Review: Breach of Contract regarding original bid scope of work and the work that was actually completed. The work was completed in an unprofessional manner and was not performed according to project specifications, timelines or city code/ordinances. Owner did not file a notice of completion due to the fact that the job was never completed. The project called for repair/replace an extensive amount of dry rot in a couple of different areas of the home including the entire original deck/handrails/headers and pads, siding and some water damage in loft area interior and exterior. A substantial amount of dry rot is left in those areas. Also the contractor reduced the deck size and replaced the deck boards with some unacceptable materials that not only look displeasing but are a danger to walk on. The front deck rebuild does not follow original plan and steps up to a point where there isn't enough span from the deck to the roof for a person to enter the home without risk of bumping their head & thus far it has already happened countless times by random people.

Initial Business Response /* (1000, 12, 2014/01/13) */

To whom it may concern:

This is in response to case # XXXXXXXX.

All work was completed to the scope of bids and estimates discussed and approved by the customer. The customer was trying to do the minimal amount of work needed to secure financing for the property. Estimates were provided for the cost of the projects using both new material, and reclaimed material. The customer, in the interest of saving money at the time, asked us to proceed forward using reclaimed material from the previously existing deck, and only provide new materials where absolutely necessary. The deck was rebuilt to the specifications of the customer. In item #4 of the invoice and estimate, it states that we will provide and install "up to four (4) sheets" of siding. The estimate and work order did not include material for a larger area as the customer was on a budget and wanted the minimal amount needed to secure financing.

We have already returned to this house once, and replaced several deck boards, to satisfy this customer, despite the estimate stating that we were to use reclaimed material. This customer requested that everything be done "bare-bones" to secure financing, and further repairs would be made in the future to further correct damage. This customer also requested a painting bid from us after services were completed. This was in July. There was no mention of these problems at this time. We chose not to bid on this project because we felt that the other bid the customer had received was at a lower cost than we could provide.

This customer wanted the minimal amount of work necessary to receive financing for the property. The customer accepted the estimate with the minimal amount of new material, and the reclaiming of existing materials. The customer would not accept pictures and wanted to see the finished work before paying the invoice. After examining the work, the customer paid the invoice, acknowledging completion of the work. Five months later, the customer was complaining about the dry-rot in the siding. This area was repaired per the scope of our bid. It is not our fault that the customer wanted the project done for the cheapest price possible, approved our estimate, paid the bill acknowledging completion, and then is unhappy that we did not go beyond the scope of our estimate. Nowhere in the estimate does it say that all the dry-rot would be repaired or replaced. It specifically says "up to four (4) sheets".

We also cannot be held responsible for the customer being unhappy with the new deck dimensions, as it was built to the size that the customer specified, to allow for the constraints of their money at the time.

Documentation will be provided if necessary.

Final Consumer Response /* (3000, 15, 2014/01/19) */

(The consumer indicated he/she DID NOT accept the response from the business.)

The written bid was very vague as you can see. We had certain expectation and a good person to person meeting before the job started. All parties seemed to be on the same page at that time. There were verbal promises made by the contractor to the homeowner. The home was not repaired enough to be financed. The contractor reinstalled rotted wood on the deck which was not part of the agreement. It is displeasing not only to the eye but it is a safety concern. We did agree that the good wood should be reused and only the rotted wood replaced. We wanted to saw up the rotted wood and burn it in the winter so we decided to do that part of the clean up. they were contracted to haul away the garbage & materials that couldn't be burned. They didn't remove anything or clean up the work site. They left all of their personal trash for us to dispose of for them. The job was supposed to take a week & took months. They came to work and left whenever they wanted to. There wasn't any consistency or communication whatsoever. We were constantly calling and emailing them. The contractor didn't pay any attention to building codes. The work that was "finally" completed to their standards was done long after the deadline that was promised is going to have to be removed and will need to be redone. A 6ft person cannot walk on the front deck without bumping their head on the roof awnings. Originally they left the job without reinstalling any front entrance whatsoever! I guess we are supposed to be happy that they built one at all? We have spent so much time going back and forth with this contractor! Until they just stopped responding all together. It is clear to us that either they do not have the ability to make it right or they just do not care to. We just wanted to bring this to the attention of the Revdex.com so that other consumers using your website are educated that just because they are recommended here doesn't mean that they are a good company. Our goal was to secure financing within 6 mths of the cash purchase date on this home. It was the first step in the process-and a very important step. The paint work wasn't able to be performed as it was brought to our attention by the Paint Contractor that the he would be painting over a bunch of dry rot. In Addition to that we hired Bug E Boys to install all new Gutters. One of the gutters that they installed is always on the ground when we return to the home after a few days/weeks in Portland. We haven't had the time to have it checked out but we assume that it probably isn't installed correctly. We would like to warn others against using this outfit. We have talked to many neighbors and people in the vicinity. Many of these people have shared similar experiences with this same company. I have been self employed for over 20 yrs. I understand how tough it can be which is why we bent over backwards trying to give them the benefit of the doubt. We didn't want to give up and have to deal with Court/and starting over with a new contractor. This was our first mistake. We have worked successfully worked with contractors in the Portland area remodeled countless properties throughout the years. This includes Commercial and Residential Real Estate in the Portland area. It is our first experience in the Coos Bay area & it is tough finding new contractors that have the work ethic that we are used to in Portland.

Final Business Response /* (4000, 20, 2014/02/14) */

We have read the consumer rebuttal from the customer. Our position does not change on anything except the gutter issue that they are having. This is the first time, in all of the correspondence with both the customer and the Revdex.com, that we have heard anything about there being an issue with the gutter. Our company will have no issue completing repairs to the gutter system that we installed. This issue would have been resolved prior to now if we had been informed of the problem prior to now.

Regarding the other issues that are mentioned in the complaint, our company stands behind the fact that we completed the work to the specifications of the estimate provided to the customer. We had to tailor this bid to the customers' request due to their desire to complete the project to secure financing at the lowest price possible. The customer wanted everything done to the minimum amount of repairs needed in hopes of securing financing, with the intention of completing further repairs at a later date. This is a case where the customer was told what needed to be done to properly correct the problems, but the customer could not afford to go to those levels. The customer then decided to do the minimal amount of work necessary for their purposes. Now they want a refund or more work done for free because the amount of work that they authorized and accepted as complete did not accomplish their goal of financing. Our company cannot be held responsible because a customer wants to cut corners, and then is unhappy with the result of cutting those corners.

In response to the disposal of materials, our crew was told by the customer that we did not need to worry about clean-up and disposal of material on the site because they had use for the material that was no longer being used. We did not realize that this meant that we were supposed to pick through the debris on the site and leave only what we guessed the customer might use. If that was the customers' intention for us, then it is something that should have been discussed with us when we were told not to dispose of the debris.

Our work was completed to the scope of our estimate, and was acknowledged as complete by the customer before final payment was made. It is clear to us that the customer is trying any way they can to complete the original repairs that were discussed (and turned down by the customer) without having to pay for them. Unfortunately, as contractors, we run into this issue from time to time. Our company had an A++ rating with the Revdex.com prior to this complaint. We would appreciate receiving that rating again. We do not like our rating being diminished because a customer pays for as little as possible, but expects perfection in return.

Thank you for your time.

I wanted to write a brief review on this site about our experience working with this contractor simply because we pulled their information off of this site when we hired them. Our primary objective in this project was to utilize funds toward fixing the lender required repairs so that we could get secure financing on the home to do the majority of the remodel thereafter. Bug E Boys was hired to do this phase of the job. Problems started from the first day & progressively got worse as the job went on. We did our best to communicate with the Company but couldn't ever get in touch with anyone. The work that was finally completed by this company ended up months beyond the promised finish date and was not done to code. This only made our efforts to obtain financing next to impossible without hiring a knowledgable contractor to come in and correct their work in addition to finish the lender required repairs we originally were seeking to complete.
