Like all building schedules, these timelines were made in good faith dependent on weather, availability of sub-contractors, availability of materials, and availability of utilities, etc.  This was made clear at the time of signing the build contract which includes Section 6 explicitly indicating that we would make a best effort to complete within 90 days of set.  Despite, inclement weather and lots of rain, sub-contractor reschedules, and utility installation dates, we expected to complete the build by the end of November which would have placed the completion date two weeks beyond the 90 days.  Given our experience with building, this would have been extremely reasonable and acceptable.

Buffalo Modular Homes was hired to build a 2400 square foot home for us. They changed the timeline for the project several times substantially and it was seldom due to a weather event    ANSWER:  This is Section Six from the Build Contract signed with the [redacted]: ...

  Commencement and Completion of ConstructionOwner and Buffalo Modular Homes shall each expend their best efforts to effect the commencement of the on-site construction of Home no later than sixty (60) days after obtaining the Building Permit and shall complete construction and have Home ready for occupancy no later than ninety (90) after the house has been delivered to the Property.  Owner accepts that activities and event outside the control of Buffalo Modular Homes including, but not limited to, the provision of utilities and inclement weather, may cause the completion date to be extended and in such cases Owner shall not hold Buffalo Modular Homes liable for any such delays. Here are the actual activity dates:- building permit received on Aug 7- on-site construction to start within 60 days or by Oct 6- foundation set on Aug 10- house delivered on Aug 14- house to be finished with CofO within 90 days or by Nov 12(Unless slipped due to utility issues)-we expected to be finished by the end of November which seemed reasonable given the very wet summer we had as well as changes in sub-contractor schedules Issues that are related to the poor workmanship of my home include not placing metal support beams in the basement according to state code    ANSWER: these posts had only been temporarily placed - we had not completed or charged for this work nor had it been inspected when the contract was cancelled – our normal procedure is insure these posts are placed in the exact locations according to the stamped prints, secured both the top and bottom of the posts, and each post top insulated and framed before having them inspected and approvedroof caps installed incorrectly    ANSWER:  these were installed correctly by our reputable sub-contractorplumbing job completely out of code    ANSWER:  the plumbing work had not been completed, inspected or charged to the customer when the contract was cancelled – any defect discovered during inspection would have been remedied by us without questionstairs installed out of code    ANSWER:  The stairs and landing had been installed temporarily to provide access to the basement but they had not been completed, inspected, or charged to the customer – we still needed to finish this work including raising the landing and adjusting the stairs so they were in line with the 1sr/2nd floor stairwell, work which was already scheduled to be completed when the customer cancelled the contract, many projects were incomplete   ANSWER:  We agree that a number of work activities were incomplete – none of the incomplete work was charged to the customer and were part of our completion punch list as required by our contract and in order to obtain a Certificate of Occupancy.  It’s egregious for the customer to cancel the contract before we had finished our work, before we claimed to have finished our work, before we had any of the final inspections, and before we had charged the customer - and then to accuse us of leaving many projects incompleteseptic was not completed according to engineer's design    ANSWER: this work had not been completed and inspected when the customer cancelled the contract.  We had scheduled an inspection and would have completed any work required by the inspector to insure approvalThis business placed a lien on us because we would not agree to provide final draw from the bank as work was incomplete, done by us the homeowners or required complete removal or partial replacement as work was out of code    ANSWER:  We did not request a final draw payment but we did request a payment for work completed and inspected which would have left a substantial amount of money owing that we would have requested once all our work was completed, inspected, and a Certificate of Occupancy was issuedTown of Newstead inspector looked through home and red flagged many projects that were not done to code. Many pictures of work were taken. Estimates for new subcontractors have been provided. Some work has already been completed to get our temporary CofO.    ANSWER:  The customer cancelled the contract before we had finished all our work, before we had final inspections and before we requested final payment.  We expected to have completed all the work and obtained the Certificate of Occupancy by the end of November.  With approximately 2 weeks of work still to be completed, the customer breached the terms of our contract by cancelling the contract and going directly to our sub-contractors to request they complete the work directly for them.  In light of this, we had no choice but to place a lien on the property to insure the customer would pay for all completed workTell us why here...
