Revdex.com:I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.1. Response is not correct, building was moved foot up the hill so had it not been moved settling would have been more severe. Also, current location is very close to location we originally requested. I agreed to do minor leveling of area around barn and I did dig trenches on uphill side to keep water from flowing into the barn area. I did not anticipate ground would settle nearly one foot on the lower side. My opinion is that most of the settling in this area was due to the fact that this area was leveled with "frozen" ground late in the week of Jan and "frozen" soil was not properly compacted. This may have been aggravated by the "overflowing" gutter in this area which was corrected after several heavy rains/snow melts2. Contractor response does not include allowance for replacement of "untreated lumber" on door or repair to gutters - missing brackets and sealing of gutter joints. 3. Contractor response does not address the out of level condition on the downhill corner of the building structure.4. Contractor response does not address proper "leveling" of gravel in workshop areaThis should including removal of OSB from under gravel and replacement with fill dirtThe sheet of OSB was hidden under the gravel and was only apparent after the ground settled and the gravel ran out. Contract specified about inches of gravel - not 12-inches. Had this been done the gravel would not be running out. Hence I still am requesting for a refund of $Regards,*** ***

Buckeyes Bill-ders did enter into a contract with Mr*** for the construction of a pole bldgin the side of his cow field. Pole bldgwas to be 33' x 27' with an 8' overhang/lestyle roof, which would have had only posts (keep this in mind) sitting at the corner Mr
*** is complaining about. This particular size structure would have easily been accommodated by the 40' x 50' area to be excavated. Mrand MrsCarson both met at the *** residence and laid out/marked bldgsite and then painted the bldgperimeters. Mr*** returned home from work and inspected bldglay out. Mr*** stated he did not like where bldgwas going. Homeowner decided he wanted the bldgto sit back farther in the field. We expressed to him that the bldgwould be sitting closer to the corner that the fill from the excavation would be going. We made him aware that it has the risk of sitting in some loose soil at that corner. He stated that he was aware of that and to go ahead and proceed. He stated that his wife would not allow him to have it if it was not in line with the home as much as possible Mr*** agreed that he would use his Kabota to place back fill to this side of the structure, as well as dig some trenches around the structure to help prevent any water from running through structureTherefore, Mrand MrsCarson pulled up marker stakes and remarked the layout of the structure. Once the holes were dug and posts temporarily set, Mr*** decided once again, there needed to be a change. He thought the bldgappeared smaller than he thought it would be. This time instead of wanting the lestyle roof, he wanted the entire structure to extend the 8". That would mean instead of roof posts sitting at the end of the 50' perimeter, we would have to excavate a larger area to accommodate the 8' extension of the walls themselves. We explained to homeowner that this would bring structure even further into loose fill. He insisted we proceed and that he would take care of getting some fill against that lower side. By the time it was all said and done, structure is 35' x 41' and the area that had to be excavated was approx60' x 50'. As for the 4' x 8' "sheet" of OSB, there is more than one sheet and it had nothing to do with structural support or to try and use to correct any problems. There were several sheets of OSB laid on the ground in that area, due to all of the muck and mud. It was virtually impossible to run a wheel barrow in mud up to your ankles. It came in so handy that we even laid sheets of it from the cattle gate, all the way to the pole bldgbecause home owner would not allow any one to drive in his cow field, and then he asks us to leave it there for him. We also used it in order to keep our tools and materials out of the mud. Mr*** knows exactly why it is there. Mr***s gravel is running down the hill because HE has failed to do what he had agreed to do. Mr*** states no one has been to his residence in response to his complaints. This is untrue. He called and expressed concern over gutters to MrCarson and MrCarson responded and repaired them. After a couple of other calls from homeowner, MrsCarson went to his residence to inspect structure. Upon MrsCarsons observations at the time, Mr*** had not dug any trenches in order to divert water, he had not placed any back fill to side of structure. This is why gravel is not staying in place. I also observed one piece of sheathing on wall between the two rooms has a small hoove in it. Also, the workbench has dropped some. Should be a quick fix...new legs or shimmed up. All lumber on exterior of structure is treated lumber. We used two different suppliersOne supplier has a lighter grade of treated lumber than the other. If for some reason it is not treated, it could have been a possible mistake by the supplier. As for the sample picture that Mr*** is talking about, it is a photo/brochure sample of the what his bldgwould resemble. Contractor offered sample to homeowner as a STYLE GUIDE...not as an exact replica. Homeowner was aware of this. No where in the contract does it say there will be trim on the sliding doors. Mr. *** received a very nice product for the price. It would last a little longer if he would take the time and effort to at least stand up to his end of the work he agreed to instead of trying to find all the fault in the contractor. We will not agree to the settlement offer Mr*** had proposed. When structure was completed homeowner was completely satisfied. We will offer to Mr*** the sum of $for the nailing down of any loose sheathing on walls and to repair workbenchSincerely Misty Carson
