Review: I decided to open a franchise restaurant and needed a loan. I created a business plan and contacted three banks in my area but they did not want to help with an SBA loan. I took the advice of a friend and contacted a financial consultant, [redacted] from Business and Community Financing Solutions, LLC. We spoke in early February 2013 and agreed that we could expect to open on May 16th, 2013. For the next two months I heard very little from **. [redacted] but he assured me that due to my credit history and capital my financing was going to be easy for him to secure. It wasn't until April 11th that [redacted] first formally attempted to obtain financing for me but according to telephone conversations we had, he also brought two other franchises with him for consideration so I was competing with his other clients and I lost financing in this way twice.Over the next several weeks I found [redacted] to be less and less responsive in calls and emails until finally he attempted to set me up with another financial organization that charged $4500 for their services. I then knew I needed to approach banks on my own and I eventually got my own loan without BCFSOL. Bills from BCFSOL kept coming and so I offered to pay half the original agreement in compromise. I received no reply for months and then finally a bill arrived in the mail with penalties added. I've contacted a lawyer but they say that until I actually get sued, there's nothing they can do at this time. BCFSOL received a $1K down payment, did not furnish a business plan as stated in our contract, did supply a spreadsheet after several months and put my project behind by at least 4 months all while I was paying full rent and utilities on an empty building. BCFSOL now wants full payment plus penalties because our contract was not contingent on getting a loan. I contend that our contract required much more attention and productivity than was provided. I've written two letters to BCFSOL to state my case but have received no answer.Desired Settlement: For the reasons described above, I request that BCFSOL keep the $1k deposit but be owed no further compensation.
