Buckeye Family Eye Clinic, Inc Dr [redacted] Phone [redacted] Fax [redacted] May 13, [redacted] Consumer Protection Specialist Consumer Protection Section Ohio Attorney General, [redacted] office East Broad St, 14th floor Columbus, OH RE: [redacted] ***; complaint # [redacted] Dear [redacted] : I have received your inquiry regarding a complaint from [redacted] ***, who is claiming that the glasses that he purchased from my office did not workAccording to your notice he has claimed that he tried to bring them back for a refund but our office refused this request Mr [redacted] was seen in my office for the first time on 4-22-He came to my office for an eye exam and to get safety glassesI performed a comprehensive eye examination and prescribed new glassesI measured he could see 20/(which is considered normal, perfect vision) out of each eye with this new prescription, both for distance and readingDuring his exam, I also noted bleeding inside of his right eye that is likely from his diabetes and hypertension (high blood pressure)This is something that needed to be monitored closely, especially since diabetes is the number one cause of new blindness in our country right now among adultsDiabetes is well known to affect visionWe scheduled Mr [redacted] a follow up appointment for 7-22-to monitor this eye health situationMr [redacted] did not show up for this appointment or have the courtesy to call to cancel or rescheduleWe tried to call the patient to reschedule but were unable to reach himThe next time we heard from Mr [redacted] was March 11th, Mr [redacted] stopped in and informed the staff that he wasn't seeing out of his glasses very wellMy staff adjusted the glasses at that time and my staff spoke to me regarding thisI was busy with patients but I asked that they inform him that I was happy to see him that day if he would like to wait (because I was almost finished with my morning patients)Mr [redacted] decided not to wait but stopped in again on March 13th to, once again, inform the staff that the glasses weren't working for himThe staff member who spoke to him on the I asked if he remembered that had said for him to get an appointment and I would see him to address this issueHe made an appointment but was rude and sarcastic and even said that he was being sarcasticHe was so rude, that once again, my staff brought his name and behavior to my attentionWhen he left, he peeled out of the parking lotAnother patient who was in the office and witnessed this event, commented to the staff that she has seen that man doing the same thing to other businesses in town [redacted] ***; complaint g The patient came to his appointment on 3-18-My staff was so concerned about Mr [redacted] and his behavior that they came to me before the first patient of the day and asked how they should handle him when he arrivedI instructed them to just check him in as usual and l would deal with him in the exam roomAt the start of the visit, I felt obligated to inform Mr [redacted] that the visit we were about to have was not going to be freeSince his original appointment had been almost a year ago and his eye health compromised at that time and he did not show up for his follow up to monitor this condition, I would need to re-examine him entirely to uncover the issue, whether it be a vision issue or an eye health issueI did not want Mr [redacted] to incur an expense that he was not aware ofHe then indicated that he wasn't paying for a visit and that I would remake and fix his glasses for freeAt this point I told him I was aware that he had been rude to my staff and that this office is mine and I would not tolerate that kind of behavior hereAt this point he threw the glasses at me and I told him that it was time for him to leaveHe then indicated that he would report me to the Revdex.com (Revdex.com)I told him that he may go file a report with them but it was time to leave my office and that would escort him to the doorI informed him that he was no longer welcome in my office and that I would be sending him a letter in the mail terminating our Doctor-patient relationshipHe said that he would not be back As we continued out toward the front door he continued his verbal abuse saying that we are crooks and thieves and he wanted a refund of $for the glasses and that he would file with the Revdex.com and they would take care of himI reminded him that we are none of those things and the glasses were a year old and that he could have addressed any issues a long time agoI reminded him that he is no longer welcome to step foot in my officeI held the door open for him, using my body as a door stopAs he started to walk out of the door, he stopped right in front of me, looked me in the eye and said "If you were a man, I would hit you." I, once again, calmly reiterated that he is no longer welcome in to step foot back in the officeI then closed the door As I headed back to the exam room to examine my next patient, I noticed of my staff members appeared to be watching in the direction of Mr***, standing outsideOne staff member was behind our front desk, the other near the front doorI instructed them that if they saw Mr [redacted] start to come back toward our office to lock the front doorAt this point, since both staff members were looking at me & listening to my instructions, they did not see him approaching the door againBecause I was looking in that direction, I saw Mr [redacted] approaching the door and yelled to the staff member nearest to the door to lock the doorShe spun around and grabbed the door to lock it and Mr [redacted] grabbed the door handle from the outside and forced it open from her handsShe tried to stand there to block the doorway to block his actual entrance to the office but he continued to walk forward and she later told me she felt like she had to step aside because he appeared like he was going to "mow" her overI continued to stand where I was able to see what was being said and he proceeded to say he wanted his prescriptionShe informed him that she would have to speak to DrBarton to which he responded "Then talk to her." I immediately walked to the front desk area and told him that was no problem (at this point, we just wanted him out of the office because we were concerned about his mental stability and actions) and I proceeded to print it, sign it, and have staff scan it into his recordHe continued his verbal abuse saying he was years old and he couldn't believe we would steal from him like that and he expected a check to be mailed to him for $He also stated "And you call yourself a Doctor?" as well as continuing to make statements regarding the Revdex.comI, once again, escorted him to the front door and reminded him he is no longer to walk into my office and used my body as a door stop to hold it open for himThis time on his way out he stopped and stuck his tongue out at me as he left : [redacted] ***; complaint # [redacted] I happened to run into separate local law enforcement officers that same day and spoke to them on separate occasions regarding this situationI asked their guidance due to the threatening nature of our interactions with Mr***Both law enforcement officers felt it was something that should be documentedThe one law enforcement person informed me that I could file assault charges due to the throwing of the glasses at me After work that same day, I took all of my documentation as well as my staff's documentation regarding all the events that has occurred in our office with Mr [redacted] over these situationsI filed a police report so that they have all of this documentation regarding these incidencesI was informed if he sets foot in my office again that I can have him arrested I sent a letter, dated March 18th 2014, to Mr [redacted] via regular and certified mail, return receipt requestedThis letter terminated the optometric/patient relationship and prohibited him from being in or around my officeI have included a copy of this letterWe did receive documentation that this letter was signed for/received I will not refund Mr [redacted] any money regarding his glasses or any services that he has received at my office as his claims are completely unfounded as well as untimely Regards, [redacted] , O.DEnclosure cc: Revdex.com
