I’m not sure why this client would choose to pretend ignorance of who he spoke to when he signed up for services with the NALA, since the “Welcome Email” identifies all of the parties to the contract and includes contact information with phone numbers and email addresses. The “Welcome... Email” also includes a copy of the contract, details of the business, terms and conditions of the services provided, descriptions of the products purchased and how those products are provided The NALA (National Association of Local Advertisers) was established in 2010 to help local business owners (client) establish their online presence in the ever changing world of digital advertising. An integral part of preparing the best course of action for their marketing campaign is to register and post to different websites. The NALA works with the client to achieve these goals, but the client must cooperate with us to do that for them. This is an important part of the process and is reviewed with the client the very first time we speak with the client. The code needed to move forward is required and the documentation shows that the client has been asked several times for this information and never responded. The NALA did not lose something that was never provided. All correspondence to and from the client is documented. This documentation clearly indicates the reason for the request, how the code would be provided to him from the service he owns and how and when this information would need to be provided to the NALA, as the code has a short life span once the request is made. When the client does not or refuses to help and engage in the process, the NALA will try work-a-rounds, but our experience is that without the client’s help the results are not effective.The NALA works with the business owner, not apart from the business owner. Press releases are an effective and proven successful marketing method to increase the business visibility online. But the press release requires the client to engage in the preparation of that news release with their Account Manager. Where the client struggles to come up with viable news worthy material, choosing to sponsor and work with a charity is a wonderful opportunity to showcase the client to the online world and has the greatest results in getting their news release to reach major news outlets. The NALA’s goal is to help the client increase their online visibility, but we also expect to be paid for our services. The NALA business to business contract is non-cancelable as stated on the contract at the time of purchase. However, we do understand that the client’s financial situation or personal circumstances may change during the providing of these services, and where we are able to modify and adjust our services to help the client, we will. Due to financial issues, this client asked us to cancel his contract after working with his Account Manager for almost two months. Although, we were unable to cancel the contract, we did offer to modify the contract. The NALA has and is willing and able to continue to provide the client with the services he has paid for and to modify his contract. We stand behind our product and we work diligently to maintain our reputation and integrity. A refund is not warranted to this client as services have been provided as stated in the contract. The client has at this time refused to provide the necessary information to move forward on one of their products; when and if the client provides this information, the NALA can complete this phase of their program. On the other product, the NALA has worked with the client trying to come up with ideas for the press release and has provided ideas for him to consider, but he has yet to respond to our ideas and has not provided his own. The NALA press team will write the news release, but the NALA cannot fabricate a news release, it must be news worthy and factual pertaining to the client’s business. We would be happy to finish the contract as agreed, should the client decide to move forward.
