This patient came to our office in May for a full examination and contact lens fit as she describesFollowing the eye health examination and refraction, she was fit in contact lenses as she describesHowever, at that time, she was not "offered to order contacts", as she was a new patient to our
office, and as such would require a follow up to determine a) that the contact lenses fit based upon her near-sightedness and astigmatism provided her with satisfactory visual acuity and comfort, and b) that the contact lenses provided fit properly to her corneas and conjunctiva and did not provide any risk for complicationsIf she had returned for her one week follow up and it was deemed that the contacts provided excellent fit, comfort, and vision, she would have been given the option to purchase contact lenses through our office or given a written prescription for her contacts to take elsewhere, as we have always done over my years of practice at Bennett EyeCare Midwest.In regards to the Fairness to Contact Lens Act, she has the rights to her contact lens prescription once it is finalized, but as a new patient, the prescription can not be finalized until the lens is deemed to not cause damage to the cornea and/or conjunctiva through a follexam that generally takes less than minutes, not an hour like the full examination.As a medical device that comes in contact with human tissue and sits directly on the cornea, regulations are put in place to closely monitor these devices, thus the reason for regular eye exams and contact lens refits year to yearNot every contact lens fits and performs the same on every patientWithout proper folland evaluation of the contact lens fit, there is risk of serious long term complicationsPersonally and professionally, I am not willing to put my years of professional experience and and optometry license at risk for someone's inconvenience to return for the proper folland care.Finally, we have never refused to release finalized contact lens prescriptions to patients, and we never will, it is against the lawWe simply need to make sure that the finalized prescription is satisfactory for the patient and for the health of the patient going forward.Thank you for your timePlease let me know if I can assist any further in this matter going forward.Sincerely,*** ** *** ***

I am rejecting this response because: I will take my refund for the contact lens exam. I have never been required to have a re check in my 15 years of wearing contacts and simply dont have the time to start. I feel as if im being punished by this business for being a member of the mitary and having the need to go to many offices.
