Initial Business Response /* (1000, 5, 2015/11/07) */
At no time did BTW ignore a stop work request from the ownerWe setup meetings and discussed his issues and addressed themWe explained what materials we used and whyAll of our work meets or exceeds the Alberta and National building codes
If you look at the cover letter for the quotes it makes it very clear to the client to make sure if there is a product he wants to be used have it written in to the quote or its not there and BTW will use the materials it feels are best for the projectAll plumbing for the shower was installed by a certified licensed plumberNo clean out is required for the shower, there is a main cleanout with 8' of the shower that would serve as access to shower if requiredWe instructed the plumbing company to contact the client to explain his misunderstanding of the Alberta Building codeThere is no need to reopen the floor for a cleanoutWe were repairing a bathroom that was partially demolished so we didn't require a permitWe returned to the client's home twice to repair the faulty stopperThe fan was working when we arrived and we checked it out anyway finding no issues with itThe toilet was not reported to use as movingWe admit that the subcontractor that removed the tub should not have taken out by himselfHe did damage a baseboard (to small chips were missing) and there were several rub marks on the wallsBTW offered to repair the baseboards and the paint but the client stated he didn't want us to do the workThe Client and BTW agreed on the sum of $for the mirror repairschips and painting over rubs do not total $The client still owes BTW $We have attached the original quotes for you informationIf we can be any further assistance in this matter please don't hesitate to contact us
Initial Consumer Rebuttal /* (3000, 7, 2015/11/10) */
(The consumer indicated he/she DID NOT accept the response from the business.)
BTW ignored the stop work and came in on two occasions while I wasn't home and continued to work, when confronted Wayne of BTW made excuses, he indicated issues were going to be dealt with this was all misleading to finish the job and get paid this is why he agreed to give me a three year warranty otherwise I would not allow them to continue to work, Electrical and plumbing issues have popped up the day after the job was completed! and I have had to hire tradesmen to repair them as BTW Wayne refused to come back unless he was paid and additional $this was work done by two non-tradesmen G*** and WayneBTW indicates All plumbing for the shower was installed by a certified licensed plumber, this statement is an outright lie the plumber *** the owner of *** actually only put in the plumbing drainage and vent for the toilet and shower nothing else the rest of the plumbing and electrical was done by Wayne and G*** neither of them are plumbers or Electricians! And despite being charged Journeymen wages I received two laborers this is the BTW wayAlberta building code was given to BTW and they have never responded to this, - Cleanouts and access cover shall be located so that their opening are readily accessible for drain cleaning purposes, *** did not say it wasn't in code just that BTW never ordered the work done BTW has never responded to this and how they would fix it ***The invoices are all paid in full and signed by Wayne of BTW ,as well as a three warranty that is signed and dated by BTW not they will honor it as they have demonstrated until they go to court ,the additional money came into play when I asked them to come in for the third time to fix the toilet that was rocking and leaking, the stopper that wasn't attached properly and the electrical work was done by Wayne and G*** and not Electricians or plumbers! I asked and have the emails to stop work and on three occasions I also advised by email that he was double charging, for garbage removal $and two Miscellaneous of $ when confronted I was told it was for extra labor and extra garbage fees and then it was for extra materials despite being charged for them there invoices are misleading and promise materials and work by professional's and instead you get 1/of what is necessaryThe damage to the home including the hardwood floors, walls bathroom door and outside walls baseboard and up and downstairs walls are all having to be redone and new baseboards ordered ongoing and not scuff marks but broken baseboard, holes in two walls, scrapes and corners damaged a hardwood floor destroyed, bathroom door scraped despite my request on numerous occasions to cover the floor
I have the contracts and emails and can send all in to your office at no time did BTW offer to repair as they were told they needed to replace the baseboards and paint all the walls and repair the damage, they wanted to put chunks of carpenters putty and fill the hole this was unacceptable as these are custom paints and moldings and the two times BTW came in they wanted a cheque and the only reason the returned was because of the money, this bathroom was completely gutted and the floor completely opened and the companies that advised me on this job indicated they required permits, ***, *** *** I will forward the information on the contracts and emails to Revdex.com , BTW and MrR*** distort facts and ignore customers and now I have a basement bathroom that will have to be redone including the cement board or cement board, the toilet was seated outside the wax ring and BTW filled the gaps with Caulking, stopper has been replaced and the shower needs a vent and Pea trap to have what I paid $thousand for accept it will cost about $to do now
Final Business Response /* (4000, 20, 2015/12/02) */
On the last occasion I visited the *** home I was accompanied by an associateHe can testify if required that We knocked on the door were granted access by the client's mother and I informed her why I was thereShe aloud us to continue into the basement were we replaced the popup with a pushdown style not requiring the rod that came with the faucetWe insured the popup was not leaking and totally functionalWe tested the water supply from the faucet and it was running properly and the faucet itself was functioning properlyWe left the faucet rod on the counter for the clientThere was nothing wrong with the faucetApparently a sub contractor damaged a small corner of the baseboards (approximately 1/2" by 1/2"on two 6" pieces of baseboardAgain the sub contract allegedly rubbed against the staircase wallsWe agreed to a $credit on the final inspection to resolve the matterWe had the floor cover with tarps the first day and hard cardboard for the remainder of the projectIn my opinion we did not damage the client's floorI gave the client an option prior to starting the project if he wanted to get permitsHe declinedThis client has a totally functional bathroomWe completed all the requirements of the quotes or gave the client credit for anything that was not doneThe client allegedly claims the grate in the shower is brokenthe only way that can happen is if someone tried to pry it offIn that event that would be the clients responsibility not BTWThe Client hasn't mentioned that he has or will be reimbursed from the RAMP program for the bathroom portion of the projectIf this client feels he has a legal action then he should proceedI have no intention of avoiding it, in fact if he does proceed then I would welcome the opportunity to defend myselfThere is no need to open the bathroom floor and there well be no refund from BTW as we have not do anything wrong
Final Consumer Response /* (4200, 22, 2015/12/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
*** it is true that BTW came in Wayne came in never told me what he was doing, after he left I looked and the stem was broken of a $faucet and a used stopper put in, when I tried to contact BTW no one would answer as I wanted a new faucet in there as this made the damage on their made it look old like garbage, I then asked BTW to come in and repair the shower handle that fell off and the drain in shower came out they refused and I have the emails and text to prove it, this all came about because I'm trying to serve court papers to BTW because my whole bathroom floor and walls will need to be reopened according to service Alberta inspectors because BTW never got permits and the work was never inspected, Wayne and G*** are not tradesmen according to Advanced education and refuse to answer those concerns because all they are is laborers and don't dispute this, Damages to my home on the walls up and down my stair case were in the hallways and door and door jams, this after many complaints G*** the laborer damaged the Brazilian hardwood in eight rates and the custom Hardwar wood and baseboards will need to be replaced, this contractor tried to hide the damage and leave before I had a chance to inspect when I did I confronted him and that when he avoided me, when we finally spoke MrR*** indicated they would reimburse me for the damage and when he offered I told him that would even cover the hardwood he laughed and left, *** He refuses to honor the warranty and I have a thousand dollar bathroom that looks like garbage and two months after completion the problems continue and the warranty is useless as I have to pay contractors for the *** work BTW did, ***
