I have reviewed the offer and/or response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Regards,
[redacted]
Thank you [redacted] for letting us respond to Mr. [redacted]. We have attached the "iron clad" contract that Mr. [redacted] mentions.  We agree that it is "iron clad" in that it shows we have a year warranty on his work, including plants/shrubs (middle of page 2). Therefore, he is obligated to honor this contract.
Mr. [redacted] can talk all he wants, but the fact of the matter remains that his company performed sub-standard work (we now have 4 dead azaleas and it looks as if the evergreen trees are also dying). The water problem was not fixed and we have additional proof from another contractor that the mulch bed is now moving the water away from the french drains and into the area that is now flooding.  There is no 'spring' in our yard. Moreover, we have had [redacted] nursery view the dead/dying shrubs in the area that is chronically wet, and they said it is no surprise because azaleas do not like chronically wet soil. They were amazed that a landscaper would not know this.  Please know that I have sent Mr. [redacted] several emails and text messages (his preferred way to communicate) over the past month without even the courtesy of a response. His mode of operation is that once he gets his money he fails to honor his commitment. The proof is clear.
This all points to incompetence on the part of Mr. [redacted]'s business. Mr. [redacted] seems to always defer his position to 'I'll get my lawyer' in order to try to intimidate or bully us. We have responded in kind, and we will follow through with a lawsuit to make our yard right. We spent way too much money (I have now learned the hard way) for poor quality work.
Thank you

demanded that I send a diagram in order for her to approve to get this done while
they were gone. I insisted I needed time to take measurements to do a drawing

through. We did, and she once again said move forward. By the time the ptants
were available they were out of town for spring break and once again she said
"lf I don't like it you can take them out". Meantime, weeks are
passing by. We showed up to work after spring break and her husband on the day
we were to work was pressure washing the rear fence line and it was too wet to
work. We once again had to leave. At this point I am very nervous about
finishing and getting paid. I have a file full of emails and text messages
getting them to finally agree to the terms and completion as she had just said
I no longer want the plants, forget it. I let her know it was too late for
that. We were finally able to finish and get pa id in full from her husband.
She took days off of work to follow us around and video tape everything. 3. The
drains have worked perfectly where installed throughout the entire process with
rain fall coming down, if not, we could not have completed the job. 4. I notice
that you did not include a copy of the contract that the [redacted]'s signed, or
emails, or text. We are licensed and insured and they were provided
verification of both before work started. I am positive that you did not
receive them because they do not support her claims. I am happy if needed to
forward all to you in the interest of sharing all and letting the Revdex.com see what
we have had to dea I with. 5. Laborers were not fired. A sub-contractor quit
and would not return the keys to the company truck so we had to call the police
to force them to give the keys back. The whole time, Mrs. [redacted] leaves her
property, comes into the street videotaping and will not walk away although it
did not involve her. The police officer even asked what her role was and she
could only say homeowner, but would not leave the street. Those same two men
drove nails into the truck tires that day. Since when does anyone take it upon
themselves to pay a sub-contractor outside of a signed contract and get upset
that they are not reimbursed? We had no lega I obligation and the men lied
about their hours and pay amount. 6. The [redacted]'s contract was not with those
men and they should not have paid them any monies. The men lied to them about
their wages and the hours that they were at the [redacted]'s house. When asked how
the men were at their house for 38 hours in three days the [redacted]'s had no
answer. 7. Another delay came when the [redacted]'s decided to irrigate the rear
yard where the sod was to be installed. After all had been prepped, we had to
leave for almost a week for a company to install the irrigation when the sod
could have been laid that day. They since developed another water problem
outside the area we worked on that they tried to blame on us, but were told by
the irrigation company as well as us that it had nothing to do with the work
that was performed and may be an underground spring. In closing: The [redacted]'s
with the Revdex.com as well as an online broker for contractors have made numerous
unfounded claims. It's interesting that you do not have a copy of the ironclad
contract and damaging emails and text that they are embarrassed over. They paid
in full for a job they were happy with and have no warranty issues that are not
covered by the contract. We as a result have had to retain council in order to
file a civil suit in Henrico Circult Court in order to protect our reputation.

Review: Paul A[redacted], who operates under several different Company Names - P&S landscaping, RVAoutdoor creations, RVA landscaping, BT Anderson landscaping to Name a few. He is operating under his sons contracting License. I contracted with him to do work at my house. It was the worst experience of my life. Excuses, lies, and then no communication. He took the deposit and second draw and never did the work. He didn't pay his employees and left all his tools and debris in front of my house for 2 months. started work and never came back once he got the 2nd draw. I found out later that he never paid his employees. Construction dumpster and debris in front of my house. He is crook, and a con man. He never fulfilled his contract and took a $15,00 he claimed was to get the material for the back and never came back. Dug trenches in my back yard, killed the grass and a tree and never came back or returned calls.

Review: This contractor ([redacted]) is highly unethical, rude, and unreliable. He took about 7 weeks to finish a fairly simple job, and we are already having problems 2 weeks after completion of the job. He will not return our messages. He wants your money, and then he is through with you. Does shoddy work, treats his workers poorly (he fired them in our driveway and to date has not paid them). Because they were laborers with little money, we paid them for their work (of course this was not refunded to us by Mr. [redacted]). He constantly berated us over text message, and phone calls saying it was our fault that the work was not completed. He hung up on us, and clearly has anger management problems. The police were called to our house while he was firing his employees. This has been the worst experience we have ever had with a contractor. Do not hire this person (he goes under several names, such as [redacted], etc). If you look on the [redacted], he has a very long rap sheet of complaints.Desired Settlement: He should not be in business any longer.

Regards,

Thank you [redacted] for letting us respond to Mr. [redacted]. We have attached the "iron clad" contract that Mr. [redacted] mentions. We agree that it is "iron clad" in that it shows we have a year warranty on his work, including plants/shrubs (middle of page 2). Therefore, he is obligated to honor this contract.
