Initial Business Response /* (1000, 5, 2015/06/02) */
As I stated to the customer yesterday 6/1/2015. There was a open dispatch for her address due to the damage to the cart and the owner was working on getting them out. This is general done on there pick up day. Today just happens to be her pick...

up day. So when she goes to get her cart from the road she will see that it has been replaced and we ask all customers to keep there carts clean. This assure less wear and tear on the equipment.

In regards to Mrs. [redacted]'s allegations of damage to her driveway. It is impossible for our truck...

to drop a container because of the system that our trucks use. It is called the Hydraulic hook lift system where there is no safety cable. Mrs. [redacted] was misinformed by whomever was there at her home after the container was delivered. Mrs. [redacted]'s driveway was in deplorable condition upon delivery of the 30 yard container. This is one of the reasons we require every customer to sign our liability waiver and the signature indicates that they have read and understand our company policy. There are no special circumstances for the delivery of this 30 yard. We stand behind our waiver.
Initial Consumer Rebuttal /* (3000, 11, 2016/05/22) */
(The consumer indicated he/she DID NOT accept the response from the business.)
As stated at the time by the driver of the truck he indicated that the safety failed; words used by him not by myself. I stated truthfully that my driveway had cracks but I am insulted by the comment deplorable condition. My cement now has holes in it as well as the cement is caved in. To address the waiver I object to his belief that nothing failed & nothing happened out of the ordinary. Ask the driver he was there as was my son-in-law. The sound was loud, the truck shook and the driver said the safety failed; his words not ours. The evidence is there & I have qualified cement companies who agree with me. I have 2 quotes for the damage; not asking for anything else but what is right. I will not allow this to do go unresolved. My property is off limits to his company & any representatives unless I am contacted first; I will provide my lawyers name and address when needed.

I don't know who they talked to about their driveway issue. It was not our driver. As I stated in my last response we DO NOT operate with the cable system. We operate with the Hydraulic hook lift system making it impossible to drop a container.

YOUR DRIVER DID INDEED DROP THE DUMPSTER AND DID SAY THAT THE SAFETY FAILED! NOT MY WORDS, HIS. HIS TRUCK SHOOK WHEN IT DROPPED. HE WAS WELL AWARE OF THE INCIDENT AND FOR YOU TO EVEN REMOTELY IMPLY THAT IT DID NOT HAPPEN AND THAT I AM MAKING THIS UP IS INSULTING,UNPROFESSIONA AND SO WRONG ON SO MANY LEVELS. THE DAMAGE SPEAKS FOR ITS SELF. TRY AS YOU MIGHT I AM NOT MISINFORMED AND YOU CAN STOP NOW. I KNOW WHAT HAPPENED. YOU SHOULD BE ASHAMED OF YOURSELF. I WIll NOT STAND FOR YOUR ASSUMPTION THAT I AM NOT TRUTHFUL. THE TRUTH ALWAYS COMES OUT AND I HOPE YOUR CONSENCE CAN HANDLE IT.

In regards to Mrs. [redacted]'s complaint Case #: [redacted]
I called her on December 17, 2015 to remind her that her account was past due. At the time she informed me that she had canceled service with our company. I went into her notes on her...

account
Where she was called on November 13, 2015 for the same reason her account was past due.
She decided at that time that she was sending in a check for the $83.73 because I had removed the late fee and she was going to stay with our service.
When I talked to her on December 17, 2015 to let her know that her service was going to be put on hold due to none payment. I was called every nasty name she could think of and she hung up on me. I then in turn called my route manager to let him know so he could pick up our equipment when he arrived she meet him outside with the same nasty mouth and attitude. She told him that he could not have the company's property and she continued with her variable abuse. Until he finally told her that he was going to call the police after that she told him to take it all the while her filthy mouth was going. Now she said she had not been getting our bill. Funny thing I billed her that same day December 17, 2015 sent it to her email the same email we have been sending it to. The next thing that pops up in my email the very next day is a letter from the Revdex.com.
Our company provided her with the service and we expect to be paid the FULL amount and the termination fee that is due immediately.

I am rejecting this response because:
at no point, either when initiating service with the company and more importantly, at the exact time of my requesting an end of service, was I told that it was a policy of the company to not issue refunds  When I called to cancel, I was asked 'did I WANT to continue service until the end of the3 months', to which I replied, no.....I fiind it troubling a company can arbitrarily, it seems to the consumer base, certainly this customer, to inform a customer about a monetary policy AFTER the fact of cancelling the service.  Again, we were offered ONE form of billing, quarterly, and that was surely to the financial benefit of the company, not to the customer.  Generally, if a company keeps my money in advance to save them (in this case, surely) bookkeeping time, I am offered monetary inducement,, i.e., a discount.  Not the case here; I wanted to patronize a minority-owned business in my own community, so that is why I began service with this company.  I find it troubling that the 'sticking local' philosophy if consumerism is appreciated in this instance, nor is their lack of transparency in prepayment billing forgiven for being 'too small'.  Right is right.....and as long as I am supported by Revdex.com's services in this matter, I will not accept their afterthought----well, that's our policy! Respectfully, [redacted]

I would NEVER recommend C. Martin Trucking for rubbish/trash removal. Their fees are excessive and service is limited. Be careful if you select them, as they charge $10.00 per item outside of the bin for pickup such as a small grill or plant stand, etc. In addition, they charge a $35 "Close out" fee. I have paid this company AHEAD of time each time I received their invoice and I questioned the "close out" fee as I was a good customer. The monotone voiced receptionist told me "It is in your contract", which I don't even remember a contract, nor do I remember if I even received a copy of said contract. he then insisted I give them a credit card for these charges. I told her I would do so begrudgingly. I would never recommend this company's service to an enemy, let alone a friend!
