During beginning of 2014, several neighbors of the *** pleaded with me to have my company perform necessary repairs to the interior and exterior of the *** homeThey stated that nobody else would do this work due to the 'unusual and unique' working conditions

At this time, we emptied, and vacated our home, for days, to allow for Kashwitna Construction to work uninhibitedDuring August thru Sept 2014, Phase 2, comprised of two people and MrS***January thru June 2015, Phase 3, a two man crew was used 90% of the time without S*** presenceHowever, at random times throughout Kashwitna Construction's employment, additional day workers, one being female, were temporarily added to his crewWe are unaware of how many individuals are employed through Kashwitna ConstructionNonetheless, throughout our remodel there were regular workers in addition to MrS***
Next, MrS*** stated that the challenge of our home being built improperly, constituted unforeseen situations, which could add to the overall project estimate. It was unmistakably known that our home was of a unique designAdditionally, MrS*** did do a complete walk-through of the homeSpecifically, he stated that he liked challenges and accepted the jobHowever, while we were aware that unforeseen difficulties could arise, Kashwitna Construction also knew of our stringent budget allotment, which consisted of our Federal Disaster LoanWe clearly stated that this would be our means for paymentThus, intelligent thought followed by precise action was needed to minimize as many errors as possible as our budget was fixedThroughout each of the three phases, we were on-call and eager to accommodate Kashwitna Construction's needsOn a daily basis we prepared, cleared, and relocated personal items, and furniture to ensure that they had an unrestricted work area
At one point during S*** response, he states that in order to "provide [us] with an actual project quote" ...he would have to "tear [our] home down and start over with new construction." This is simply a preposterous declarationHe knew our home was unique from the startWhen we were first seeking to hire him we made it know that our home would be a remodel, not a rebuild
In point three, the issue of cleis addressedDuring Phase 2, the roof, we did agree to piafter the crew to receive a reduction on the invoiceHowever, the invoice never reflected a deductionAs the remodel moved to the inside of the home, clegained significanceWe stated that we wanted a small-scale cleto occur after each day of constructionIt was something that would only take 5-minutes most daysAdditionally, we noticed that without this request, simple common courtesy was likely to be neglectedFloors were more prone to be scratched for instance if they were not required to tidy-upIn one instance, our newly purchased and installed bathtub was scratched on the interior as they tossed scrap materials into it without first placing a linerAfter this we respectful asked to alter the agreement to include a brief straightening at the end of the dayThis change occurred after we requested it several times.
A fourth item of discussion, MrS*** declared that our statement was concerning his lack of professionalism in retrieving cabinets from ***He stated that he was “the person who picked up these cabinets (which were yet another add on to [the] original project list) and delivered them to [our] home.” We never stated that he did not eventually pick them upHowever, his company did fall short on this matter* During Phase 3, the home interior, we purchased kitchen cabinets in Wasilla at ***MrS*** was aware of when they were purchased and stated he would collect them during one of his frequent tripsApproximately one month later, *** called us informing us that the cabinets had not been picked upIf they were not picked up, *** would reclaim them as store propertyMrS*** stated that he did “not see how this could cost*** *** *** *** any effort or expense.” The added expense would have occurred if the cabinets had not been retrievedThey would have been reclaimed by *** and we would not have received reimbursementWe avoided this by bringing the matter to his attentionAfter a couple nudging phone calls, he did pick them upHowever, he did forget about the pantry cabinetThis caused us to find another means of obtaining it before it was reclaimed
As to point five, no appropriate name referrals were offeredUpon our request, S*** did suggest individuals who he knew would not work for us for various reasonsIt was the peak of construction season when Kashwitna Construction unexpectedly withdrew from the jobAs our residence is located in a small community, there are only a handful of licensed, bonded, and insured contractors in our areaThe individuals he named were either already employed, had declined a previous job offer, or were not certified with the above mentioned criteriaOur Federal Disaster Loan stipulates that any work completed must be done by a licensed, bonded, and insured contractorMrS*** was aware of these facts
In regards to payment of the tent, he has been paidThis is explained in the next point as each is interrelated
MrS*** notes in number six that the bathroom was one area of our home that needed to be remodeledHe also states that the work completed will have to be redone due to lack of communicationWhile these statements hold some truth, the context and narrative that Kashwitna Construction relates is incorrectA new mixer, faucet, handle, shower fixtures, and a metal splashboard were a part of the original remodel plans for the bathroomWe made it clear that a new mixer was essential as the old one leakedThe leak was causing mold to erode the wallMrS***’s crew set to working independently under his supervisionWhen they finished for the day and left, we went to observe their workThe metal splashboard had been applied and glued to the wallThe faucet set had not yet been installedWe realized at this time that the mixer was still in the box and had not been installed before the metal splashboard was set in placeAdditionally, the metal had been cut incorrectly and would have to be removed and replaced(Since this time, we discovered a second piece of metal splashboard had been cut incorrectly and hidden within scrap materials.) Immediately, we call S*** to inquire about this problemUpon answering, he stated that he was overwhelmed by his errorHe did not have a solution as installing the new mixer would now include ripping out the metal splashboard along with the attached wallA short while later he visited our home to compare the faucet-mixer set to the ill constructed projectHe needed the weekend to think it over and said that he would take the faucet set and see if he could exchange it for something that would be compatible with the current situationMeanwhile, we had no facility in which to bathe*** *** suggested a temporary solution to allow for washing; he was able to develop a method which would allow the handle stems to be turnedThis was only meant to be an interim solution that would enable time for a permanent one to be devisedA few days later, MrS*** quit unexpectedlyThis deficiency remains a current problem with the bathroom shower, mixer, and fixturesThus, they will need to be readdressed and redone.
The confusion with payment of the tent is simply resolved when one subtracts the cost of the faucet set that MrS*** took while pondering a solutionThe value of this hardware totaled $While it was never returned to us, it was also never removed from the invoiceIts value pays for the tent as he could return the faucet set for reimbursement for its full value
In point seven, MrS*** examines the number of crew members who were involved in the construction processWe have addressed these details when responding to his first point.
A short history is needed to address point eightOur rural residence had substantial flood and wind damage, which, as stated earlier, lead us to receive eligibility for a Federal Low Interest Disaster LoanThis loan stated specific requirementsAfter completing extensive research into local area contractors, Kashwitna Construction was hiredThe work achieved during Phase and Phase was paid and met our satisfactionMrS*** is correct that we shared our enthusiasm to our neighborsHowever, during Phase 2, we began to see a decline in workmanship and professionalismWe were not completely satisfied; however, we now had an investment of both time and money. As respectfully as possible, we tried to address our concerns, yet they were not always well heardThe benefit of the doubt was given when simple errors were made, nonetheless, a decline in both nonverbal and verbal messages along with workmanship began to augment
Within point nine, MrS*** refers to several of the project phases and their assigned costAs declared in the beginning of our mutual agreement, estimates were furnished by his companyThese were to ensure that construction would remain within the strictly set guidelines of our budgetWhile we do appreciate any previous discounts or price reductions offered by his company, these prices ranges were established well before they began any remodel workThese amounts are not what we wish to contendAdditionally, the numbers mentioned were a part of the earlier phased projects and have been fully paid.
In response to MrS***, we are unaware of the regular use of any “recycled garbage materials.” All the materials used were newly purchasedThe only time we encouraged use of older, previously purchased materials was during the work on the roof during Phase Also, we had unopened new paint that we had never usedWe offered these gallons of paint to help offset cost and increase efficiencyMrT*** has an immense history with various construction projectsHis expertise and assistance was continually made available so as to eliminate any project exasperation
Lastly, it dispirits us to know that MrS*** felt as though his employers provided a hostile settingAn auspicious versus truculent environment was what we wanted to provideFurthermore, MrsT*** endeavored to create an uninhibited environmentShe did not seek to add to the project list as our budget would simply not sustain any added items.
While we set out to find a professional contractor, we also were eager to support a neighbor and community member through employmentThe above stated course of events sadly relates how our business relationship erodedKashwitna Construction’s professionalism is what lead us to hire them, however the affairs that occurred before their untimely exit have disparaged this imageMrS*** states that “the *** and I have irreconcilable differences and outlooks with regards to their home and also with the way we conduct our lives.” His statement of “irreconcilable differences” is disheartening as we never intended to form a irreconcilable relationship with him or his companyWe are simply trying to move forward and complete our unfinished homeThe invoice as well as the matter of the tent have been explained repeatedly throughout this letter, as well as, through prior correspondenceKashwitna Construction has been paid in fullAdditionally, the faucet set that he retains, appropriately pays for the 12’x14’ pop up tent
This being said and perspicuously explained, we have no intention of extraneously dispersing anymore finances towards Kashwitna Construction.
Sincerely,
*** *** *** ***
