To Whom It May Concern: This is in response to the complaint filed by Dr [redacted] Dr [redacted] used my office to handle a speeding ticket in My former associate, [redacted] , was the primary attorney that handled the speeding ticketOn August 27, 2015, my legal assistant received an email from Dr [redacted] regarding a new speeding ticket he had received (see Exhibit “A”)My legal assistant replied on September 1st and immediately notified Dr [redacted] that [redacted] had moved and is no longer with this officeWe offered to handle his legal matter for a flat rate of $300.00, the same fee Dr [redacted] was charged for the speeding ticket (see Exhibit “B”)Dr [redacted] replied that he wanted us to proceed and asked my office to call and obtain his credit card information for payment (see Exhibit “C”)A receipt was emailed to Dr [redacted] and a letter of representation was faxed to the Court (see Exhibit “D”)Dr [redacted] sent an email at 5:p.mon September 1st (after my office had closed for the day) that stated as follows (Exhibit “E”).“Hi [redacted] ,I think we had a little mix upI intended to hire [redacted] for this and thought you were calling from his officeWould you please refund the credit card? Apologies for the mix up.Best, **” My legal assistant replied the next morning and reiterated the entire situationDr [redacted] was provided with the option of a refund minus the services that had already been provided (see Exhibit “F”)Dr [redacted] replied and basically accused my office of being “opportunistic” and “unethical.” See Exhibit “G”)He further claimed that my office charged him “$for a (single) email.” My office responded and again asked how he wanted to proceed (Exhibit “H”)An invoice detailing the services that were provided is attached as Exhibit “I” for reference No response was received aside from the groundless complaint he filedMy office received a plea offer from the Court on September 8th which was emailed to Dr [redacted] My legal assistant asked for his mailing address to send him a refund check since he retained Mr [redacted] to handle his case (see Exhibit “J”)Dr [redacted] responded asking that my office submit the refund directly to his credit cardMy office does not retain credit card information for security purposesA second email was sent to Dr [redacted] informing him of this and asking for a mailing address to send the refund check in the amount of $(Exhibit “K”)To date, Dr [redacted] has not provided an address to send the refund check
