Review: Mr Byers bid on construction of a 4 season room for our home. We accepted his bid and signed his proposal on April 21, 2014. At that time he asked for and received a deposit of $8000.00, approximately one third of the project cost. We were told it would be 10-12 weeks before the work could commence. There was some preparation work that had to be done before the room could be constructed. This required removal and replacement of a small piece of patio to square it off. We were looking at mid-July for the construction to begin. Mr Byers told us he wanted to get the patio taken care of ahead of the onset of construction so the concrete would have time to cure. I attempted to contact Mr Byers on June 12 to confirm our project was still a go for mid-July because we wanted to get carpeting and furniture ordered. I left a voice mail since he did not answer the phone. On July 14, 21, 23, 25, 30 and Aug 5 I placed calls to him, literally begging him to return my calls and give us a status update. No response.

Finally, on Aug 9, we decided to contact his supplier, [redacted] in Erie, PA, since Mr Byers is an authorized dealer/distributor of their products. [redacted] had no record of Mr Byers placing an order in our name. They did, however, have his cell phone number (###-###-####). I called Mr Byers cell phone number using a phone that did not identify the caller. He answered after about 4 rings. As soon as I told him who I was I detected a hint of surprise and his voice became nervous. Suddenly he was apologetic for not returning my calls and he gave an excuse of his son needed surgery and that's why he hadn't called me back. All I wanted from him was a date when he was going to construct our addition. He said he was going into his office that afternoon (it was a Saturday) and try to get caught up on things and that he would call me at the beginning of the week. I asked if that would be Monday and he said probably Tuesday (Aug 12). At this point he has had our $8000 for 4 months and nothing has been done.

He did call on Aug 12 and said he was behind in his work and that we were now looking at mid-September before he could do the job. We were not thrilled with that news because that meant another month of waiting. Our carpet was in and ready for installation. The furniture was due in any day. We said okay, but if anything changed he was to let us know. He said he would. He lied. We waited a couple of weeks and I had a gut feeling something wasn't right. I called him on Aug 29 to confirm the mid-September start date. He was hesitant to commit to the date saying things were hectic trying to keep people like me happy. He said he didn't know for sure until he checked his schedule. He told me he would call me the Tuesday after Labor Day (Sep 2). Today marks a week and I have yet to get the call. I have sent him two emails to his business using the address on his web site. Email address is [redacted] and his web site is http://www.byershomeimprovements.com/. They have gone unanswered also. In them I told Mr Byers that we no longer want him to do the work, we are voiding the contract and want our $8000 returned immediately.

I have begun doing some research and found out he was given an "F" rating on Angie's List for contracting a job, taking a $3500 deposit and never doing the work or returning the money. His [redacted] page has one review and it certainly is not an endorsement. People tried to get him to come back for two years to fix something. He never went back. I talked to his supplier again yesterday and they are going to check their records to seen when he last placed an order. I also found out that their ship time for an order is only 4 weeks, not 10-12 as we were led to believe. I also called the local office that issues building permits and found out that he has not even applied for a permit. Now he's had our $8000 for 20 (twenty) weeks and has done no work.

A neighbor told me there is a time frame of 6 months in which you can request a refund, after that you forfeit your deposit. I have a very strong feeling that Mr Byers is trying to stall us for 6 months and one day.Desired Settlement: I would like our $8000 returned immediately in the form of a certified or cashier's check. Not a penny more and not a penny less. It doesn't appear as though he has incurred any expenses on our behalf. I'd also like to see his business be given your lowest rating along with a warning to avoid doing business with him. If you cannot resolve this quickly, I will be forced to press charges against Mr Byers. My time frame is getting short and things need to happen. Appreciate anything you can do to help. Also, the address you have for him is a P.O.Box. His office is physically located at [redacted] in [redacted], PA. I have sent him a certified, restricted delivery letter to his office address which basically tells him he's fired and we want our money back. I have my doubts that he'll bother to sign for the letter. Also, if you try to contact him, I also have my doubts that you'll get any response. Mr Byers is also on the [redacted] Township Board of Supervisors. Their office phone number is ###-###-#### and they are physically located at [redacted], PA [redacted].
