I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
In the response from Ms***, she had stated that we "sometimes feed our children in their car seats when both need fed at the same time." I am not sure where she came up with this notion, because we have never fed them in their car seats. As for the children being in another room I could honestly care less if they were in there, it is the fact I saw my child come out of there with my own eyes and Ms***'s employee assured me I was wrong. It seems as if they were trying to hide something from me and that I do not appreciate. If Ms*** has one employee in charge over others while she is gone, she needs to be a little more clear with us as parents on who to speak with. Those are just a few reasons we decided to withdraw our children from the daycare. But none of that really matters, we are free to choose whatever daycare we feel is appropriate for our children. As for Ms***'s "gracious" offer to "let" us continue to bring our children to her daycare for the remaining days that we paid in advance for (which we are only obligated to pay for week at a time according to her "handbook"). I still feel she rightfully owes us for the services in the form of a refund that she did not provide, since she "criminalized" me for threats that were not made. Since she did that and if I were to show up on the property I would be trespassing to bring my kids to daycare. So by law I was unable to bring my kids to a service that she wanted to provide me instead of just refunding me my money that she has no right to keep. Unless she just was expecting me to leave my children on her door step? So with this being said I still feel the only acceptable solution would be a refund paid in full

">When the children first started to attend our daycare we did feed them in their car seats a couple timesI was told by their mother they had to be fed sitting up because of their acid reflux issuesTheir mother also said that sometimes they are fed sitting up in their car seats when both twins needed to eat at the same time, because of that statement I thought it was ok for us to also do thatOnce their mother called and asked that they no longer be fed like that we immediately stoppedI have an open door policy and believe percent in parent/teacher communicationAlso because of the acid reflux issue the twins would spit up a lot, we changed their clothes normally 2-times a daySometimes when they were dropped off they would spit up in their car seats, and unfourtnaly we would miss some of it while cleaning out the car seatsSince we are a license II facility and have up to children a day we try to separate them by ages as much as possibleThis helps things be calmer and we believe this helps give the children better learning opportunitiesWhen the parents asked what room their child was in, they asked a teacher who had been with ages 3-all dayTheir children were under months so she was not aware we had combined roomsWe never lied to the parent, if he would have asked the apprioate teacher he would have gotten the correct answerSometimes if it's a day when there are not as many children we will combine roomsThe teacher he asked was unaware that the children she was not in charge of had moved roomsThe mother knew we did this because I would send pictures of the twins happy and playing in the toddler room instead of infant room sometimesThere was also a contract signed at the beginning of care stating that any money paid will not be returned if you choose not to bring your child on those daysThis is standard daycare practiceThe father was mad he was not going to get his money backI explained the contract and even offered multiple times that he could finish out the days that he had paid for already, so he felt he was getting his money's worthHe refused the services and also threatened to come to the daycare and not leave until he got his money backHe said he would do whatever it takes, even if he has to make a sceneI had to call the local police, and they informed me I should have them pick up their remaining items they had at the daycare after hoursIf he did show up during operating hours he would be in trouble for trespassingI hate that it came to this but had to protect the other children and my businessUnfortunately the parents remain confused about the importance of our signed contractWe really enjoyed our time with the twins and took the absolute best care of them that we couldAttached is a copy of the contract that was signed, a letter from the mother explaining their acid reflux and a statement from the local police office
