See attachment.Here is a summary of the [redacted] Job wherein [redacted] and [redacted] Owe Butler Homes Inc$4,480,[redacted] called me to inquire if I had any lots because he and his wife wanted to build a home, I told him about lot # [redacted] I had In [redacted] Sub, (1,Acres)They liked the lot and decided to build on it, [redacted] asked me if I would carry the loan to avoid the possibility that they might have to carry two mortgagesI agreedI also agreed to enter the Home in the Parade of Homes in order to obtain good discounts on materials and fixturesI also did some work on their existing home to get it ready to sell which it did rather quicklyI sold them the [redacted] Ct, lot for $39,500.00; I asked [redacted] for $5,000,down but ended up accepting $at ***'s requestThis left them with a balance of $37,I worked with them on designing the house to their specificationsAt completion of the home, it was shown both weekends of the Parade of Homes eventWhich had awards and a great turnout with many compliments on the home.The contract was estimated at $278,000,00, depending on choices made throughout the construction process, Overages did occur related to their choicesNear completion, [redacted] wanted to meet to go over invoicesHe was anxious to get their loan closed in order to get a 3.65% interest rateHe and I went over the invoices together and estimated other bills not yet invoiced so that they could expedite their closingTogether we estimated $289,I told [redacted] at the time that since this was only an estimate, that I might owe money back to him or they could possibly owe me more money since all billing had not been finalized, They proceeded with the closing while I continued to pay bills since I was carrying the construction loanThey proceeded to buy new furniture for the home, which I voluntarily fixed a problem with their new bed, and at no charge hung their TV mount brackets, in the summary of money owed to Butler Homes Inc.Lot price $39,500.00Down pmt $1,950.00Balowed $37,Personal loan $211,000.00My cash $45,230,07Total = $293,780.07Client mortS289,Difference $ 4,480,Owed to Butler Homes Inc.My standard fee for new home construction is 10%I made a concession to accept 8,5% from the [redacted] 's to build the home, I feel in effect they stolen money from me, I made many financial concessions for this family and in all fairness would like allowed compensation to be returnedNote: all [redacted] 's numbers are not correct with Lien filed 2-12-2016, also have done work for his Parents, one of his Uncles, a second Uncle (built his home), and his Cousin (my neighbor, built his home) with all of them satisfied and paid Butler Homes inc, in full with no problem!ÍA Lien is filed on someone when they will not pay you in full, material, or merchandise, Lien was placed 2-12-and released 4-3-(I contacted [redacted] that lien was released.) and Butler Homes Incstill has not been paid in full to datewhich I’m sure [redacted] has not contacted you on this correct?Sincerely, [redacted] Butler Butler homes Inc,

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
After reviewing Mr***'s response we agree that the Improperly and Unjustified lien has been released from the property. However, Mr*** was sent a certified letter for which he signed for in July of with a list of warranty repairs that have not been completed as of yet. Additionally, Mr*** promised copies of all receipts for the property. During the entire time of the build we repeatedly asked for copies of receipts so that we could keep up with the amount of money that had been spent as well as accounting for budgeted items that we did not install such as a fireplace or items such as tile flooring and all appliances that we paid for out of pocket. Mr*** consistently gave us an excuse that his computer was down and that he would get us the receipts. We did trust Mr*** and continued on with the build.As we got closer to finishing the house the Lender needed to be updated as to the status of the build so that they could begin ordering the necessary appraisals and title searches. As a result, the lender also needed to know the final price of the home. I met with Mr*** on the job site and went over what he had written down on his file folder of the bills. It should be noted that during this time, one of the bills from the Lumber Company had a different address on it and was for another job Mr*** had completed. That amount of money was deducted from the bill from the Lumber Company. At NO POINT did my wife or I agree to pay additional monies after closing!!!Attached I have included the original contract in which Mr*** was to receive a total of $21,for the completion of the house. I have attached a hand written list of invoices that Mr*** completed and on the bottom it states that the total amount of receipts is $295,528.46. At the bottom, it states that we owe him $6,228.46. I have also attached a letter from Mr*** dated January 7, in which Mr*** "try and resolve this matter without further legalities". In this letter, Mr*** advises that we owe him $4,827.82. This was the number I used in my original complaint. Mr*** actually filed the lien for $4,480.07. I have also attached a Appraisal Appeal Request in which the black ink is Mr***'s handwriting. We had to appeal the original Appraisal because the house did not appraise out. Pay attention to the section labeled NOTE" APPLIANCES WERE PAID FOR OUT OF ***'S POCKET & MIRRORS, TILE, MAILBOX, THAT KEPT THE TOTAL FROM BEING $294.671.00"I have also attached the updated contract in which Mr*** agreed to and wrote the amount of $289,300.00. As previously stated, we still have not been provided with all receipts. For example we have nothing from the drywallers and have no idea who completed that work. The lumber company "receipt" is Mr***'s *** CARD (CREDIT CARD) STATEMENT showing $29,and I have already observed another job on that account and cannot know how much of that amount is from our home.My wife and I feel that we have paid all that was owed and completed our end of the contract with Mr***. Mr*** has threatened a slander lawsuit if we do not "CONTACT THE Revdex.com AND LET THEM KNOW IT'S BEEN RESOLVED"We simply ask that he fulfill his end of the contract.
