Last month I was looking to move into a two-bedroom unit at Colonial West through Burns Properties off PhelanMy deposit and application were submitted and paidWhile it took several weeks for my application to be approved, I kept following up with the office for my move in statusI was told that the unit was not available to view because maintenance was working on some repairs and that it would be ready by January 18thI assumed that the approval to move in was a go and that once the repairs on the unit were complete, I'd be shown the unit and be ready for move inI was told to set up electric services a week prior to move in (which I did call Entergy and the lights were active January 14th)On the 18th, that morning I go to the office on my lunch break and was told they were still waiting on rental verification from another property I last rented in HoustonAll this time I'm under the impression that I would have a new home for me and my two daughters *** *** #**

To Whom It may concern: I was out of the office when the complaint was filed, but the attached was the response from *** ***, Property Manager that the complainant spoke of. I have reviewed both the complaint and response and have seen photographs of the apartment. It seems
that the complainant has exaggerated her side of the story in terms of delays and condition of the apartment. Ms*** attempted to please her when by having the apartment repainted and the area of the upstairs bathroom re-calked. It is apparent that the complainant had intended to violate the application and the Lease with the intent to move in an unauthorized occupant with her, whether it was a husband or boyfriend, he couldn't get his story straight with Ms*** over the telephone. Ms*** showed and leased the apartment the following day to another prospect, they seemed pleased with the condition of the unit. Considering the above, we are not required to return the deposit to the applicant, as per the application agreement. However, since the unit was relet immediately, we have decided to give Ms*** her deposit back. She must provide the Revdex.com with a forwarding address to send the application refund Let me know if you need anything further at this time. *** ***

[redacted]: [redacted] worked with Ms. [redacted] during the application process.  Accordingly, Ms. [redacted] application was never approved nor was she told that it was approved.  She and Ms. [redacted] spoke ongoing about a prior balance of $ 3, 229.00 that she owed to another apartment...

Ms. [redacted] attempted to work with her and hold the apartment for a couple of more weeks while she worked out payment with the apartment complex.  However, that did not occur and when she came to pick up her security deposit, Ms. [redacted] offered her more time to hold the apartment to resolve the delinquency, but Ms. [redacted] didn’t know when she would receive her income tax check. The application was denied at that time by Ms. [redacted].    Ms. [redacted] did not know why Ms. [redacted] assumed that her application had been approved.  We will not refund the money to Ms. [redacted] for prematurely ordering the turn on of the electricity of that apartment.  Please let me know if you have any further questions. [redacted]

After threatening to call my attorney a week later the deposit was returned.   I still wish to leave the complaint regarding their customer service. I heard them taking about customers and how they were going to evict them, They were acting if it was a game. Laughing about calling the cops to...

get that n word out of there. Talking about how the lady just wants a free month. They were belittling her in front of me. They even mentioned her first name. If I knew they lady I would have known all of her personal business. Besides that, I had to take off work three days to handle this situation. I heard the office manager telling the receptionist  tell her I'm busy. Then was told that the deposit would be returned in 30 days. I had to mention that I was an ethics major in law school and that [redacted] would have a field day with the way we had been treated. I also mentioned that their HIPPA compliance was not good at all. Example: We were turned down for an apartment with Burns Property. We went to another location that we were not aware that Burns owned. When I was called by The Regency(Burns Property Apartments) the lady that called was laughing saying nope you cant move here we are Burns too. Right then and there I knew they had been talking about us. This whole ordeal has been very unprofessional and I do feel they discriminated against us. I know every apartments have their own Guidelines,but if you put it in black  and white you should have to honor it. I'm still very upset because they basically defamed my husbands character. True he has a felony, but it was from 1991(24 years ago), it was a non violent crime(Marijuana possession less than a gram),and he has not been in a lick of trouble since. The papers said that all backgrounds would be looked at on a case by case bases. All in all yes they did return the deposit,but this is the worst experience I have ever had with any business entity. They were rude, provided false information in black and white. We now rent from Parigi which goes by the same guidelines as Burns only a little bit more strict, and we got in with no problems.
