BTL Homes

Dear DPOR representative,

My name is ***, owner of a residential home at the forth mentioned address above. On Sep 26, 2019, I signed a contract with Mr. Miguel Z of BTL Homes to build a home addition of an existing residential home that I currently own. I've provided him with all the approved plans and building permit as produced and approved by the Fairfax county. The total agreed price of the entire home addition project (shell option) was $234,860.70 ($50,852.05 would be for completing the entire foundation/ basement work - phase 1 - and the rest $184,008.65 for the rest of the home addition, including constructing addition on the main floor with a 2 car garage and a new second floor -- less an incentive discount of $5,500). A total deposit of $57,500.00 was also paid via bank wire on Sep 26, 2019. On top of that, the contract also required that I pay weekly payment as work progresses, which I did. So far I've paid Mr. Z a total of $87,610. Actual work begin around 6 weeks after signing the contract. However, at certain phases of the work, it became very evident that his crew/subcontractors were mainly interested in improvising ways to outsmart county inspections, without regard to honest and quality work, and more importantly to my concerns as the homeowner and payer. I've raised a number of concerns to Mr. Z, but they were either ignored without offering any valid justification, and or were not met on time. In any case, following Christmas day of 2019, he decided to abandoned work after I cited some concerns with the quality of work and that some the issues I raised have never been addressed, at which point he grew nervous and impatient and declared that he's abandoning work. I made a number of attempts in good faith to reach out to him and have him resume work, but such attempts failed as he vehemently refused to resume work unless I paid what he called "actual cost". So far and as of the date of this complaint, he won't refund my money or resume work.
