Omega Moving & Storage claims department has been in constant contact with Moore Furniture, the manufacturer of the damaged nightstand. However, they no longer carry the line of furniture nor do they have the matching screws in their warehouse. According to the signed Bill of Lading, if your article is a complete loss and is no longer functioning, we are able to refund $0.60/lb for your nightstand. At this point, our claims department will follow through with the claim according to the Bill of Lading that you agreed to

This is the same response I've been getting from them for the last days It's not my responsibility to figure out a way to delivery my item They are in San Diego and I'm in ** This is a two hour drive They could have easily sent a driver to deliver my item regardless of whether they have a trip to ** or not How long am I expected to wait, 1,2,or more months I'm sure their are other freight services that will deliver glass otherwise they wouldn't be sold As for as the claim is concerned, they sent an email telling me how much they would pay There was never an email asking me to accept the final amount for damages.

The man who delivered could attest to the fact that the blanket covering the furniture was wet and the damage was purely to water. This wasn't the only thing that was wet, many boxes were still wet when they were delivered to the point the bottoms fell out but they contained items that were not damaged due to the water. I sent photo's of the birds eye maple dresser to your office before you picked it up. It was in pristine condition and never had any repairs. I can send affidavits to that fact. What I got back was warped wood with green mold on it. It would seem to me that your company should be responsible for negligence. Water damage is not a moving occurrence and all I can conclude is that you left my possessions outside and they got rained on or your warehouse had a flood. That is not taking reasonable care of my items. The amount I was asking was just to fix the one piece of furniture, the birds eye maple antique dresser. The other piece was a loss and was scrapped. If you need better pictures of the warped wood I can do that, but the piece was in perfect condition and anything you see on the photo you caused.*** *** In a message dated 2/16/3:15:P.MEastern Standard Time, *** writes:Good afternoon Ms***,Omega regrets that you have a less than perfect experienceWe have been in contact with you since August via email and telephoneOmega would like to resolve this matter but have yet to come to an agreement on amount to settle the claim for your repairs without violating company policies. We would like to offer you $to close this claim at twice the amount legally required.Previous Offers to settle claim:1/16/$(per per lb.)2/20/$(more than valuation above)On the Bill of Lading, signed, initialed, dated and printed the following: “cents per article per pound” by the customer“The valuation coverage provides minimal protection under this option at no additional costThe coverage only applies if articles are totally destroyed or lostOmega Moving & Storage, Incassumes liability for no more than $cents per pound per articleThere is no provision for coverage of cosmetic damagesThis option does not cover scratches, dings or dentsCarrier cannot be held liable for any damage to internal electronic, mechanical items, particle wood items (pressed wood) and items packed by the owner, fragile or brittle items such as glass, china, ornaments, etc.”Item#31: Water Damaged Desk/Broken Leg (Weight 145lbs) Valuation Calculation $Item#30: Water Damaged Dresser/Mirror (Weight 110lbs) Valuation Calculation $66.00In summary, Omega Moving & Storage, Incis only liable for compensation according to your insurance coverage selection, which was valuation coverage that only protects $cents per pound per article based on total loss.We thank you for taking the time to explain your concernsPer our company policies and selected insurance option, we find $to be a fair settlementOmega is offering more than $per pound per article for Claim #***We regret to inform you that we cannot cover the cost of the repairs at the amount requested by Miss *** of $As additional insurance was not purchased and items were not lost nor destroyedWe respectfully regret inconvenience as the photos provided do not clearly show water damages and the broken items appears to have residue that indicates previous repairs.Best regards, Omega Moving & Storage, Inc.Office: ***Fax: ***Website: www.omegamoving.com***Mar (days ago)to***From: ***To: ***CC: ***Sent: 2/16/5:15:P.MEastern Daylight TimeSubj: RE: Claim: *** *** / Job #***Good afternoon,We would like to offer you $to close this claim at twice the amount legally requiredPer our company policies and your selected insurance option, we find $to be a fair settlementOmega is offering more than $per pound per article for Claim #***.Please confirm to settle this claim.Thank you,Omege Moving & StorageFrom: *** [mailto:***] Sent: Tuesday, February 16, 12:PMTo: Claim Omega MovingSubject: Re: Claim: *** *** / Job #*** Can you please explain to me how my furniture and boxes got wet while in your care? No where in the document provided by Omega packers it is mentioned that they can breach the time window given by themselves. As I have said it many times before also, the variation in time window was too much, almost 10-12 hours. It becomes even more serious when we consider the fact that this was enforced on me even after my multiple requests to push it later in the day.Secondly, Omega delayed the delivery to night & then their workers asked for extra nightly charges. Where in the document it says that omega is free to push the delivery at any time & then ask for extra money? To me it is a Scam.Lastly, Where is the doc it is said that Omega can 'handle' the items in any way they want. The basic insurance I have opted for & which is supposed to pay for these kind of damages is taken in the faith that Omega will handle my items carefully & professionally. But if they do not do so & stuff more items in their truck then it can really accommodate, then they should also be ready to pay for the damages caused to personal items due to this mishandling.[redacted]

Good afternoon Ms. [redacted],Omega regrets that you have a less than perfect experience. We have been in contact with you since August 2014 via email and telephone. Omega would like to resolve this matter but have yet to come to an agreement on amount to settle the claim for your repairs without violating company policies. We would like to offer you $306.00 to close this claim at twice the amount legally required.Previous Offers to settle claim:1/16/15 $153.00 (per .60 per lb.)2/20/15 $250.00 (more than valuation above)On the Bill of Lading, signed, initialed, dated and printed the following: “0.60 cents per article per pound” by the customer. “The valuation coverage provides minimal protection under this option at no additional cost. The coverage only applies if articles are totally destroyed or lost. Omega Moving & Storage, Inc. assumes liability for no more than $0.60 cents per pound per article. There is no provision for coverage of cosmetic damages. This option does not cover scratches, dings or dents. Carrier cannot be held liable for any damage to internal electronic, mechanical items, particle wood items (pressed wood) and items packed by the owner, fragile or brittle items such as glass, china, ornaments, etc.”1. Item#31: Water Damaged Desk/Broken Leg (Weight 145lbs) Valuation Calculation $87.002. Item#30: Water Damaged Dresser/Mirror (Weight 110lbs) Valuation Calculation $66.00In summary, Omega Moving & Storage, Inc. is only liable for compensation according to your insurance coverage selection, which was valuation coverage that only protects $0.60 cents per pound per article based on total loss.We thank you for taking the time to explain your concerns. Per our company policies and selected insurance option, we find $300.00 to be a fair settlement. Omega is offering more than $0.60 per pound per article for Claim #[redacted]. We regret to inform you that we cannot cover the cost of the repairs at the amount requested by Miss [redacted] of $400.00. As additional insurance was not purchased and items were not lost nor destroyed. We respectfully regret inconvenience as the photos provided do not clearly show water damages and the broken items appears to have residue that indicates previous repairs.Best regards,  Omega Moving & Storage, Inc.Office: [redacted]Fax: [redacted]Website: [redacted]

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. And does department of transportation recommend that you can harass the consumer in any way you want by citing these guidelines? In that case I am going ahead and filing the complaint with DoT on this.

The vendor states that they regret the "peculiar case in which nature and rare coincidences took place".  They don't say what the rare coincidence is or why nature should have any part in the care of my belongings.  Did they have the furniture sitting out in the rain?  How else would my antique wood furniture be delivered wet and moldy?   My contention is that due to the poor care of my belongings the valuation coverage is void and they should pay for the repairs.[redacted]

To whom it may concern,Mr [redacted], Has been in contact with our claims department and is well aware of the reason why his glass can't be delivered. UPS and FedEx  will not allow glass to be sent via their services. We had advised him that as soon as a route for the LA area is available that...

will be delivered. We have also offered him compensation for the damaged table according to his elected coverage during his move which is .60 cents per pound with no response to us on his decision. Email from that offer will be attached. If any other information is needed please feel free to contact our office. Thank you.Regards, [redacted]

Mr. [redacted], We have addressed the issues previously with your signed contract as a guideline for your concerns. We can only offer what is on your signed contract as we are regulated by the US Dept of Transportation.. We can not do anything that is not in the contract, we have reviewed your claim and offered compensation for the items that are covered under the $.60 cent per pound rule. Wages are not included and will not be payed. Omega Moving and storage

The last reply shows that they lied initially to about obtaining screws in December (see attached email) from the respective furniture company. The screws are not unique and able to obtain at any common hardware store. It took them 5 months to offer me $18 for the damage to the nightstand. It's going to cost me almost 4x that to hire a handyman to come over and fix it. When I asked if they could send someone, I never heard from them again until I filed a complaint. These movers did an excellent job the first time I hired them but a very sloppy job the second time. They also ruined most of the legs to my 4 piece sofa set that is costing me several hundred dollars to replace as that was not covered. These are not reliable movers that care about your belongings.

Mr. [redacted] The glass will be delivered by one of our employees who will be in the area this weekend. As far as your table, the offer for that is still standing. A phone call to you to coordinate a time for delivery will be made by the end of the week. Thank You Regards,Omega Moving & Storage

Mr. [redacted], Please review the following documentation, this has all the information pertaining to your move. Please review all of it. It has all the information I had previously given you regarding the way we process your claim. It is all signed by you as acknowledgement.  Thannk...

You, Omega Moving and Storage

Thieves, disrespectful, and overall terrible place to buy a car or fix it. They don't know what they're doing. Broke my car and made it worse then charged me a ridiculous amount of money. The owner is an obnoxious crook and so are the employees. Avoid at ALL COSTS. You'll be better off going somewhere else. Heard and read several reviews of the company all were bad, most left their with a newly bought car that broke shortly after purchasing. They have an UNCERTIFIED mechanic who does not know anything about cars. Will rob you of your money, and on top of it refuse to fix or negotiate anything for their mistakes. Horrible place to fix your car or purchase a vehicle. They maliciously prey on good hearted people, and steal your money. A complete scam. RIP OFF! STAY AWAY
