Complaint: [redacted] I am rejecting this response because: The response by Brad J [redacted] is factually inaccurate.MrJ [redacted] states, "On May 11th, my company By the Yard removed the existing sod throughout the front yard." This is not accurate The job was performed on May 7, I have proof in the form of a check dated May - the day of completion of the job.MrJ [redacted] then asserts, "I received an angry phone call from [redacted] stating that she had a leak in her front drip system, that she was going to call someone to come repair the problem, and then send me the invoice." This is not accurate either, as you will note on my original complaint that during routine yard maintenance performed by another company in July, 2015, the leaks were discovered, after which I immediately called MrBrad J [redacted] of "By the Yard" to notify him of the discovered damage At no time did I indicate that I was "going to call someone to come repair the problem, and then send [him] the invoiceMrJ [redacted] then goes on to state, "She became agitated and said this was only possible if I could be there within the hour." In fact, MrJ [redacted] would do well by himself to admit that it was he who agreed to come out to investigate and arrived in a little over an hour.MrJ [redacted] goes on to say, "I then reviewed where the damaged lines were and admitted we probably had damaged one of the breaks." This is inaccurate, as MrJ [redacted] advised us (me and my 17-year old son) that the damage to both lines was "not from a shovel but from our tiller."Further, MrJ [redacted] asserts, "I sent Ms [redacted] a complaint form from [The Construction Industries Division] office to report unlicensed contracting and the contact numbers she would need in order to remedy this situationShe refused and then wanted me to pay for her water use during this period." While it is true that MrJ [redacted] did send me a "complaint form" to be filed with the Construction Industries Division, at no time did I "refuse" to file or fill out said form.I could continue to refute statements made on behalf of MrJ [redacted] , however, that is not likely to be of more benefit than what is already documented above.I reiterate and affirm my original account of the events that occurred and on behalf of "By the Yard Landscaping."Finally, I note that MrJ [redacted] admits that he failed to perform due diligence in checking drip and sprinkler lines after tilling and replacing sod in our yard.In summary, due to lack of due diligence in workmanship as well as in documentation to include invoicing and factual accounting as well as due to the aggressive manner with which I - a single mother - was treated by MrJ [redacted] , I recommend against hiring this company for any form of work.Respectfully, [redacted] [To assist us in bringing this matter to a close, the consumer must give a reason why they are rejecting the responseIf the consumer does not provide a reason if he complaint will be closed Administratively Resolved]

This letter is in response to Ms.*** ***'s complaint. On May 11th, my company By the Yard removed the existing sod throughout the front yardWe added soil amendment and tilled, raked, and rolled the area for new sodWe then installed new sod throughout the front yardWe then
adjusted all the sprinklers throughout the front and changed a few nozzles to increase coverage. On June 31st, I received an angry phone call from *** stating that she had a leak in her front drip system, that she was going to call someone to come repair the problem, and then send me the invoiceI stated that this is not how a warranty/ responsibility call would be handledI stated I would be happy to come out and repair the damaged once I ascertained whether the issue was something we had causedShe became agitated and said this was only possible if I could be there within the hourI told her I would do my best and be right over. When I arrived at the property Ms*** she then stated that the repairs had already been completed and that she would again send me the billI then reviewed where the damaged lines were and admitted we probably had damaged one of the breaksThe break I admitted responsibility for was near the drive where the original installers of the drip only placed the drip line just below the grassThis repair would take ~ seconds to repair as it was only at a 2" depthThe second break was at the top of the lawn and was more than a foot deep right next to an established tree and could not have been damaged by our tiller. I agreed to pay for the damaged line by the street up to $This is what I would have charged to repair this line$ for a 1/2" compression coupling and $ for labor plus taxMs*** then sent me a copy of her bill for $ for the repairs she felt I was responsible forThe materials and the labor was not itemizedBecause of the gross overcharging on this bill I reviewed the company used to make repairsThe company *** *** * *** *** is not licensed in the state of New Mexico, nor does Taxation and Revenue have them in their systemI contacted the company and they could not and would not give me a breakdown of the time spent repairing the drip breaksI contacted the Construction Industries Division and spoke at length with their officeI sent Ms*** a complaint form from their office to report unlicensed contracting and the contact numbers she would need in order to remedy this situationShe refused and then wanted me to pay for her water use during this period. As for due diligence regarding this issueWe did not repair, inspect, or otherwise run her drip system during the installation of the lawnThus we would not have had any knowledge of a leak for us to repairThis drip system ran for over two months before I received a callPerfections invoice stated this was an emergency repairOne can only wonder if this was such a terrible leak why it took two months to be addressed. With regards to me being so called "aggressive" on the phone, per New Mexico state law I use a hands free device while drivingDepending on the connection and where I may be in the city my reception can be spottyI told Ms*** this because she accused me of being angry and yelling on the phone, to which I stated I was speaking loudly because I could not hear her well and assumed she could not hear meI went above and beyond my responsibility to help Ms*** and unfortunately became the focus of her frustrationIf she had simply been patient I would have repaired the damaged line and she would not have been grossly overchargedI hold no animosity towards Ms*** and wish the situation could have been handled with a more desirable outcome. In conclusion, this should be a lesson for everyone not to use contractors that are unlicensed, uninsured, and who don't pay their taxes.Sincerely,Brad J***
