On February 14, 2014 the truck I was using for plowing, broke down. I had the vehicle towed to[redacted] in Hadley, MA to have the problem identified and fixed. After spending a few days pinpointing the issue, they stated that it was a transmission issue that was too large of a job for them and they recommended Budget Auto Repair in Hadley, Ma. I spoke with the [redacted](?), of Budget who stated that the transmission needed to be rebuilt and he could complete the job at a cost of $1500-$2000. I had stressed to him the importance of getting the truck back as quickly as possible as it was needed for plowing. He stated that "I guarantee to have it done in three days, if not sooner". The three days passed [redacted] when I hadn't heard anything I called to check on the progress.I got his voicemail and left a message. Still no word the following day, so I made another phone call to budget, again, no answer, left another message. The next morning I went to Budget to try to personally speak with him. He was not there and the truck was still up on the lift pulled apart. The gentleman who was there said he didn't know what was going on and that I needed to speak with the owner because he was the one performing the work. I explained to him that I had been trying to get a hold of him but have not had any of my calls returned. The gentleman then called the owner directly and placed me on the phone with him. I expressed my concern over the vehicle and the amount of time it was taking to finish the job and as to why I had not received a phone call back. He then stated that he didn't receive any of my numerous messages and that the truck was taking longer due to whatever we had put in the transmission. He then told me all he had left was to put it back together and put it back in the truck and it should be done the following day.So another couple days passed. He then told me he has family issues and it will be done soon.Last time I saw the vehicle at his shop 3/13/14 it was running but would not go into gear.Product_Or_Service: Vehicle repairDesired SettlementAs of today March 18,2014 the truck is still at his shop and he is stating the transmission is done but there is another issue as to why the truck wont go into gear and it will now cost more money and take more time.So I said we would like to remove our truck pay half of the bill, have it fixed elsewhere and if the new problem is of no fault of his we will glady settle the debt.If it is his mistake then the cost is to be taken from half held. Also a discounted rate due to time waited.Business Response Budget auto received a call from [redacted] at Auto [redacted] asking me to tow Aspen reality truck in for a transmission failure. I towed the vehicle in and upon examination I found that the truck would not move and poured transmission fluid out as fast as could be put in.I left a message for [redacted] and received no response for 4 days. [redacted] arrived at the shop and asked for a progress report. I explained I had know authorization to repair the truck. He said there must have been a communication and authorized the repair. At this point he requested a timetable, After doing transmissions for 30+ years I said the following if the job goes perfectly it would be 1 day to remove the unit 1 day to rebuild it and 1 day to install it however I qualifed this with the following this does not count when it gets in the scheduled since we only have a 2 bay shop and did not have an appointment, further parts availability and any other unforeseen problem. During the course of the repair the first problem encountered was someone had filled the unit with sealer in an attempt to stop the leak as a result the unit required a huge amount of hand cleaning, I showed Mr. [redacted]what I was dealing with on the rebuilding bench.another set back was that the torque converter and a solenoid had to be special ordered. Throughout the process Mr. [redacted] became increasingly hostile and at one point told my worker that he is from Springfield and not to be F with I did not understand the reference. After the truck was done it was test driven and pressure tested all was fine. At this point a explanation of how the system works so that you can understand the issue.the engine provides energy to the transmission regulates the power to the transfer case which which weather the truck is in neutral 4wd high 4wd low or 2wd the range is determined by a switch on the dashboard which when depressed sends a signal to the transfer case computer which then activates a actuator moter on the transfer case to select the range. Please bear in mind this has been a plow truck for many years has not been taken care of and has in excess of XXXXXX miles on it. When Mr. [redacted] arrived with his boss (Sparky) to pick up the truck and we were putting the plow on the transfer case selector started blinking which indicates a problem and blew the fuse putting the transfer case in neutral. Sperkey requested I find the problem. I spent a day diagnosing the problem at no charge I determined the transfer case computer had failed. Sparky said he was taking to another mechanic at my great relief. I got the transfer case to stay in 4wd low and they took the vehical. The vehical just came back for warrentee work with a new transfer case computer and a new selector switch.conclusion 1. delays were unavoidable and explained in full2. there were no more snow events therefore no damages exist3.I would submit that Mr.[redacted] received a thebenefit of one day in free diagnostic labor.I submit that this complaint has no merit.Respectfully submitted[redacted]

Replacing engine incorrectly by mechanic caused engine to have massive internal damages. 1/10/XX XXXX Subaru was dropped off to Budget Equipment and Auto to repair engine oil leak. Mechanic exclaimed engine would need to be removed to make repair needed. I gave consent to make repairs needed to fix oil leak. Repairs resulting in a payment of $951.17 were concluded and paid for parts and repairs done. I have work order receipt for repairs done. ref #WO1260On 3/5/14 my Subaru stalled with major engine issues while driving to store. I had AAA tow it to local mechanic who concluded the Subaru had possible engine failure due to internal engine failure because of an massive leak in oil. 3/8/14 I had another mechanic pick it up to make further investigation into causes of engine failure. Second mechanic concluded engine cam was not replaced correctly causing a massive oil leak and engine failure. Desired SettlementI am seeking a complete refund in all work done to my 2003 Subaru Forester by Budget Equipment and Auto Repairs, as well as the cost of having to buy a new car. Refund of #WO1260 total: $951.17Refund of #WO1265 total: $502.98Replacement of $4800.00 in having to buy a car to replace 2003 Subaru Forester. Business Response [redacted] Complaint has no merit because she did not include the entire course of events. While it is true that she called me ([redacted])and said that her car was towed to collage street motors in Amherst and said her engine had seized and asked that we tow it to are shop. This is what has been conveniently omitted from her complaint, we in fact brought the vehicle to our shop. The oil was full and the engine ran perfectly as witnessed buy me personally and my mechanic there was a noise that sounded like a bad power steering pumpbut certainly no bad engine. I called Mrs. [redacted] to give her the good news,She said that her fatherwanted the car towed to his friend in NH. When the driver came to pick the car up I started it for him and told him to look for a power steering pump failure. As you can see that information would damage the validity of her claim. In retrospect when I first met Mrs.[redacted] she had said that the engine was replaced once and I cant help to wonder if the friend was te person who installed the used engine. In conclusion there are three witnesses to the fact that the engine ran fine and there was no oil leak when it left my shop therefore I will not offer any settlement. Instead we will be filing a civil complaint against Mr. [redacted] for attempted fraud to obtain money for damages that never happened. WE will call Mrs [redacted]Budget [redacted] Budget head machanic.and the driver from the Nh repair shop who picked up the car to be determined though dicovery.Respectfully submitted [redacted] Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)I do have merit in my complaint. I did give [redacted] the chance to look at the engine to get his opinion on what may have happened. When he called me to tell me that there was no engine problem and it was a bad steering pump I made the choice to get an third opinion from another licensed mechanic. This "friend" that [redacted] notes in his comment is a licensed mechanic my family uses out of NH who we paid to come tow the Subaru back to further investigate what may have caused the engine damage. I did have the engine replaced to the Subaru in 2011 and had not had major issues with the car until I took it to Budget Auto in January of 2014. Though [redacted] may wonder who installed the engine it has no relevance to this case. I took the my car to Budget Auto for engine repairs and one month later the engine failed, I have had 3 different mechanics including [redacted] look at it and his claim that it was a "bad power steering pump" was the only diagnosis that was different. I only wonder if his claim to having 3 witnesses to the fact that the engine ran "fine" were employed by him in the first place. Why would they say anything otherwise. I have invoices from other licensed mechanics, one of which I have paid to investigate the problem stating that the oil pump seal broke that caused a major oil leak causing the engine to seize. I have records of the work Budget Auto completed on the Subaru showing they installed the oil pump seal kit that broke. I am not looking for fraudulent claims I am simply looking for reimbursement for the monetary detriment this has caused me.

No invoice was delivered upon begining repairs, charged for parts that I purchased and delivered used, car was held with no communication for 5 months and mechanic refused to be honest about when it would be ready. Then called demanding over two thousand dollars for the repairs and pressuring me to give him the car(worth 8,000) and let him sell it at auction and give me any remainder profit, probably nothing. This man is dishonest and uncommunicative and is filing a complaint now against me after disappearing with my vehicle for 5 months.Desired SettlementVehicle returned and charges mallprocessed.Business Response all work was authorized we have admission of responsibility's leverage this issue is currently in collections and this is an attempt to use the Revdex.com to gain an advantage any other info required please contect [redacted] Esq XXX-XXX-XXXX
