I have been shopping new housing by a number of regional builders in the Lewes-Rehoboth Beach areas of retirement friendly Delaware This coming Spring of will see robust building of beautiful homes with livable floor plans Of course, there is also an apparent return to approximating 'McMansions' among the more upscale homebuilders, as well I have stepped into the realm of purchasing land and having a custom-built home built by reputable area builders Suddenly however, I find I can 'have it all' with Bryton Homes -- models at "The Meadows of Beaver Creek" just minutes from the Lewes-Rehoboth beach resort communities and talk about quality, a range of designs, the ability to customize features (I have a specially-abled adult family member) and, yes, I can have it all and at the most competitive pricing -- leaves [redacted] in the dust price-wise and, yes, I believe 'quality-built', as well! I can even consider having one of their beautiful homes built on my own lot within proximity to their Meadows community I never thought my search would end so happily! And a special thanks to Bryton's professional and caring sales rep, [redacted] !!!

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
Dear Revdex.com:
We hereby reject the response by Mr. [redacted] as being completely untruthful.  During our walk-through on the day of our purchase-settlement, June 19, 2015, we discovered vinyl plank flooring with more waves than the ocean
Attached please find a letter supplied and signed by Mr. [redacted] that verifies what we have claimed is indeed true.  We do not understand nor do we appreciate the fact that instead of finishing our home properly, he would instead be untruthful in his response to our Revdex.com complaint. 
Here are the facts:
·       Bryton Homes required us to use their subcontractor, [redacted], to choose and install the flooring several months before the building of our new home.  We complied with Bryton Homes’ timelines in choosing the flooring.  [redacted] sales person strongly recommended the brand of vinyl plank that we chose as it was sold to us as a top of the line vinyl plank and it would meet our concerns about having hardwood floors installed in a high humidity location.  On the day described above, June 19, 2015, the Bryton Home’s Superintendent said the problem floor was 70% their issue and 30% ours for choosing the product.  We responded that this flooring was highly recommended by their subcontractor.  On that day, it was disclosed to us that the crew [redacted] used to install the floor have not EVER installed a vinyl plank floor.
·       Both our settlement attorney and we strongly requested Mr. [redacted] to escrow $7,000, the approximate amount we had paid for this flooring and Bryton Homes told us that it is their policy not to escrow and refused to do this.  We were backed into a corner because our mortgage interest rate was soon expiring and our attorney believed that Bryton Homes would not leave us with a defective floor.  This fact was reinforced by the letter Mr. [redacted] sent to our attorney on June 19, 2015, which is attached.
·       The local manager for [redacted] was called in on June 19 at approximately 10:30 a.m. and he said that this product should not have been in their showroom and it should only be sold in Home Depot for existing homes-not for new homes.  He reiterated that in the area of Delaware (Sussex County) for which he is responsible, [redacted] had NEVER installed this product nor would he recommend having a floating floor in our location due to humidity.  After about 3 days, he brought alternative selections and a catalog from reputable vinyl plank distributor and asked us to choose another product that could be glued down.  We chose a product and waited approximately 3 weeks for it to be delivered, living with boxes everywhere and tripping over the ocean waves in our floor.
·       The [redacted] manager and several other employees were present when the second installation began.  The crew leader told the manager that the problem with the floor was caused by the incorrect use of the “Luan” underlayment, which the installation manual states is unacceptable, and proceeded to staple hundreds of staples into the Luan and the subfloor; then began gluing the new vinyl plank floor to the Luan.  We were present throughout the day and were told that the glue was not drying a quickly as it should and they were putting our fans on it. 
·       The next morning we awoke to yet another defective floor/installation.  We phoned the manager from [redacted] to visit our home and he came immediately.  He stood and looked for a long time and said he was speechless.  He returned to our home several times over the next two weeks and did follow up with us.  He tried to clean the floor over a small area, but this only caused more scratches and did not eliminate the numerous bumps.
·       In addition, we had numerous discussions with Bryton Homes’ Superintendent who said that the floor only needed to be cleaned to get all the glue off of the floor and that the bumps we were seeing in the floor was just how this product looked.
·       [redacted] offered to put in floating laminate flooring or an impregnated engineered hardwood that we identified over the defective vinyl.  [redacted] said they did not want to pull up the flooring.  We even offered to pay for part of the installation cost for the impregnated engineered hardwood.
·       We researched this option with many reputable hardwood floor distributors and installers in the local area and three of them inspected the vinyl flooring.  None of them would install a new floor over the vinyl and all of them told us that the installation was improper and that the unsightly bumps throughout the flooring was caused by one of the following:  the staples that were put in the Luan, the use of the Luan as an underlayment, the adhesive used was not appropriate for the product or was improperly trawled (fans should not have been used), the flooring was not rolled with a three-part 100 pound weight roller, a requirement for glued-down vinyl flooring.  We also found this information in the flooring installation manual left behind by [redacted].  None of the local wood installers could identify a reason why the floor had scratches in it on the first day of installation.  
·       During one of our many conversations with the [redacted] manager, he told us that one of our options was to request a refund from [redacted].  If we chose that option, then he would need to clear it with his President.  Within one half hour of requesting this refund, the [redacted] Manager responded he would deliver a check in a few days, which he did.
·       We made the decision to request the refund offered for the following reasons:   (1) We did not want [redacted] installers to return to our house because of the damage they had done in our house and furniture; (2) They were not willing to remove the second defective flooring, and (3) The Superintendent for Bryton Homes was not willing to acknowledge the fact that this installation was not done properly and that the his opinion was that the flooring looked like it was supposed to look.
·       We have been forced to live in a 1,800 square foot home being unable to unpack while waiting installing of 1,000 square feet of flooring that we purchased from an independent company not affiliated in any way with Bryton Homes. 
·       In retrospect, we believe that the Sussex County Building Inspector would have revoked the occupancy permit on Friday, June 19th, the day of settlement, given the danger provided by the defective floor. 
·       While we did accept the refund and are not filing a complaint against [redacted], since [redacted] is a subcontractor for Bryton Homes, the new floor that we are installing includes an additional $2,000 to $3,000 cost to remove the defective floor.  In addition, there are other costs that will be incurred such as cleaning the HVAC ducts, replacing a three-month HVAC $70.00 filter that we have already replaced twice since June 24th due to the dust in our house and repainting/replacing quarter round and touch up painting on walls.  We have contacted Bryton Homes about covering these costs, and we did not receive a positive response to this request.
Our statements here today are verifiable, not only with the attached document but also from our settlement attorney.  If you would like to contact our attorney, we can supply you with his contact information.
In closing, it is hard to fathom why a new home builder would not want to address serious deficiencies in a new home, exposing itself to a Revdex.com complaint and then responding untruthfully.  We are extremely disappointed and shocked by Bryton Homes' response to this complaint.  We hereby request that the complaint remain open and posted on your Website and at this point, we have no choice but to contact the Delaware’s Attorney General of Consumer Affairs or others.

Review: Home built by Bryton Homes in The Villages of [redacted]. Problem is continuing issues with Home and Customer Service. Started when we discovered the 4 foot Great Room Extension was short by 10 inches by 15.8 feet. The company grudgingly credited a per square foot loss credit. The day of Settlement we discover that the Vinyl Plank floors we had ordered via the company Bryton Homes used, were warped so bad that it was a huge safety factor. Bryton Homes refused to allow us to escrow $7,000 for the 1000 square feet involved, and with our loan commitment expiring, Bryton Homes supplied our Lawyer with a 'Promissory Letter" guaranteeing the floor would be replaced, to meet "their standards". We had to move in on June 24th and were unable to unpack our house(still not resolved as of this complaint). The Flooring Company readily admitted the product was sub-standard and should not have been in their show room. They also promised to replace the floating vinyl plank, but with a glue down vinyl plank. We chose a Commercial quality replacement from a sample book the flooring company supplied. Many weeks later, the new floor was installed. We were told the first floor failed because of the Luan underlayment. Then to our surprise, the floor crew stapled the Luan to the subfloor and glued the very thin (3mm thick) vinyl plank on top. When the job was done, we discovered glue all over the floor and our brand new refrigerator(This was a New Home). In addition there were planks sticking up and scratches all over this Commercial floor. An installation brochure the installers left clearly indicates that Luan is an "unacceptable underlayment material" for this floor.We also discovered that much of our furniture had been damaged, even more than from the movers . In addition, there were NO transitions installed between the floor and the bedroom carpet, a definite safety hazard!. To this day we do not understand why no transitions were ordered or installed. We had Bryton Homes Construction Foreman inspect the floor and he indicated that he would like to see it after the flooring company cleaned it. We pointed out that the floor had ripples everywhere and that cleaning would not change that, BUT we agreed to let them try. The flooring company Manager came in with a Mr. Clean Magic Eraser and cleaned a small area, which made the scratches and ripples much more apparent. He also indicated that if we found someone to clean the floor, he would reimburse us. That is just crazy, as the Foreman indicated the flooring company would have it cleaned. More shortcuts here! At this point, the Flooring Company Manager suggested that maybe we should take a refund from them, live with the floor(with no transitions- which we thought would be installed) and replace it later. We would like to point out here that this Managers 's original intention was to install engineered hardwood, or some other product of our choice, on top of this defective floor. When I asked him if the company had special crews that install hardwood, and different crews for different types of floors, he answered " no, we use the same crew , and we only do new construction" I stated "at this point I think we should part company, and we will agree to the refund you suggested" we did this not realizing that the transitions would not be installed, thereby making it impossible to install anything on top. We didn't want to anyway, as 4 different flooring companies had come to inspect the defective floor, and bid for the job. Each company indicated that the ripples we were seeing were the result of the stapled Luan, too much adhesive and improper rolling to flatten the floor. Although we accepted the refund for the Vinyl Plank and agreed to hold the flooring company harmless, only for this part of the whole house installation they did for Bryton Homes and us ( carpet in Bedrooms, Ceramic Tile in Baths), we did not realize that removing this stapled glued vinyl plank would cost us $2,000 over and above whatever flooring we chose. To this date (September 7, 2015) we are still living with this defective floor and no transitions. We have ordered new flooring, but have no install date and still are living in a house that we have been unable to unpack.

As if this was not enough, we have discovered that Bryton Homes did not use adequate supports for our subfloor, leaving 15 feet between concrete wall/pillars. When anyone walks across the floor, it moves and the vibrations can be felt just sitting in the room All four of the flooring contractors that inspected the floor indicated there was not sufficient support to prevent this huge amount of instability. Bryton Homes has refused to do anything to help us with this a critical issue, and one that we spoke to the Construction Manager prior to our home being built. We told him we had a serious issue just like this,with the home we were moving from, and were assured it would not be a problem here. The Foreman will not even come and sit in a chair to see for himself, so we are working with International Beams of Canada, the manufacturer of the I-Joists used as floor joists.

Another issue we pointed out was that the floor crew had got glue all over our new refrigerator door, and had scratched the door in an attempt to remove the glue. Once again an unacceptable issue with a brand new home!

We kept inquiring about the door for over 6 weeks, with no communication. Finally we receive an email in response to our email, indicating that the assistant foreman had ordered the door. Turns out this was not true. A GE Appliance representative(called to check up on the electric smell and possible fire hazard from the dishwasher) that called me about the next issue I will be explaining below, contacted Bryton Homes, and one half hour later I got an email confirming the door had been ordered. No one told us the door would be delivered to us, only that the install was scheduled for last Friday, September 3rd. The door was delivered here on Tuesday September 1st, and the attached shipping form showed the door ordered on August 29th, This past Friday, a GE serviceman arrived to install the door. He acknowledged that the door wasn't ordered until the date shown, 8/29 , and then the service man refused to install the door because Bryton Homes did not make the arrangements to pay for the installation. After waiting all day last Friday, this service guy refused to wait while we tried to reach Bryton Homes and walked out the door and left!

Even more unbelievable is another issue we had (mentioned above). Our brand new dishwasher stopped working, and we discovered that it had flooded our conditioned DRY crawl space. The Plumber for the builder came out and told us it wasn't his fault. When we asked him to help us use our own Shop Vac to get the water up, as I am disabled, and now have a torn Rotator Cuff, this Plumber refused and left us with 45 Gallons of water to vacuum up and lift out of the crawl space. Further there was an strong electrical smell from the dishwasher.Prior to doing this, we called and begged the Bryton Homes Foreman to help us. His response was that his assistant would come the next day to cut a hole in the plastic in our conditioned crawl space and drain the water under the house. This is something that should not be done, and yet another shortcut by this Builder. Who would want to drain 45 gallons under a sealed dry crawl space and then reseal over top the muddy mess ? I vacuumed it all up, and spent the next two days in agony. Bryton Homes did not care to help us the right way, nor did they even say thanks to us.

With all these issues outlined above, unbelievably there are more. In a brief description, here are the other issues we have dealt with:

-all towel racket and toilet paper holders keep falling off the walls and were never installed or tightened properly

-our bathroom sinks were never caulked and the shower only partly caulked. This existed for 2 months, until finally done. We kept calling and asking , and the kitchen company denied they were not caulked.

-Numerous damaged Cabinets were installed. We are still waiting for one, as well as some trim installed around our bath cabinets to hide the damaged ends- yet another shortcut!

- It takes way too long to get hot water to our Master Bath sinks(rear of the home and about 50 feet from the water heater). The Plumber and Bryton Homes have refused to do anything about this.

-There is so much dust in our ductwork from the floor being pulled out, we are almost done with our 2nd 3 month Air Filter. When we told the Foreman that we vacuum every day and their is constant debris being spit out from our HVAC system and its ductwork, the Foreman indicated that the New Owner Handbook said it should be changed monthly. We gy an upgraded Heat pump that does not use a regular filter, rather a MERV 8 Media Filter. I bought 4, and the installing HVAC company confirmed that I was correct and that it is a 3 month filter. This shows just how little attention went into the building of our home. We also had to get our Thermostat replaced as it did not work well and we learned there was a recall on it. How could the Foreman not know this, as we might be the only Buyers to upgrade and pay extra for a quality system and not a bottom of the line builder model with specs from 2004 (10 seer-this is what we got in 2004 in our previous home). Oh by the way, we were never given a "New Home Owner Handbook. I got one yesterday at the sales office.

-We have asked for a duct cleaning after the 3rd floor is installed, and were refused.

-The I- Beam Manufacturer is setting up an inspection of our subfloor, and when they contacted Bryton Homes, they refused to participate and be present for the inspection- no date has been established yet.

To summarize, no one that spends their life fortune on a new home should ever have an experience like this! While Bryton Homes did address some minor items on our "punch list" they have been unavailable and unwilling to help with these excessive and unacceptable flaws in our new home. Living here since June 24th, under these conditions has been intolerable. We would never have thought of filing this complaint, but over the past 2 weeks, it became apparent that Bryton Homes was not willing to do anything to help us.Desired Settlement: -We hereby request reimbursement of the $2,000 it will cost to remove the defective stapled and glued flooring

-We request a mover and storage pod to put our already damaged furniture in when the new flooring is installed

-We request replacement of any shoe molding that cannot be re- used, and painting of all the shoe molding when the floor is done

-We request a thorough duct cleaning after the floor is done. We will eat the cost of the expensive MERV 8 Media HVAC Filter, that the Foreman apparently either doesn't remember or tries to turn the blame back on us.

-We still need one Cabinet door replaced and the promised molding to cover the defect of the Master Bath Medicine cabinet

-We need the hot water issue to our Master Bath addressed. We are willing to purchase an Ariston Point of Use Water Heater, and have a stand built to hold it in the crawl space, but are requesting that Bryton Homes do the plumbing connection and supply an electric outlet (needed0 no more than 5 feet from the location it is installed in.

Although we feel totally abused, ignored and disrespected by Bryton Homes, and never imagined we would have to file a Revdex.com complaint in order to get all this work done that should have been done correctly, we will accept only all of the above, and with that, we will agree to forego legal proceedings and a complaint to The Attorney Generals Office of Consumer Affairs. One would think that since Bryton Homes is still building here and at The [redacted], that they would want happy Home Buyers willing to give good reviews to prospective buyers. We have already allowed several different families to tour our home, while saying nothing negative about them In fact, we learned yesterday that one of these families has contracted to build the same home as ours ( A NEW Floor plan, which we were the first to buy with 2 four foot extensions), just on the other side of our next door neighbor. Bryton Homes response regarding the size of the home issue, as well as the unique problems we have experienced in a floor plan they had never built before was " We build off the Blue Prints!". Our response was " Customers buy off of the Floor Plans you provide, as we are not Home Builders or Engineers" To date, their floor plan for our Kendal Model is still incorrect and being sold this way, while we were told that we could have the credit for the missing footage we paid for, only if we did not talk about this with anyone. I must ask- WHAT IS THAT?

Finally we state that this is nothing personal, however it seems that the Construction Manager has taken this personally, and made us fell that we do not have the right to ask for repairs on a home that cost us just under $440,000!
