During the course of Mr***’s lease, the Homeowner’s Association has under taken through the direction of its management company, *** ***, various structural maintenance items and repairs. At the time this rental unit was listed and rented to the tenant, *** *** had not
advised our firm of any work planned for this building. Visible construction was evident in other areas of the complex. We believe that Mr *** would have seen that construction at the time he viewed the rental unit however I am unable to speak to any conversation related to construction or requesting any form of disclosure regarding the specific rental unit that may have occurred at that time as Mr *** elected to see the home with an agent from another brokerage, *** ***. While Mr *** denies that the realtor who showed him the unit is his agent, he named her as his agent on his rental application and she received the standard cooperating agent commission from our firm.As Mr *** states in his complaint, our firm does not own the rental unit in question but represents the homeowners. Without the homeowners’ consent, my firm does not have the power to revise any term of the lease releasing any portion of the security deposit or reducing rent. When we received the tenant’s complaint, we contacted the homeowners to negotiate fair compensation for the tenants inconvenience related to the construction At this time, the homeowners and the tenant have agreed to settle this matter with a return of 50% of the security deposit and they have executed a written agreement to that effect.Please advise if any other information is required to resolve this complaint.
