Our family owned and operated company has been in busines for over yearsWe pride ourselves in being transparent and fair with all of our tenants and clientsPrior to moving in, prospective tenants are provided copies of the lease paperwork so they may review before signingTo avoid
miscommunication and confusion, we have detailed paper work that clearly states our expectations for tenants upon move out.Our company performs a move in walk thru with all new tenants, in order to document any previous damage to the rental unit At this time, tenants walk thru the property and make notes and sign our "Move In/Out Checklist"*** *** performed his mowalk thru and signed the mochecklist on May 22nd 2015; the refrigerator drawer mentioned by Mr*** was not noted as being damaged by agent or tenant We understand that some things can be overlooked, which is why our General Manager approved a refund for this itemThis checklist also discloses the use of a professional carpet cleaning company when tenants move out We have used the same carpet cleaning company for a number of years now, *** Carpet Cleaning (now owned and operated by *** *** *).Our company stands by the accuracy of disputed deposit, but are willing as a measure of good faith to reimburse the tenant for the amount disputed.Respectfully,Emily Burkentine, Property ManagerCc: Paul Burkentine

deliver sic- (sq.ft.) The square footage was an approximate number in conjunction with our Contract Addendum A - Home Features and Contract Addendum F-House PlanThere is no mention, in any document signed by *** ***, that the above ground square footage is 1,sqft(In reality, finished livable space equals approximately 1,740) This number includes the bump out to the master bedroom - the master bedroom measures - 11" wide x bump out F sqftThis meets *** ***'s definition of a bump out - "going away from the house and adding square feet." This addition is visible in the photos attached.In early March, *** *** did her electrical walk throughHer home was just in the framing stage, no drywallThe day after this walk through, she expressed that she was unhappy with the overall size of the homemeetings occurred after thisOne, on March 4th - with her realtor present, to show her a finished home approximately the size of hers - ** *** *** Note: Because of her displeasure, all construction was halted on this project in Mid- March until we could meet to discuss.The second meeting occurred on March 16th, *** ***, her Realtor - *** ***, and family members met with Michael B*** & I at our model homeAll of *** ***'s concerns were addressed at this timeIncluding the text message dated 3/where stated the measurements of the homeAt the conclusion of the meeting, *** *** again agreed to move forward with construction.** It is important to note that the appraiser was given the FINAL building plan, the one used to construct the home He would not have seen the base plan or square footage of the home and therefore has no reference point to state there was no bump out done to the home. *** *** visited the home in late MayShe called me on Sunday May She had a few concerns or items that needed to be addressedI answered all of her questions, except the master bath tile shelf.I needed to check with the project manager - Michael B***On Monday May 23, she sent these concerns to her realtor who forwarded them to us via emailThe only unresolved issue on the list was the Master Bathroom Tub- We did deliver an oversized, soaking tub with tile ledge and tile surroundThe shelf *** *** is referencing in our Model home, is actually a plumbing access areaThis access area was not necessary when constructing her home, so it was omittedSuggestions have been made for resolution of this issue, but *** *** has not given us an opportunity to discuss these options or to find a suitable resolution.On June 6, *** *** left a Voice Mail expressing her desire to Void her contract and requested a refund of her deposit & change orderI returned the call, left a voice mail for her to call me backWhen she did call back, Michael B*** answered the phone and she hung up.Our contract language is clear on defaultWe have also stated, in person to *** ***, to her realtor and in writing that no refund of deposit money will be given as early as March 4, 2016.After reviewing over points of contact with *** *** - in person, text, voice mail, phone, and emailThere is no hint of intimidation in any communication from B*** & Sons to *** *** *** has $24,worth of unpaid, non-standard upgrades in her home, not including daily interest charges that are accruing on her homeWe have invested a lot of time and resources into delivering this homeWe hope for a speedy resolution this issue as well.Please let me know if you need any additional information.Best Regards,Stacy D***Sales Manager Burkentine & Sons

These are all complete liesStacy did call and I called her back, I never intended on talking to Mike directlyI did hang up because I was not calling him in the first placeThose pictures of the so called bump out are complete crap, that is nothing more than a window overhang that the appraiser told me about and clearly not a 2-foot bump outThe bump out was for the accommodation of the fancy garden soaking tub that the contract stated "to look like the model" on which they did not deliverThat tile ledge had nothing to do with plumbing, and they never ever mentioned that much and they know itThey delivered something that I didn't want or ask forI have had several conversations with the appraiser and he assured me that they did not do a bump outStacy contacted my lender and obtained a copy of my appraisal that I paid for and at no time, ever gave permission for them to getThey cannot charge me any interest because the VA won't allow them to because they are well aware of what is going onI have already spoken to the VA and they told me that I didn't have to close on something less than what I agreed to and I did not agree to that tub that they put inI have obtained a lawyer and he is handling this whole thing, he said that they are in breach of the contractI have also gotten other government entities involvedThey are trying to take advantage of a Vet and that is not going to happenMy lender had also told me not to close with outstanding issues or concerns because it will be next to impossible to get then to fix anything after the factI signed a release and letting the lawyer do his job
