Revdex.com: I have reviewed the response made by the business in reference to complaint ID [redacted] , and have determined that this does not resolve my complaint For your reference, details of the offer I reviewed appear belowYes, they did offer me 12K or 15K, but when I said I wanted 15K, Joe advised me not to pay extra, he would switch me out and into a new car after years (he was aware I was in outside sales at the time)It all comes down to what I was told and advised at the time of signing for this leaseYes, I did agree to purchase a newer car, but after doing so, I realized it wasn't the car I wanted or the price I wanted to payAfter reading Joe's reply, he only remembers what he wants to remember, not what he said to myself and my wife about the extra milesAt this point time, I realize that they don't want to be responsible for things said, so I'm not going to be bothered by the resultsIf they won't stand by their word, so be itWe'll pay the overage, although we feel because of Joe's 'don't worry about it' statement, they should cover it Regards, [redacted]

Revdex.com:
I really wish Busam Nissan had clarified any of the statements they conveyed in their response, but they did notAgain, Mr R*** quoted " Dont worry about the final payments which clearly was acceptance of the loyalty program paperwork which I furnished When I discussed financing with Mr R*** he agreed- because my credit Union could offer me a lower interest rate, he did not make any effort to even discuss Nissan Financing periodI was not offered any finance information at all.I pointed out several times, the necessity of the final payments as the road block to me purchasing a new vehicle from him at that present time. The waiver of payment from Nissan only stated I LEASE OR PURCHASE A NEW VEHICLE FROM NISSANMr R*** never advised me it was solely married to the new vehicle being transacted through Nissan Finance Corp.e response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below

After further conversations with Nissan Customer Service & their Division of Consumer Affairs the situation was resolvedI appreciate the Revdex.com for the guidance to help resolve this matterI also appreciate Nissan Consumer Affairs in stepping up in the resolution which the Dealership would not

The customer did purchase a new vehicle from usHe had received a solicitation from Nissan that offered an early lease termination if the customer purchased or leased a new Nissan and financed the vehicle with Nissan Motor Acceptance Corp. The dealership never offered to make any payments for the
customerThe salesperson states that he informed the customer that Nissan would make the final payments if the customer elected to finance their new vehicle with NissanThe customer asked about the solicitation he received from NissanHe purchased a new Nissan but did not finance with NissanWe called Nissan to inquire about this when the customer called us and we were informed the customer did not finance the new vehicle with Nissan Motor. We do not have any notes mentioned in our promised category as to making any payments for this customerAs is customary on any new/used vehicle purchase, we have the salesperson complete a "We Owe" or "Add Remove" form with the customer which states any promises we make to the customer such as promising we would pay a final payment, or if floor mats or some accessory was included in the dealWe checked our paperwork and there is no mention of us "owing" any payments on this deal, and we cannot find anywhere in our paperwork of a mailer or solicitation that this customer received and states was given to us.I don't know why Nissan would direct the customer to call the dealershipMy guess is they informed the customer that they would not be making the final two payments and directed the customer to call us to find out why.My concern is that the dealership did not solicit this customer offering to take care of lease paymentsNissan solicited the customer and was very specific that the customer must finance their new vehicle with them to receive the offer. The final part that makes me question Busam' liability is that we did NOT set up the financing for the customer's new vehicleIt is specifically mentioned in the deal that the customer was to use his own financing to purchase the new vehicleMy guess is the customer had a bank or credit union they preferred to deal with and elected to finance the new vehicle with themIf we had been given the opportunity to search and obtain financing for the customer and elected to choose a different bank than Nissan, I would understand why the customer would place some of the liability on the dealershipBut we did not work with the lender and the customer specifically chose his own bank or credit union to finance withIt would have been in the dealers best interest to obtain the financing for the customer and had we elected to obtain financing other than Nissan which would have voided his payment waiver from Nissan then I could see how the customer would think we intended unfair business practices. I think the customer needs to take this matter to Nissan because they make the rules and decide which customers payments are waived and they make the final paymentsSince the dealership did not promise to waive any payments or obtain the financing and steer the customer away from financing with Nissan then the problem lies with the customer and Nissan. Thanks for your time and attention to this matter.John B***

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below
Dear Mr* ***
Thanks for
taking time to handle my complaint ID *** with Busam & Nissan Corporation
and for your effort to coordination and mitigate this powertrain transmission
& radiator repair warranty issuePlease find my response to questions
below
Question 1.* Has the company addressed
the issues of this dispute?
Answer: No,
Busam in cooperation with Nissan Corporation USA have not satisfied nor have
they fully addressed the warranty dispute issue as requested in this complaint
Question * If not, why?
Answer: Mr
***, Busam Nissan representative is merely restating the same “standard corporate
response” I have received from Nissan corporate office and later repeated by service
manager *** *** on 10/21/2015. The
matter of this complaint is for additional years of extended warranty or
24,to 36,milesI am not seeking co-pay or claiming reimbursement help
from Busam or Nissan
In 2013,
Nissan fully acknowledged, admitted and disclosed to NTSB and US Federal courts
that they had Major Manufacturer malfunction with Transmission and Radiator
assembly on Frontier and similar modelsNissan offered owners (within specific
years/miles restrictions) reimbursement claims options See attached Document (Doc1_Nissan_1st_Letter)
Question * Has the company met the
agreement they outlined in their response?
Answer: No Again, Mr*** and Busam in cooperation
with Nissan Corporation USA have not satisfied nor have they fully addressed
the extended warranty dispute issue as requested in this complaint
On
10/21/2015, I paid “opocket” the full cost of repair and I am not seeking
co-pay or claiming reimbursement help from Busam or Nissan See attached Document (Doc2_1st_Repair_at_Busam)
I expect
Busam (repair service provider) and Nissan Corporation (vehicle manufacture) to
provide (parts and service guarantee / warranty in writing) beyond the standard
year 12,miles offered
The fact
that I had to return (towed vehicle) back to Busam after miles of driving to
replace and re-clamp busted cooler line, led me to question the integrity and
reliability of parts and service provided
See attached
Document (Doc3_Towed_and_2nd_Repair_at_Busam)
Sincerely and Best regards,

This is the response from B*** Nissan of complaint id *** in Relation to the customer *** * ***. Mr*** has stated that he agreed to a lease of 12,mile per year under the assumption that he would turn in the current lease early and into a new lease with NissanHe stated that I
advised him to do this and we did not live up to our promise. The first part of the statement is that I convinced him to sign a lease agreement which is between the customer and the leasing agency for less miles than he drove per yearI can assure you we offered the customer payments for 12,and 15,miles per year so it was ultimately the customers decision to choose the mileage. The second part of his statement says he has tried on multiple occasions to upgrade his lease without successFor instance, he says he was told rates weren't good and to wait by dealership employees. What the customer fails to mention is that he leased a Subaru from our Subaru dealership and elected to turn that vehicle in early and went into a Nissan leaseThis was the second vehicle we leased to him and we also leased his spouse two vehiclesWe very much have desired his business and have worked with him on multiple occasions to get into a new lease and turn his current lease inIn fact, this past summer, Mr*** came in to the dealership and worked with our leasing consultantWe were able to reach an agreement to turn in his lease early and to lease a new NissanThe vehicle he desired was not at our dealership so we informed him we would have to obtain the vehicle from another dealershipHe informed us that we had an agreement and to get said vehicle from the other dealerSo we obtained the vehicle and called him to inform him that his new vehicle was here and he stated that he now wanted to waitThe sales manager was upset because he had shaken hands with Mr*** who stated please go and get my new car for meNormally, we would require a written agreement and deposit from a customer to obtain a vehicle from another dealer, but Mr*** had leased several vehicles from the dealership prior and even was an employee here for some time, so they felt a deposit wasn't necessaryBoy were we wrong. The sales staff tried to contact Mr*** after this with limited success and he informed the staff he was going to lease a new *** because they were taking better care of him.A few months after we tried and failed to do a deal with Mr***, he called John B*** and stated this same complaintJohn verified we presented Mr*** with his options when he leased the car originally with 12,and 15,miles a year and he verified we had worked to get Mr*** into a new leaseIn fact he tried as well to get Mr*** into a new Nissan but unfortunately there wasn't a deal that met his demandsI can promise that it wasn't for a lack of trying on our part that he isn't in a new vehicle.I cannot offer for *** anything but to help with getting in a new leaseIt seems he has already moved on and posted to social media that he purchased or leased a different manufacturer vehicleAt this point, the vehicle is between Mr*** and Nissan Motor Acceptance Corp. Thanks Joe
