Complaint from [redacted] Dated July 16, 2014

It is true that [redacted] put in an offer to purchase the property located at [redacted].

The offer was dated September 6, 2011, giving her a 9 month escrow so she had time to get her down payment and closing cost of $2,800 together.  She closed escrow July 12, 2012 and it is true all her payments have been made on time.

Her purchase contract gave her 17 days to inspect the property to make sure that it is everything she expects from her purchase.  She was made aware that this property was donated to the Fire Department and they have no knowledge other than what is of public records.

On page 4 paragraph 12 please find her due diligent clause, “AS IS” and right to inspect.  And paragraph 19 is her due diligent clause giving her 17 days to inspect but anytime during the 9 months she could have backed out and the Fire Department would have refunded all her funds.

Prior to a mobile being removed (years ago) I have seen people watering the yard, so at that time there was water in the well, power was on and people using the septic.

This notice comes 2 years and 9 months after she first saw the property and a lot has changed with a lot of wells needing to go deeper.  The lot next door just closed on a cash sale for $18,900 with no well, septic or power so she is in a good position to resell the property if it does not live up to her expectations.

I have spoken to the [redacted] CEO and they are willing to have her deed back the property thru escrow and reimburse $8,680 (which includes down payment, principal and interest payments and Rancho Tehama Association Dues paid by her) allowing her to purchase another property.

Review: [redacted] With the [redacted]. Sold me A lot Advertised as "already with a well/septic/electric on property for $13,000.00" Now at the same time as other properties were going for 3-times less without the amenities already on the property. June 2014, I was ready to move on to my property only to find out that there's no water in the well. This was checked out by 3 different well drilling co. Each are telling me that I will have to have a new well drilled@ the cost of $14 to $16 thousand dollars. Which you can see is more than I paid for the property. The electric poles And The Electric Boxes are missing. And the septic pipe is broken.Desired Settlement: I need Well-Electric-Septic before I can move on to the property. I bought it and Agreed to pay the higher price for the property because I was under the impression that I would have these amenities.I haven't missed a payment or my home owners association property dues. I just want what I paid for. A Well-Electric-Septic that works.
