Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear below [To assist us in bringing this matter to a close, we would like to know your view on the matter.]The Contractor failed to make any offer of a resolution and remains in denialTherefore, I would like to ask if the Revdex.com can help us arbitrate our issues.I did hire the Contractor for this job with the belief that the new storefront would be installed in accordance to the manufacturers specifications, recommendations and guidelinesBut the job does not meet these termsThe storefront is not level, not square, and not trueThe concrete threshold is cracked, broken and unlevelBy rights, the Contractor should have acknowledged this and if it wasn't included in his original Proposal, then he should have made a Supplement Proposal for me to turn into my Insurance Company as I have plenty of Insurance Coverage for this damaged incident.The Contractor admits they drilled holes in the wrong place on the new Storefront which makes it appear less professional and less appealing to the eye, yet he refuses to replace the piece of metal, or credit me back any moniesSame goes for the Window sill where they erred by forgetting to place it under the Window, and as an afterthought, (A cheap attempt to remedy), they just placed the Sill in front of the Window, with a line of Caulk separating the sill and the window, which will eventually fail and allow rain and snow in between and cause future damage possiblyYet he refused to credit me or the work to make it right.This Contractor brought on these issues himself by 1) failing to investigate and ascertain all the damage initially, 2) Delaying the demolition, of which he has not responded to in this complaint, 3) then after seeing the additional damage after the demolition was done, he failed to address the damage or my concerns by failing to acknowledge and failure to draft a supplemental SCOPE of work, 4) He must have erred in his drawings and/or calculations by not leaving enough space for a window sill to go under the window as mine originally was under the window5) He erred, product substitution by leading me to believe that I paid for, and would receive an new Aluminum framed awning, yet I received a steel frame which looks like it may even be my original awning frame, just cleaned up and extra supports welded onto it, This may be important because an upper support block for the awning broke and the contractor didn't replace it, so a heavier steel awning would put more stress load on that broken block than an aluminum framed awning.Simply put, I had plenty of Insurance coverage to cover all repairs, but this contractor failed to bid out the whole jobAnd what he did bid out, does not meet my expectationsI now have a storefront that, more probable than not, will stick shut again sometime during this next winterThe new Storefront is missing fasteners, has a loose aluminum threshold, has extra holes in, and has pieces that are easily visibly not levelHe said that he would set up a meeting with the Glass company and me, but he never didNow he has made it clear that he thinks he is still owed, and still deserves the full price.Not only that, But I originally had a certain brand of Storefront, and he ordered me a different brand than what I hadI thought it was because his preferred Glass Company didn't sell my brand of StorefrontBut afterwards and after learning whom his Glass Company was, I looked and their website has the logo of the brand that my Storefront wasThere is no reason I could not have gotten the same brand Storefront as what I had, prior to the vehicle driving into my building.He now claims that I'm supposed to put a sign up on my door that warns people that this door may stick shut and not be an EXIT or an ENTRANCEI would ask him, should I put it next to the luminous EXIT sign, or over top of the EXIT sign? Unbelievable the denial this man hasIt's time he takes responsibility for his actions and in-actions.Additionally, a window broke out and was not boarded up by the Contractor which cost me a lot of money in utility bills and securityI have more issues with this contractor too, but I think the public understands what is going on when reading this Complaint and responses.Final Thoughts, seeing as the Contractor refuses to acknowledge the shoddy job, refuses to credit me any monies back, refuses to the job, refuses to correct his mistakes, refuses to replace and repair the remaining damage, and refuses to provide me with a new aluminum framed awning, and instead just insist's and "demands" full payment, then I would like to ask the Revdex.com to arbitrate this Claim for us, and if the Contractor refuses this Arbitration suggestion, then I feel I have no choice but to reject his work performed, reject his goods and services, and he can have back his goods and services from my premises, at his own expense, of which he had provided me and also pay me for the additional damage and expenses that he causedOtherwise, let's call it even Regards, [redacted] ***

states that they have adjusted my storefront, and as a result of those
adjustments, and because he alleges that he has numerous times verified that
the door has not been pinched shut since, and therefore has made the
representation that the Storefront now meets the manufacturers specifications,
tolerances, recommendations and guidelines, and that he has implied that I will
not have any more issues with my storefront, and that he has given me a
guarantee and warranty on this Storefront, and because he states that the
awning frame is in fact brand new and not my original frame, and that I will
not have issues with the window sill installation or the caulking, I will
currently agree to accept their statements, representations as being truthful
an accurate, and I will also accept their price reduction for the holes they
erroneously drilled into my door frame headerBut I reserve the right to sue,
litigate, arbitrate or reopen this COMPLAINT or to go after the contractors
involved in the future by any other means I choose, if I have any issues with
my storefront in the future, or if I find or believe that that any of their
statements and representations of which I have relied upon are false,
misrepresentations, or inaccurateI also reserve my right to sue, litigate,
arbitrate or reopen this COMPLAINT if Burkhart refuses to provide me with a
further price reduction for my two latches and two electric strikes which they
threw away, and for my time and price I charged Burkhart for having to manually
lock and unlock the new storefront because they had ordered the incorrect
electronic strikes, and for my time I spent trying to get multiple birds out of
my premises on numerous occasions due to the openings that was not boarded up
properly by Burkhart
With that being said, I am responding to Burkhart’s statements he
has made during his responses to this COMPLAINT for the public to read can

Regarding Burkhart’s “Paragraph 2:” I consider to be a
Misrepresentation of the facts because they installed the Storefront in
November of yet he claims that I did not make him aware of concrete issues
until “after our construction was complete.” PLEASE SEE BELOW THE FOLLOWING

quotation? The issue with these projects is that it is very easy to
expend money going to pick up things that may not be perceived when the project
is initially looked at so the costs for the general conditions is heavier than
normal

violation of which the City of Waukesha could give me problems about, and if there was an emergency, and people could not get out that door when it is stuck, that could have an adverse affect upon peoples life and health by potentially causing or attributing factor causing injury or death to people on my premises in the event of an emergency or disaster situation.The vehicle caused damage to the floor beneath the storefront areas. The Storefront is now sagging in the middle causing the storefront to be unlevel, and further out of manufacturers clearances and specifications.Additionally, the first attempt to install the storefront was shoddy and incorrect as you had verified as the framing was not installed "True", as is required by the Manufacturer, (Specifically, the top of the door would close, but the bottom would remain open maybe aproximately 3/8".The Opening for the Storefront, especially the concrete floor/threshold, is not level and true as is required by the Manufacturer of the storefront.I believe I should have Insurance Coverage to dig out the broken floor/threshold etc, and have the whole area under the storefront replaced with new to create a Level and true, and unbroken/undamaged surface to support the new Storefront system. Even if I didn't have coverage, that work should have been performed to address the damage, and to meet the Manufactureres specifications.Additionally, this brand new storefront has additional holes drilled into it which I consider to be damage. The holes are caused by the contractors whom made mistakes during the install. I should not have to accept these additional visible holes, nor the holes drilled threw the therrmally broken areas in an attempt to correct the shoddy workmanship. Especially, when I was paying extra for that thermally broken barrier material, which has now been compromised by having to drill through it to anchor the storefront.Also, you errored in your design, and ommitted the fact, in part, that a window sill was supposed to go underneath the window, instead of in front of the window. Now the window cannot be as easily replaced as there is now a barrier on  both sides of the window framing.Additionally, you led me to believe that you would be providing me with an aluminum framing awning, but I received a steel frame instead.Also, the block which supports the awning is broken, and it was not replaced.Also, you threw away my old electric door strikes and parts when I had originally informed you that I want to keep the old parts, and you agreed, yet you took my old parts and threw them away, or maybe even turned them in for scrap money.You have already indicated to me that you feel you are done working at my location. Therefore, I now need to ask you and [redacted] for the last definitive time, if you are willing to address any of these issues?If not, then I need a definite answer from you both, so that I can then consider, at the very least, to have other contractors come in, remove the storefront, repair the floor/wall below to eliminate, or decrease the risk of the potential threat of death or injury caused by that door sticking shut in the winter.Although, before I hire anyone else to finish this storefront project, I am making a good faith attempt to allow you the chance and opportunity to address these issues.Please forward this to Mr. [redacted] whom owns your company and then please respond back to me in a timely manner, hopefully by this weekend.Then we need to discuss any credits that you will give back to me for the other damages and issues, that I may end up having to repair/replace yet.Hope to hear from you by evening, May 8, 2015.Sincerely, [redacted], North Street Station, 511 E. North St. Waukesha, WI, 53188 [redacted]We are responding to your email letter dated May 6, 2015. We will be responding paragraph by paragraph to the points you have raised. We have also attached as Attachment A your signed acceptance of our quotation to you dated June 3, 2014 for $14,994.00 plus the sum of $802.00 for thermally separated metal framing where applicable totaling $15,796.00, which is the amount invoiced to you on December 31, 2014.Paragraph 1: After the storefront system was installed, one of the two doors needed to be adjusted since it was difficult to open. The contractor, who installed the storefront, promptly came to the site and adjusted the door by utilizing the adjustment capabilities built into the hinges of the doorway. Adjustment of these types of doors is not unusual which is why an adjustable hinge is incorporated into the design. Since the initial adjustment, we had several cold temperature happenings where the temperatures dipped to the -16 to -20 degree F range and, to my knowledge, there was no problem with the operation of the door. In fact, in each case where the temperature dipped, I personally went to the North Street Station before work to make sure the door was operational and, indeed, there were no problems with the door operation. To address the life safety issue of the door, there are at least 6 doors which provide access into and out of the building. If, for some reason, this one door did not function properly, there is a door immediately adjacent to that door which has not had any operation concern which can be used and if there was a problem with the door functioning, would you not be responsible to provide adequate signage regarding the non-functioning of the door?Paragraph 2: Our quotation (Attachment A) did not include any concrete work in our scope of work. At the time of review after the accident, there was no damage to the concrete floor noted nor pointed out by you, the owner. Additionally, our quotation did not include any leveling or plumbing the existing structure. The new work was figured to be installed on existing surfaces and to be replaced as it was originally. It was made aware to me by you that you had sought a contractor to replace the foundation below the original storefront prior to the accident, but yet that information was not provided to me until the new storefront was installed. Paragraph 3: The new storefront system was installed in the exact location as the original storefront since the repair of the existing floor and ceiling system to accommodate a new relocated storefront was not included in our scope of work, which is typical since patching material is not typically available. As it turns out, there is no owners stock of the flooring since there is ongoing legal action for that work done at the site. Additionally, with regard to the existing floor and foundation system, the new storefront system was placed in the exact location on the floor since the exact size and location of the existing foundation below the concrete slab on grade was and is unknown. Unless the storefront system was placed in the exact location without knowing the foundation size, there could have been a problem with installing the storefront off the foundation thereby subjecting the storefront to a greater freeze/thaw problems.Paragraph 4: The correcting of the plumb and level condition of the existing conditions were not included in our scope of work.Paragraph 5: The work mentioned was not included in our scope of work.Paragraph 6: The installer did miss-drill the holes for one of the door closers which they installed screws into to seal the holes. These holes do not detract from the structural integrity of the aluminum storefront framing. We are not aware of any holes which were drilled into the thermally broken barrier material, which is located in the side lite to the west of the storefront system. The storefront system is not thermally broken since the door frames are vertical and cannot be made of the thermally broken framing system.Paragraph 7: Regarding the replacement of the glazing on the sidelite window, the interior and exterior sills are installed below the removable stops which actually hold the glass in place. The entire frame does not need to be removed in order to re-glazethe window.Paragraph 8: We have admitted that we were in error when our quotation indicated an aluminum frame for the exterior canopy. We additionally erred when describing the removal of the existing canopy as aluminum. It is a simple error to view galvanized steel as aluminum. The quotation was based on galvanized steel, which was provided and, in fact, is stronger and structurally beneficial over aluminum.Paragraph 9: Before the damaged storefront was removed, you asked us about salvaging the existing hardware. Our reply was that you can have all the hardware you want to take off before we do the removal since all the hardware is new. You chose not to remove any hardware and when we came to do the removals, none of the hardware had been removed and you called me to ask if we could remove the hardware. Our reply was we could if it was available. We were not aware that the demolished storefront had been immediately removed from the site upon removal from the opening and it was taken directly to our yard where it was placed in a dumpster and the dumpster was emptied that day and we were not able to do any hardware removal.Paragraph 10: All the work has been completed with regard to our quotation (seeAttachment A). We have completed all the punch list items and await your payment to us. If there is additional work you would like us to accomplish on this project, we can provide you with a quotation to complete the additional work, but we will require payment in full before we start the work.Paragraph 11: The work completed on this project was in accordance with the quotation dated June 3, 2014 (see Attachment A). If you choose to do additional work that is above and beyond our scope of work, that is your option. At this time, there is no risk or potential threat of death or injury due to one door that only required adjustment, which was done in a timely manner and has not exhibited any sticking since the adjustment.Paragraph 12: The scope of work included in our quotation dated June 3, 2014 (see Attachment A) has been complete and we expect to be paid fully for the work completed.Paragraph 13: Mr. [redacted] is fully aware of your correspondence.Paragraph 14: Now we get to the real reason for your complaints. You would like a reduction in the mutually agreed upon contract sum for the contracted work. Let us remind you, before you signed our quotation dated June 3, 2014 with you indicating it being "Accepted", you attempted to "negotiate" the contract amount by telling me that you had gotten a quotation from Paul Davis Systems for $10,000 to do the exact same scope of work. We asked you at that time that if you had gotten such a good price from another contractor, why you had not contracted with them to do the work. That question went unanswered. We also told you that we would not reduce our quotation amount and that you were free to contract with whomever you wished. Your choice was to contract with Burkhart Construction Corporation for the full amount of the quotation, which is $15,796.00, which we expect and demand to be paid in full.Thank you for your consideration of this information, as well as the previous correspondence we have sent to you answering your inquiries.

Review: The contractor originally delayed the demolition of my storefront from where a vehicle drove into it. He was advised of the damaged concrete threshold and that I wanted it replaced prior to the new storefront being installed. Contractor did not replace the concrete, nor provide me the ooportunity to have another contractpr replace it. Instead, the contractor went forwrad and installed the new storefront on the damaged concrete threshold/frost wall area.

Now last winter, the door stuck shut by being pinched by the framing of the storefront. They did come out and adjust the door to nearly its lowest possible adjustment which allowed the door to then open, but it happened again. Adjusting the door is a bandaid to the solution. It is not resolving or correcting the issue. Next year, I expect the door to stick again which is a hazzard to my customners and a violation of the City ordnances, laws and/or regulations.

The contractor is in denial of the issue and is done working at my location but yet is still billing me the full amount.

There is additional problems too, as the employee of the contractor told me in person that they would replace the concrete threshold, but didn't. The VP of the Contractor told me he would do make it level before installing the storefront. he did not, and it is unclear to me if he ever asked the Storefront installers to make the threshold level or not.

Another issue is that he was selling me and installing an Aluminum awning frame, and I received a steel frame instead.

Also, the installers made a mistake and drilled holes in my new storefront in the wrong places making the storefront less appealing to the eye.

Also, the first time they installed it, it was not True or level as the top of the door was shut, but the bottom remained open about 3/8". They did come back and moved the bottom of the storefront inwards, but is now unable to put all the screws in the aluminum threshold because they cant put two holes in concrete side by side,

I have contacted the contractor numerous times but they remain in denial. They've agreed to meet with me in the past, but refused to put a level, or square on it which would show that the storefront does not meet the manufactureres requirements.

There is more, but this is already getting pretty long.

I feel that I did not receive a quality product or installation of a new Storefront, and the contractor won't fix it.Desired Settlement: I would like the contractor to remove the storefront, remove and repour the concrete threshold/frost wall, do whatever it takes to solve the problem of whatever is making the door stick periodically.

If they refuse to do more work, then I would like a credit on their billing, reduced by the amount of the other estimates that I am currently receiving from other contractors to get the job done right.

Otherwise, remove their storefront and not bill me. And I will hire different contractors to install yet another Storefront, hopefully correctly this time.

Box 498, Butler, WI 53007 [redacted]The storefront is creating a potentially dangerous situation whereas it is shrinking or contracting or something, in the winter, causing the door to get pinched shut. This is a violation of which the City of Waukesha could give me problems about, and if there was an emergency, and people could not get out that door when it is stuck, that could have an adverse affect upon peoples life and health by potentially causing or attributing factor causing injury or death to people on my premises in the event of an emergency or disaster situation.The vehicle caused damage to the floor beneath the storefront areas. The Storefront is now sagging in the middle causing the storefront to be unlevel, and further out of manufacturers clearances and specifications.Additionally, the first attempt to install the storefront was shoddy and incorrect as you had verified as the framing was not installed "True", as is required by the Manufacturer, (Specifically, the top of the door would close, but the bottom would remain open maybe aproximately 3/8".The Opening for the Storefront, especially the concrete floor/threshold, is not level and true as is required by the Manufacturer of the storefront.I believe I should have Insurance Coverage to dig out the broken floor/threshold etc, and have the whole area under the storefront replaced with new to create a Level and true, and unbroken/undamaged surface to support the new Storefront system. Even if I didn't have coverage, that work should have been performed to address the damage, and to meet the Manufactureres specifications.Additionally, this brand new storefront has additional holes drilled into it which I consider to be damage. The holes are caused by the contractors whom made mistakes during the install. I should not have to accept these additional visible holes, nor the holes drilled threw the therrmally broken areas in an attempt to correct the shoddy workmanship. Especially, when I was paying extra for that thermally broken barrier material, which has now been compromised by having to drill through it to anchor the storefront.Also, you errored in your design, and ommitted the fact, in part, that a window sill was supposed to go underneath the window, instead of in front of the window. Now the window cannot be as easily replaced as there is now a barrier on both sides of the window framing.Additionally, you led me to believe that you would be providing me with an aluminum framing awning, but I received a steel frame instead.Also, the block which supports the awning is broken, and it was not replaced.Also, you threw away my old electric door strikes and parts when I had originally informed you that I want to keep the old parts, and you agreed, yet you took my old parts and threw them away, or maybe even turned them in for scrap money.You have already indicated to me that you feel you are done working at my location. Therefore, I now need to ask you and [redacted] for the last definitive time, if you are willing to address any of these issues?If not, then I need a definite answer from you both, so that I can then consider, at the very least, to have other contractors come in, remove the storefront, repair the floor/wall below to eliminate, or decrease the risk of the potential threat of death or injury caused by that door sticking shut in the winter.Although, before I hire anyone else to finish this storefront project, I am making a good faith attempt to allow you the chance and opportunity to address these issues.Please forward this to Mr. [redacted] whom owns your company and then please respond back to me in a timely manner, hopefully by this weekend.Then we need to discuss any credits that you will give back to me for the other damages and issues, that I may end up having to repair/replace yet.Hope to hear from you by evening, May 8, 2015.Sincerely, [redacted], North Street Station, 511 E.
