Busalacchi's A Modo Mio

Review: I visited this restaurant on valentines day in 2014 and had a nice evening. Unfortunately my waiter made a mistake on the bill. I was originally charged 96.01 by mistake. He charged me for a drink I tried but sent back. He realized the mistake prior to giving me the check, and assured me it would not be on the bill. However he brought the check over with the drink included. Once I pointed it out he asked me to just sign it and let me know he would print me another receipt without the drink. Consequently that bill was for 91.74. I tipped him 8.26 making the total an even 100. This is why I noticed that the bill was incorrect on my card, since it came out to be 104.27. What he actually did was charge me for the drink as well as tip. This was FRAUDULENT. I did not sign a receipt totaling $104.27 and therefore this restaurant has committed fraud by using my credit card information to charge me for more than what I received.I reached out to the owner to request a refund and he would not comply. I gave him over 30 days to refund my card, and he did not. He claims he does not know what credit card to refund, and that he would like me to email him my credit card number. After this restaurant has already fraudulently used my credit card information, I refuse to do such a thing. I requested a check, and he would not comply.Desired Settlement: I would like a full refund of $104.27 for having to not only deal with this matter on 4 different occasions, but to keep me from further pursuing this matter and pressing charges for the company having fraudulently used my credit card information to overcharge me.
