a couple of complications that arose during the installation.

I am delighted with Bryant fence and the team sent out for the installation. They were very good about bringing up any issues, like a neighbor's water connection being on my side of the property line where the fence posts needed to go, presenting the options available, and working through the resolution WITH me. When they hit MY water line, which was unmarked, unlocateable, and run on a crazy diagonal from the main, they were well-prepared, with everything needed to fix it on their truck. The crew was friendly too.

My experience with Bryant Fence Company was exceptional! David was very helpful in choosing the fence and answering all our questions. They installed before expected, in virtually one day, and did a beautiful job. I actually had the flu during the installation. They had to come back to replace a gate that was late coming in, and Carlos and Phillip, (our installers) even asked how I was feeling. Rick and Sam were great to deal with as well. I have zero complaints. This company cares about their product and above all, their service. They make sure you are happy. I recommend them highly.

Recently had the back yard enclosed with a privacy fence. Everything went as planned. I knew up front prices for the different styles of fence. We went over everything up front and the guy working on the fence would work as long as daylight would allow. Everything seems sturdy, including the gates. Showed me the end product and fixed any concerns I had. Everything was left neat. I would recommend them for your fencing needs.

What a great experience! The fence is beautiful, the price was very competitive and the installers were outstanding. I will use them again in the future. We could not have asked for a better experience with this company! The owner personally came out to give us the initial quote and we scheduled to have the fence put up this January. As soon as the weather cooperated, the two guys were out here and basically had the fence up in one day! The team was super efficient and I didn't even know they were here! I would highly recommend Bryant for any fencing needs!

Bryant Fence just finished my fence and did a fantastic job. The crew that worked on my project were some of the most polite and hardest working I have seen in many years. Their work ethics and level of customer service were exceptional. I would greatly recommend this company for any fencing needs you may have!
