Initial Business Response / [redacted] (1000, 12, 2016/11/04) */ Contact Name and Title: [redacted] Realtor Contact Phone: XXX-XXX-XXXX Contact Email: [redacted] @holleyhometeam.com In response to the claim submitted by Mr [redacted] This response is being submitted by [redacted] as the agent who represented Mr [redacted] in the sale of the property located at [redacted] through Mike Thomas Associates I initially met with Mr [redacted] on July 5, His grandparents, past clients I have sold multiple properties for, also attended the meetingDuring this time we discussed that Mr [redacted] was more than months behind on his mortgage paymentAfter reviewing numbers with Mr [redacted] and his grandparents I felt that we could list and sell the home without a significant loss to Mr [redacted] preventing the property from entering foreclosureAt this meeting I suggested to Mr [redacted] that he attempt to make partial payments as every month additional fees were being added to his mortgage balanceAt this meeting I left Mr [redacted] a copy of the listing contracts and additional paperwork I would need for listing the home so that he could review prior to our next appointment I again met with Mr [redacted] and his grandparents on July 15, At this time we reviewed the contracts together, I answered questions, and he signed the contractsThe home was listed for sale on July 19, On August 31, I assisted [redacted] and [redacted] with submitting an offer on Mr [redacted] 's propertyThey executed the agreement on September 1, and I immediately submitted a copy to Mr [redacted] A limited agency agreement was executed by all partiesI contacted [redacted] Mr [redacted] 's lender to assist in determining what the approximate mortgage balance would be the estimated day of closingEach day that elapsed additional fees were being added to the balanceAdditionally, Mr [redacted] 's escrow account had a negative balance of [redacted] I e-mailed Mr [redacted] a copy of the offer along with an estimated net sheet based on my understanding of his mortgage balance On Friday, September 2, Mr [redacted] contacted the mortgage company himself and insisted the mortgage balance estimate I was using was incorrectPer his request, I updated his net sheet utilizing the numbers he gave me, though cautioned him that I did not believe his understanding was correctThe e-mail Mr [redacted] forwarded me from Stonegate on September 1, with his figures specifically states "Pleased keep in mind fees are subject to change." The representative told me numerous times that the property was slated to go to an attorney and that, once complete, I could submit a copy of the executed purchase agreement but that it would not necessarily stop the foreclosure proceedingsA copy of the executed purchase agreement was submitted to Stonegate Mortgage via fax on September 6, On September 24, Mr [redacted] received a notice from [redacted] & [redacted] AttorneysOn Monday, September 26th I contacted the number on the letter and was transferred to the attorney for the fileI left a message and the message was not returnedI did leave another message on a different day however I do not have the second call documented, nor do I recall the date On Wednesday October 5, I sent a copy of the final closing statement to [redacted] and reviewed with himHe still disagreed with the final numbers and called the mortgage companyHe stated he was able to negotiate the fees and he provided an updated payoff to the title companyThis left him with a negative balance of [redacted] so the title company gave him a credit to net him out to [redacted] We later learned that the net sheet provided to us by Mr [redacted] was incorrect and there is now a negative balance with the title company [redacted] (***@centurionlandtitle.com) with Centurion Title is preparing a statement with additional details regarding with her knowledge regarding this portion of the transactionI am submitting documentation for your review as follows: - Copy of the executed purchase agreement - Copy of the executed limited agency agreement - Copy of the executed listing contract - Copy of the authorization form for Stonegate Mortgage - Copy of fax confirmation confirming offer was sent to Stonegate Mortgage - Text message communications with Mr [redacted] - E-mail communications with detailed explanations and corresponding estimated net sheets - A final closing statement provided by Centurion Title and executed by all parties Initial Consumer Rebuttal / [redacted] (2000, 14, 2016/11/04) */ (The consumer indicated he/she ACCEPTED the response from the business.) represented Mr. [redacted] in the sale of the property located at [redacted] through Mike Thomas Associates.
I initially met with Mr. [redacted] on July 5, 2016. His grandparents, past clients I have sold multiple properties for, also attended the meeting. During this time we discussed that Mr. [redacted] was more than 6 months behind on his mortgage payment. After reviewing numbers with Mr. [redacted] and his grandparents I felt that we could list and sell the home without a significant loss to Mr. [redacted] preventing the property from entering foreclosure.
