December 05, 2015On July 23, [redacted] purchased a [redacted] ***We were able to obtain financing for [redacted] through [redacted] (***)The day [redacted] took delivery of the vehicle he missed signing a line of the retail installment contractWe did not realize he had missed signing that line until we were notified by the bank (***)The bank returned the contract back to us, we phoned [redacted] to notify him of the missed signature and he came in willingly to sign the line he missedWhen we returned the contract to the bank they somehow lost it, we do have tracking numbers from the U.SPost Office proving it was delivered to the bank, however the bank misplaced itBecause the bank misplaced the contract [redacted] never received correspondence from *** [redacted] contacted us on November 18, to inform us he had not made a single payment yet (keep in mind he's been driving the car since July 23)He also stated the bank had no record of himWe immediately called ***, and they did not process his loan because the contract was misplacedBecause it wasn't processed the assignment is still with us [redacted] also said they would honor the same approval provided the customer signed a new installment contract so that he wouldn't be four months behind in payments and provide an updated pay stubWe informed [redacted] of the bank's decision to continue to honor his loan approval even though it was days later [redacted] informed me he did not want the car he could not afford the monthly paymentI asked him what changed in the four months he had the car he said nothing; he thinks the payment is too highI asked him if sent his information to a new bank we started doing business with to lower his payment would he be okay with that, he said yesThe new bank we sent his credit application to agreed to offer a loan at a much lower interestrate, therefore reducing his monthly payment approximately one hundred dollars per month [redacted] informed me he knows how America works, he doesn't want the car and he is returning itI explained to [redacted] there is a First payment default clause in the installment agreement he signed.Because the Contract (installment loan contract) is being held by us, and because [redacted] has refused to make a payment we have no other recourse than to place a notification of a voluntary repossession against his creditWe will also use every legal remedy available to us including but not limited to going to court to place a Judgment against [redacted] for the funds owed to us by [redacted] ***We have done our very best to assist [redacted] in purchasing a vehicle of his choice and obtain financing for [redacted] *** [redacted] asked for sometime to consider his options, we agreed to thatSince [redacted] has ignored our phone calls and refused to return calls to us I am assuming he ran to you, the Revdex.com for assistanceI believe we have given [redacted] ample time to consider his options and he made a decisionI will allow you ample time to review and go over with [redacted] ***I will start legal proceedings no later than December 17, We have done everything to assist [redacted] in a professional and ethical manner.Should you have any questions please contact me any time Monday through Friday from 9:30AM to 6:00PM.Thank you,Paul JGeneral Manager
