The complaint is missing some compelling factHere is our view on the chain of events:At 5:05p on 12/4/2015, our sales representative received a voice mail message from ** ***'s *** *** with the following request“Our Internet is down and this is an emergency and we need help”
2. Our rep, **, responded at 5:15p and spoke with ** ***'s *** *** (CEO)Mr *** requested that ** come onsite on Tuesday morning 12/8/at 9:30a to address ** ***'s problems** arrived at ** ***'s office at 9:30a on 12/8, as scheduled, to meet with Mr ***, explain how BNC works, and go over the consulting agreement BNC uses for all of our customersBefore signing the agreement, Mr *** asked ** if ** could look at his network and see if he could get their internet connection back onlineIn good faith, ** did this, working with a *** engineer who was also onsite, as well as a remote based engineer ** *** had used to set up their network** troubleshot the problem and was able to identify the issue as an incorrectly setup private IP addressHe fixed the issue and had Mr *** confirm his email and internet connection were working, which he didMr *** then asked ** if his internet was working, why were his phones not working** explained that the hosted phone service ** *** had chosen was incompatible with the phones they had purchasedAfter being onsite for almost two hours, ** sat down and went over BNC’s consulting agreement with Mr***Mr*** had two minor issues which you will see in the attached PDF:- Section: - questions about our ratesI explained to him that our should ** *** agree to a minimum 4-hour/month proactive maintenance plan, BNC would reduce its regular rate of $185/hr to $per hour (this is spelled out in paragraphs - 4.4)You will see on page that Mr*** agreed to the proactive monthly maintenance plan.- Section: - Mr *** struck this section out** explained to Mr *** that BNC handles changes via an addendum and that any changes would require BNC's COO's approvalNevertheless, Mr *** signed the BNC client agreement as it wasHe then asked that BNC be back on site ASAP to document the ** *** environment, review backups, and make sure ** *** did not have any serious IT security holesHe requested that we have someone onsite as soon as possibleOne of our systems engineers arrived onsite that same day (arriving at 1:45p and leaving at 5:45p) to address critical IT issues which Mr *** requestedMr*** addressed the following issues: Audited NetworkDocumented IT environmentReviewed DNS configuration on all servers and noted inconsistencies.Worked with end users to address lingering local desktop setup issues which occurred after move from Wyoming Identified wireless network and verified that existing wireless AP's left in the building will not work with ** ***’s current firewallThe next day, 12/9/15, the systems engineer sent Mr *** an email outlining a highlevel overview of his findings, not least of which was confirming that the phones they were using at their Wyoming location would not work with the circuit they had in DenverOn 12/9/** went back onsite at 9:am to attend a confirmed appointment with Mr ***The purpose of this meeting was to wrap up some minor issues with the BNC consulting agreement related to Section 7.1. ** spent minutes in Mr ***’s office working to resolve the final BNC agreement detailsDuring this discussion Mr*** took a call and told ** he would have to come back at another date to finalize the BNC agreement detailsUpon leaving ** said to Mr***: “It seems to me that you do not want to work with BNCIs that correct?” Mr *** looked up and said, “Yes”** exited the premises at that time and no further relationship has existed between BNC and ** ***BNC tried to help and accommodate ** ***’s requests in a professional mannerAfter working with Mr*** for two days, it became apparent that this was not going to be a good long term relationship for either party. BNC attempted to collect it's fees per the contract that was signed and Mr *** told them the work was never approved and he wasn't going to pay for it.BNC sent the account to collections, where it is today, and is what we believe prompted Mr ***'s filing of a complaint. We believe we acted in good faith and were only requesting fees for the services that were both asked for by Mr *** and permissible under the agreement
