Findings from interviewing drivers that went to Mr [redacted] 's house: Mr [redacted] exhibited gross negligence while purposely directing the backing of dump trucks into his driveway where he instructed the driver to straddle the concrete and the grass to avoid cracking concrete even more than it was The drivers expressed concern to Mr [redacted] about breaking the concrete even more, he still directed them into his driveway where the first truck did no damage only because it's a very small truck The second truck he directed broke the concrete and he still gave the driver a thumbs up saying perfect The third truck was even bigger than the first and did the final breaking of the concrete, still Mr [redacted] directs the truck into the driveway At this point Mr [redacted] calls me telling me the trucks broke his driveway and he wants me to fix it I told him he was warned that the trucks would cause damage to drive way but he still backed them in causing damage At this point another load was on the way to Mr [redacted] 's house to dump the last load and he still directs the truck on the same broken concrete When I spoke with Mr [redacted] he immediately started asking for my insurance to file a claim to fix his concrete, he even went as far as having someone else call in an order for rock and whoever it was asked for my insurance to give to their mortgage company before I could deliver the load I knew at this point Mr [redacted] was behind the call because I have been in business for a long time and no one has ever ask for my insurance to deliver load of rock I talked again with Mr [redacted] and told him I had no insurance that would cover intentional acts, insurance was for accidents and this was no accident, he backed those trucks in on purpose At this point, I knew they were scamming me and I cut all conversation with Mr [redacted] [redacted] Owner

Complaint: I am rejecting this response because of inaccuracies in the owners storyI directed the dump trucks into the driveway but told each of the drivers before they were even on my property of where they needed to drivethe first driver did as instructed but the second did notI certainly did not give him a thumbs up saying go aheadMy full statement of events is as followsOn April 2016, I called inquiring about getting dirt delivered to my houseI was told that they were busy but to text the number I just called and he (***) will take down my name and address and he will call me when ready to deliverThe next day, April 5, I got a call at about pm saying if I am ready they will be sending trucks my way with the dirt requestedI told him I am ready and to send themI met the first truck on the road in front of my houseIt was a small dump truckI instructed him that he needed to back up into my yard via the side grass on the side of my driveway by the roadI directed him onto the first section of driveway by the road (the one with the culvert) and then immediately off the driveway and onto the grass as I had told him while on the streetHe did as instructed and dumped dirt with no issuesAs he was pulling away the second truck came down but this time it was a much larger truckI instructed the second driver as I did the first and he said he understood, but it became apparent that he did not fully understand the instructions as he did not make his way onto the grass area in enough time to stay off the very end of my driveway by my houseI was waving him to stop and that he needed to move over but he did not see me or heed my instructionsThe initial damaged occurred during this time and I proceeded to let him dump after he made it off the drivewayAfter he dumped I told him he needed to stay on the grass on the side until he got to the end of the driveway, but he did not listen and went straight on to the end of the driveway causing more damageAbout ten minutes later the third driver (***) showed up with an even bigger truckI was told this was the largest truck they have, I then asked if he thinks he can get it to where it needs to be he said yes shouldn't be a problemI gave him same instructions as the first and second driver and even told him not to put any tires on the front of the drive way by the house and he said "don't worry he won’t touch it like the second guy did"He did as was instructed but then he started to sink when he was backing up and he quickly moved forward to keep from getting stuck, while in the process of moving forward his back tire caught the edge of the concrete drive and pushed it further down and making the damage more severe [redacted] had to dump the load beside the driveway as it was apparent the truck was too large for my residential areaHe apologized but said there was nothing he could do as he thought he was going to get stuckHe got out and tried calling his boss a couple of times with no answer and said that he will tell him what happened and get him to call meI had one more load of dirt coming and when it arrived it was in a smaller "more versatile" truck driven by [redacted] (the third driver of the largest truck)Before the truck arrived I called [redacted] and he said to show damage to last driver and have him look at itSince [redacted] was last driver, I told him what [redacted] told me to do and he said he will tell him what happened and will call me tomorrow morningI told him ok sounds good and paid him and took the receiptThe time now was approximately PM Tuesday April 4thI waited until about 8AM the next morning April 6th then called ***I was told that it was my fault and that everyone knows that dump trucks are not responsible for damages to concreteI then asked him “when did you tell me this”? Not once before did he mention it or was it written on the receiptHe then said the drivers did what I told them and there is nothing he was going to doI told him again no they didn't the second driver did not do as instructedHe asked for photos and ended the conversationI got photos of the driveway and texted them to himHe replied back with a number to a gentleman name [redacted] , [redacted] said didn’t know what he will charge me but he will fix itI replied back to his asking is this is his resolve "saying it’s not your fault and make me pay full price to fix something his company damaged"There was no reply and so I tried calling him again and that’s when I noticed that he blocked my number as it was going straight to voicemailAfter trying to contact via Facebook I realized that he had no intentions of making amends of the damageThen after a couple of Facebook posts from his personal Facebook account telling me he blocked me as he thinks it’s my fault I decided file an insurance claimI have screenshots of all communication as well as pictures of the damageI do not deny instructing and directing the drivers but instructions were not followed and this caused unnecessary damages Also it is important to note that [redacted] never came out to view the damage nor did he come out previously to scout the land before accepting the job to supply me with dirtI believe this could have been avoided if he would have sent the size appropriate trucks to the yard which could have been determined if he would have been out to scout the areaI have never made any demands of Mr***, certainly never asked for insuranceWhen I contacted C&M resources I was never made aware or warned that they are not responsible for damages to my propertyAlso if Mr [redacted] would have ever came over to see the damage he would have known that the last load of dirt was not even dumped on my property but in a neighbors yardI did not and have not requested any insurance information from C&M resources because I was blocked at approximately am from the phone contact on April 6th and approximately pm April 6th on his company Facebook pageBefore which I had not asked or spoken with Mr [redacted] for more than or two minutesAs far as assumption that I got someone to call and request rock in order to get his insurance is ludicrousBefore I was blocked and banned from his Facebook and it became apparent that he did not want to communicate with me I had told many of my coworkers of the good quality of materials that I receivedIf they called on their own requesting materials then that is result of their own accordHe has not and did not speak to me personally or text message after the 6th of February at approximately amOther than a Facebook post from a shared account (there is no way to tell who sent that message) there has been no contact from Me to C&M resources [redacted]

I am rejecting this response because of inaccuracies in the owners story. I directed the dump trucks into the driveway but told each of the drivers before they were even on my property of where they needed to drive. the first driver did as instructed but the second did not. I certainly did not give him a thumbs up saying go ahead. My full statement of events is as follows. On April 4 2016, I called inquiring about getting dirt delivered to my house. I was told that they were busy but to text the number I just called and he ([redacted]) will take down my name and address and he will call me when ready to deliver. The next day, April 5, I got a call at about 4 pm saying if I am ready they will be sending 4 trucks my way with the dirt requested. I told him I am ready and to send them. I met the first truck on the road in front of my house. It was a small dump truck. I instructed him that he needed to back up into my yard via the side grass on the side of my driveway by the road. I directed him onto the first section of driveway by the road (the one with the culvert) and then immediately off the driveway and onto the grass as I had told him while on the street. He did as instructed and dumped dirt with no issues. As he was pulling away the second truck came down but this time it was a much larger truck. I instructed the second driver as I did the first and he said he understood, but it became apparent that he did not fully understand the instructions as he did not make his way onto the grass area in enough time to stay off the very end of my driveway by my house. I was waving him to stop and that he needed to move over but he did not see me or heed my instructions. The initial damaged occurred during this time and I proceeded to let him dump after he made it off the driveway. About ten minutes later the third driver ([redacted]) showed up with an even bigger truck. I was told this was the largest truck they have, I then asked if he thinks he can get it to where it needs to be he said yes shouldn't be a problem.
