This letter is in response to the correspondence received concerning the case and complainant referenced aboveI have reviewed the text of the complaint, recorded telephone calls and, examined the files at issueOur records indicate that the Complainant purchased the ***’s Shield Ultimate
coverage plan (the “Contract”) from *** *** *** (the “Dealer”) on 7/2/As stated in the Contract, *** *** *** *** (“***”) serves as the Administrator of the ContractThe Contract is at all times subject to its written terms and conditions.On 9/28/at 4:47:03pm ET our office received a call from a representative (***) of *** *** ***, the Complainant’s selected repair facility (the “RF”)Based on this conversation, a claim was initiated for the alternatorThe RF was advised that the “Contract stipulates that all claims require pre-approval from our office before work can be performedAny unapproved work will not be covered.” When asked, due to the late hour, the RF was told that she would be contacted the following morning with regard to any questions, if an inspection was needed or would receive approvalThe following morning, 9/29/at 8:38:46am ET, the Claims Adjuster (the “CA”) called the RFDue to the time zone difference, there was no answerHe called again at 10:39:44amET and spoke with ***She was advised that an independent inspector would be dispatched to verify the failureShe was advised the inspector would call about one (1) hour before arriving and would be there within -business hours and to allow an additional day for the report.She was again advised that no work was to be done without authorization for repairThe Complainant contacted our office at 10:48:12am ET that same dayDuring the course of that conversation, he was advised of the outside limits of the inspection processThe Complainant advised he was in a rental vehicle and asked about coverage, he was advised the rental benefit was based on an approved claimThe Complainant voiced his opinion regarding the timeframe to send an inspector, as well as, referenced he would report the vehicle stolen, inquired as to cancellation and stated he would contact the Revdex.comThe representative reiterated the decision to send an inspector and provided the contact information of the Dealer for cancellation.At 11:48amET on 9/30/15, *** received notification from the inspector that when contacting the RF to advise of His expected arrival time, *** advised the vehicle was no longer at the RF as it had been repaired per the Complainant’s directionThe inspection was, of course, cancelled at that time and the claim denied as the repair was done without authorizationWe realize that sending an inspector delays the claim decisionThis is, however, required based on various criteria as set forth by the underwriter of the ContractAs the Administrator, *** is required to adhere to the adjudication process which, in this instance, required an inspectionOur office has, at all times, acted in good faith and in accordance with the Service Contract*** Administration Services, Incdoes not waive, but specifically reserves, any and all rights and defenses it may have under the Service Contract, as well as applicable state law
