Good Morning....Thank you for responding...What Mr [redacted] did not mention to you in his complaint, is the " over payment" in question was the result a late payment on his partI carried an IOU for several months, without fees of any kind, ( I can fax you a copy if you'd like) for the final payment of a job that was performed as indicated on your copy of the Home Improvement Agreement that he provided I was handed a check for $ 3, as partial payment for the final in early October A couple of weeks later, after they returned to their winter home in Mexico he called me to inform me that they received notice from either their bank or money management firm indicating that the check in question was in "Insufficient Funds Status" ( INSF)His only recourse was to have his son bring a replacement check when he returned from Mexico, sometime in late November.Not wanting to bore you with the whole scenario, but in my defense, I'd like to outline some previous facts that will enlighten you on my position, which as it turns out, is based on Principal only, and has no legal standing.The [redacted] s had applied for a first mortgage to fund the completion of the remodelBased on the delay of approval and funding from [redacted] ***, I agreed to continue forward progress, and fund the project until they received funds, which wasn't until early January This was ( at my stupidity), without fees of any sortI had funded over 150k for over four months They called me in early Jan2016, told me they had received the money to pay me, but when I went over to pick up the check, they told me they could not pay everything, and asked me to either carry the remaining balance, or let them make paymentsWe agreed on an IOU(This was after I had discounted my contractors fee by 5% to make the balance due more palatable., over 10k)..With that being said, some time after their son had returned from Mexico, sent me a checkwhich I cashed, Mr [redacted] called me again from Mexico accusing me of stealing money from him by continually re depositing the original check ( that he acknowledged had INSF) , and cashing the replacement checkThis was a accusation as my bank ( [redacted] ***) has a SOP that automatically debits his bank 2-times before alerting their customer ME, that the funds would be deducted from my accountI never received ANY notice from [redacted] that funds had been reversed as bank statements indicate, and based on my work load, did not check the balance everyday like he apparently did.Regardless of all that, his multiple accusations really upset and hurt meBased on the concession's I had made to reduced their cost, and me working almost days a week for months, I told him I would look into it when I had time and ignored his accusations of stealing his money/complaints, and failed to research the issue, until I was severed a Notice to appear in Small Claims Court a couple of weeks ago, with a court date of 9-27, but was postponed until 10-to give me time to research this issue.Having sought legal counsel, and not wanting to waste any more of my time and money on Principal, I will be refunding Mr [redacted] his "over payment" in the next day or two, which is an option indicated on the SC-100, rather then wasting the Courts time as well.I will be pursuing no further action in this matter unless forced to, and will be forwarding a copy of this email to him with payment.I hope the Revdex.com requires an acknowledgement of some sort from Mr [redacted] , that this matter has been rectified.Thank you.Regards, [redacted] ***
